About approval of the Procedure for provision central and local executive bodies of the help of seaports of Ukraine to administration, owners of maritime terminals, to port operators in mitigation of consequences of natural disaster, accidents and catastrophic crashes, and also in prevention of possible illegal and unauthorized interventions in port activities

According to article 12 of the Law of Ukraine "About seaports of Ukraine" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for provision central and local executive bodies of the help of seaports of Ukraine to administration, owners of maritime terminals, to port operators in mitigation of consequences of natural disaster, accidents and catastrophic crashes, and also in prevention of possible illegal and unauthorized interventions in port activities which is applied.

Procedure for provision central and local executive bodies of the help of seaports of Ukraine to administration, owners of maritime terminals, to port operators in mitigation of consequences of natural disaster, accidents and catastrophic crashes, and also in prevention of possible illegal and unauthorized interventions in port activities

1. This Procedure determines the mechanism and conditions of provision of necessary assistance central and local executive bodies in mitigation of consequences of natural disaster, accidents and catastrophic crashes which happened in the territory and the water area of seaports, and also in prevention of possible illegal and unauthorized interventions in port activities that creates threat of life or to human health, safe seaworthiness, operation of vehicles in seaport and safety of freights.

The help is provided central and local executive bodies within their powers and in case of availability of the corresponding forces and means.

2. In this Procedure terms are used in the value given in the Code of civil protection of Ukraine and the Law of Ukraine "About seaports of Ukraine".

3. The help is provided for mitigation of consequences of natural disaster, accidents and catastrophic crashes in case the administration of seaports of Ukraine has no sufficient forces and means for independent liquidation of such consequences.

For the purpose of mitigation of consequences of the specified incidents administration of the relevant seaport, owners (users) of maritime terminals, port operators act according to the plan of localization and accident elimination (catastrophic crashes) for the territories and water areas of seaport.

The plan of localization and accident elimination (catastrophic crashes) determines tasks, amount and conditions of action (interaction) of subjects of managing in port for the purpose of prevention of emergence of accident, its localization and liquidation and minimization of its consequences, immediate response to accident or threat of its origin and provides implementation of package of measures for stop of its development and complete liquidation of consequences of accident, and also determines the list of the courts, the equipment, devices and mechanisms necessary for localization and accident elimination which affirms administration of seaports of Ukraine in coordination with the captain of seaport and owners (users) of maritime terminals and port operators.

4. For the purpose of prevention of possible illegal and unauthorized interventions in port activities that creates threat of life or to human health, safe navigation, operation of vehicles in seaport and safety of freights, owners (users) of maritime terminals, port operators through administration of the relevant seaport in writing address administration of seaports of Ukraine.

Responsibility for provision of unreliable or inveracious information of rather natural disaster, accidents, catastrophic crashes, illegal and unauthorized intervention in port activities is assigned to persons who extend it.

5. The administration of seaports of Ukraine for the purpose of non-admission of violations of the law and emergence of danger within seaports interacts:

with the Ministry of Internal Affairs, GSChS and the corresponding local executive bodies - concerning illegal and/or unauthorized intervention in port activities that creates threat of life and to human health and safety of freights;

with Administration of navigation and the corresponding local executive bodies - concerning illegal and/or unauthorized intervention in port activities that creates threat to safe navigation and operation of vehicles in seaport;

with the Ministry of Defence, GSChS and the corresponding local executive bodies - concerning mitigation of consequences of natural disaster, accidents and catastrophic crashes.

For the purpose of taking measures to non-admission of emergence of danger within seaports and timely response to it the administration of seaports of Ukraine together with central and local executive bodies develops and approves the corresponding plans of interaction.

6. The common directorship the organization and holding actions and works on mitigation of consequences of natural disaster, accidents and catastrophic crashes which happened in the territory and the water area of seaports and also attraction of necessary forces and means irrespective of their subordination is performed by administration of seaports of Ukraine in the procedure established by the legislation and according to the plan of localization and accident elimination (catastrophic crashes) and plans of interaction specified in paragraph five of Item 5 of this Procedure.

For the purpose of direct management of works during emergence of natural disaster, accidents and catastrophic crashes, liquidation of their consequences, and also on prevention of possible illegal and unauthorized interventions in port activities that creates threat of life and to human health, safe navigation, operation of vehicles in seaport and safety of freights, administration of seaports of Ukraine is appointed the works manager on mitigation of consequences of emergency situations.
