About approval of the Regulations on auction committee on realization of material values of the state reserve

In pursuance of the Law of Ukraine "About the state material reserve" and resolutions of the Cabinet of Ministers of Ukraine of August 25, 2004 No. 1078 "About approval of the Procedure for realization of material values of the state reserve" (with changes), for the purpose of ensuring proper functioning of auction committee on realization of material values of the state reserve, PRIKAZYVAYU:

1. Approve Regulations on auction committee on realization of material values of the state reserve which are applied.

2. Declare invalid the order of the State committee of Ukraine on the state material reserve of December 09, 2010 No. 439 "About approval of the Regulations on auction committee on realization of material values of the state reserve", registered in the Ministry of Justice of Ukraine on December 29, 2010 for No. 1390/18685.

3. To department of economy of defense and (Nebotov P. G.) in accordance with the established procedure to ensure safety submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the First Deputy Chairman of the State agency of reserve of Ukraine Kosichenko M. P.

Regulations on auction committee on realization of material values of the state reserve

I. General provisions

1. This provision determines general organizational and procedural bases of activities of auction committee on realization of material values of the state reserve, including mobilization (further - committee), and also the rights and obligations of his members.

2. The committee in the activities is guided by the Constitution and the laws of Ukraine, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine, other regulatory legal acts in the sphere of the state material reserve, including this Provision.

II. Procedure for creation and organization of activities of committee

1. The committee is headed by the Chairman Gosrezerva or his deputy.

2. The staff of committee affirms the order of the State reserve. At least seven people from whom at least two - representatives of Ministry of Economics, the others - representatives of the State reserve are part of committee.

3. The vice-chairman and the secretary of committee are determined by the chairman of committee from among members of the committee. In case of absence of the chairman of committee of its obligation the deputy performs it. In case of absence of the secretary of committee of its obligation other member of the committee appointed the chairman of committee carries out.

4. The list of the questions which are subject to consideration on committee meeting, and the agenda are led up to members of the committee not later than one working day prior to meeting.

5. Committee meeting is considered competent in case of presence on it at least two thirds of its structure.

6. Decisions on the questions considered on committee meetings are accepted by a simple majority vote by open voting. In case of equal distribution of voices the voice of the chairman of committee is decisive.

7. The decision of committee is drawn up by the protocol which is signed by the chairman and all members of the committee who are present at committee meeting.

The member of the committee who does not support the decision of committee can state in writing the separate opinion attached to the minutes of committee.

8. Committee meetings are held in case of need.

III. Main objectives of committee

1. Treat the main objectives of committee:

combination of the material values which are subject to realization according to the name and quantity in lots;

other tasks provided by the Procedure for realization of material values of the state reserve approved by the resolution of the Cabinet of Ministers of Ukraine of August 25, 2004 No. 1078 (in edition of the resolution of the Cabinet of Ministers of Ukraine of June 27, 2023 No. 644).

IV. Rights and obligations of members of the committee

1. Members of the committee have the right:

submit question for consideration of committee;

get acquainted with materials on holding the auction;

obtain information necessary for accomplishment of the tasks assigned to committee from structural divisions of the State reserve;

state in writing the separate opinion in case of not support of the decision of committee.

2. Members of the committee shall participate in work of committee personally.

3. Chairman of committee:

makes the decision on holding committee meetings;

determines date and the venue of committee meetings;

will organize work of committee;

offers the agenda of committee meeting;

conducts committee meeting;

determines the vice-chairman and the secretary of committee from among members of the committee.

4. Secretary of committee:

informs members of the committee on holding committee meetings;

draws up protocols of committee meetings;

at the request of the chairman of committee performs other organizational work.
