About approval of the Technique of determination of the available or absent free handling capacity (capacity) of the Single gas-transport system of Ukraine

According to part seven of article 7 of the Law of Ukraine "About bases of functioning of the natural gas market" PRIKAZYVAYU:

1. Approve the Technique of determination of the existing or absent free handling capacity (capacity) of the Single gas-transport system of Ukraine which is applied.

2. To the director of the department of questions of production of traditional and alternative types of fuel Ruban I. V. provide submission of this order on state registration in the Ministry of Justice of Ukraine in accordance with the established procedure.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the deputy minister - the chief of staff of Bondarenko A. Yu.

Technique of determination of the available or absent free handling capacity (capacity) of the Single gas-transport system of Ukraine

I. General provisions

1.1. This Technique developed according to the Law of Ukraine "About bases of functioning of the natural gas market" and the Regulations on the Ministry of Fuel and Energy of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 382.

Action of this Technique extends to the gas, gas-distributing transportation companies and the operator of the Single gas-transport system of Ukraine (further - the operator).

1.2. The reducings applied in this Technique have the following values:

EGTSU - Single gas-transport system of Ukraine;

The ODS - the gas company;

GP - the gas-distributing company;

GRM - gas distribution networks;

GRP - gas control Item;

GIS - gas-measuring station;

GRS - gas distribution station;

GTP – gas transmission company;

MG - trunk gas pipeline;

UGS - underground gas storage.

1.3. The terms used in this Technique have the following values:

free throughput of components of EGTSU (gas network, the gas pipeline, the section of the pipeline) - difference between the technically feasible (optimum) throughput of EGTSU (gas network, the gas pipeline, the section of the pipeline) during certain period of time and all subjects of the natural gas market contracted for this period by transportation loads of natural gas;

Single gas-transport system of Ukraine (EGTSU) - the industrial complex consisting of trunk gas pipelines and gas distribution networks, underground gas storages and others organizationally and technologically related objects and constructions intended for transportation, distribution and storage of natural gas;

replacement - the process connected with features of functioning of EGTSU in case of which supply of natural gas is performed irrespective of availability of physical capacity of transportation of natural gas from point of entry to point of its exit. At the same time natural gas of one owner (origin) can be used by other owner on condition of receipt of equivalent amount of natural gas for this owner in other point of entry in EGTSU;

gas discharge Item from EGTSU (exit Item) - Item EGTSU which according to the legislation is equipped with gas metering station through which gas is supplied with EGTSU to consumers of Ukraine and customers of services of gas transit;

gas input Item in EGTSU (entrance Item) - Item EGTSU which according to the legislation is equipped with gas metering station through which gas arrives in EGTSU from the gas companies of Ukraine, gas importers and other subjects of the natural gas market (residents or nonresidents) which order services of gas transit on the territory of Ukraine;

reserve of capacity of components of EGTSU (capacity reserve) - difference between the technical throughput of the constituting EGTSU in certain point of ensuring capacity and the size of the capacity permited other customers (consumers) including the capacity ordered to accession;

technical handling capacity (capacity) of components of EGTSU - the greatest possible overflowing of amount of natural gas under standard conditions for unit of time through gas pipeline section in point of ensuring capacity which GP (GTP) can provide to customers, taking into account integrity of system and requirements for operation of components of EGTSU;

interconnect points - point of entry and exit of EGTSU (border gas-measuring stations) in which accounting of overflows of gas between gas-transport systems of the adjacent countries is performed;

integrity of system - any situation in the constituting EGTSU in case of which pressure and physical and chemical indicators of gas remain in limits between the minimum and maximum levels determined GTP (GP) that technically guarantees transportation of natural gas.

Other terms are used in this Technique in the values given in the Law of Ukraine "About bases of functioning of the natural gas market", the Procedure for access and accession to the Single gas-transport system of Ukraine approved by the resolution of the National commission performing state regulation in the sphere of power, of April 19, 2012 No. 420, registered in the Ministry of Justice of Ukraine on May 7, 2012 for No. 721/21034 (further - the Procedure for access and prisoyedineniyak EGTSU), and the Procedure for development and coordination of the balance year balance of receipt and distribution of natural gas in Ukraine, planned (settlement) balance of receipt and distribution of natural gas and forming and approval of planned distribution of supply of natural gas to consumers, No. approved by the order of the Ministry of Fuel and Energy of Ukraine of November 26, 2012 920, registered in the Ministry of Justice of Ukraine on January 31, 2013 for No. 196/22728 (further - the Procedure for development and coordination of balance of receipt and distribution of natural gas to consumers).

1.4. GP (GTP) and the operator EGTSU determine the size of the existing or absent free throughput of components of EGTSU according to this Technique.

For refusal in access or accession to EGTSU based on absence or insufficiency of free throughput of components of EGTSU it is necessary to provide respect for such criteria as objectivity, transparency and nondiscriminations.
