Approve Regulations on network of test laboratories by determination of content of genetically modified organisms in products which is applied.

Regulations on network of test laboratories by determination of content of genetically modified organisms in products

1. This Provision establishes the general principles and the main tasks of network of test laboratories by determination of content of genetically modified organisms in products (further - test laboratories).

2. Network of test laboratories is the system of organizations which is created by the central executive bodies, actionees of the Law of Ukraine "About the state system of biosafety during creation, testing, transportation and use of genetically modified organisms".

3. Test laboratories in the activities are guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, and also other regulatory legal acts in industry of genetic and engineering activities and the address with genetically modified organisms and this Provision.

4. The main task of test laboratories which are included into network of test laboratories is determination by carrying out necessary testing and researches of content of genetically modified organisms and/or products of their conversion in products, in particular grain, seeds of crops, fruit and vegetable products, wine materials, tobacco, landing material, foodstuff, sterns, feed additives, cosmetics, medicines and veterinary medicines, and also other types of products which contain genetically modified organisms and/or are received with their use.

5. Test laboratories have the right:

use in the procedure established by the legislation information which managers are the central executive bodies, National academy of Sciences, National academy of medical sciences, National academy of agrarian sciences, on profile of the activities;

provide test reports to subjects of managing by results of determination of content of genetically modified organisms in product samples;

introduce scientific methodologically to the center for questions of testing of genetically modified organisms (further - the scientific and methodological center) offers concerning enhancement of system of testing of genetically modified organisms and their tracking;

perform on contractual conditions advanced training of specialists of test laboratories based on the scientific and methodological center by passing of rates and training, holding meetings seminars, scientific and scientific and practical conferences;

participate in:

- development and the edition of materials of the scientific, information, methodical and educational direction concerning testing of genetically modified organisms;

- to work of the international organizations and centers which activities answer the purpose of activities of network of test laboratories, and also in the international programs of determination and tracking of genetically modified organisms;

use collections of cultures of microorganisms, vegetable samples and the cloned DNA based on collection of strains of microorganisms and lines of plants for food and agricultural biotechnology of Institute of food biotechnology and genomics of National academy of Sciences;

together with the scientific and methodological center to take part in:

- to development of methods and techniques of identification and determination of genetically modified organisms which will meet international standards, provision of efficiency evaluation of such techniques, including sampling (tests) and identification of transformational events, information materials and recommendations concerning testing of genetically modified organisms, methods of research and modern achievements in this industry for scientific institutions, educational institutions;

- interlaboratory comparisons;

- development and ensuring development of production of domestic test systems for identification and tracking of genetically modified organisms.

6. Scientific and methodical coordination of activities of network of test laboratories is performed by the scientific and methodological center.

7. Requirements to management of test laboratory and its personnel are provided by DSTU ISO/IEC 17025:2006 "General requirements to competence of test and calibrating laboratories".

The list of the requirements to documents and samples necessary for carrying out research on determination of content of genetically modified organisms in products, deadline of carrying out such researches are determined according to the procedure, established by the Cabinet of Ministers of Ukraine.

8. Test laboratories shall be accredited by national authority of Ukraine on accreditation and in case the national authority of Ukraine on accreditation does not perform accreditation of rather corresponding types of activity on assessment of conformity, - national authority on accreditation of other state.

9. Metrological support of means of the measuring equipment which are used in test laboratories is performed according to the legislation in the field of metrological activities.

10. Test laboratories in accordance with the established procedure keep accounting documentation concerning the conducted testing and researches.

11. Financing of test laboratories is performed at the expense of the sources which are not prohibited by the legislation.
