About the organization of kliniko-expert evaluation of quality of medical care
According to subitems 6. 5, 6.53 subitems 6 of item 4 of the Regulations on the Ministry of Health of Ukraine approved by the Presidential decree of Ukraine of April 13, 2011 No. 467, and for the purpose of realization of provisions of paragraph two of Item 8 of the Procedure for quality control of medical care , No. approved by the order of MZ Ukraine of September 28, 2012 752, PRIKAZYVAYU registered in the Ministry of Justice of Ukraine on November 28, 2012 for No. 1996/22308,:
1. Approve:
1) Regulations on kliniko-commission of experts of the Ministry of Health of Ukraine which is applied;
3) Regulations on medical council of healthcare institution which is applied.
2. Determine Management of quality control of medical services responsible for the organization of work, activities, coordination and control of activities of kliniko-commissions of experts in the Ministry of Health of Ukraine and regions.
3. To the Minister of Health of the Autonomous Republic of Crimea, heads of structural divisions concerning health care of the regional, Kiev and Sevastopol city public administrations to ensure functioning of kliniko-commissions of experts according to this order.
4. To provide to management of quality control of medical services (T. Donchenko) in accordance with the established procedure representation this order on state registration in the Ministry of Justice of Ukraine.
5. This order becomes effective from the date of its official publication.
6. To impose control over the implementation of this order on the deputy minister A. Tolstanov.

1.1. The Kliniko-commission of experts of the Ministry of Health of Ukraine (further - KEK MZ of Ukraine) is permanent body which is created for joint consideration of kliniko-expert questions of diagnostics, treatment and rehabilitation in healthcare institutions (further - UZ) irrespective of pattern of ownership and subordination (further - UZ) and at physical persons - entrepreneurs (further - FLP) who perform economic activity on medical practice on delivery of health care and medical services.
1.2. The basis for consideration of KEK MZ of Ukraine of the appropriate clinical questions of diagnostics, treatment and rehabilitation in UZ and FOT and implementation of kliniko-expert evaluation of quality of medical care and medical services according to this Provision is the order MZ of Ukraine.
1.3. KEK MZ of Ukraine in case of accomplishment of the tasks assigned to it is guided by the Constitution of Ukraine , the laws of Ukraine, acts of the President of Ukraine, the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, regulatory legal acts of the Ministry of Health of Ukraine and this Provision.
1.4. The Ministry of Health of Ukraine performs coordination, advisory and consultative functions on the organizations of work of kliniko-commissions of experts of the Autonomous Republic of Crimea, structural divisions for health care of the regional, Kiev and Sevastopol city public administrations.
2.1. KEK MZ of Ukraine carries out kliniko-expert evaluation of quality and amounts of medical care and medical services by examination of clinical questions of diagnostics, treatment and rehabilitation, availability of the corresponding qualification of specialists in the direction of provision of medical care and medical services.
The Kliniko-expert evaluation of quality and amounts of medical care and medical services is made within 30 calendar days from the date of receipt of request or the appeal of physical persons and legal entities. In case of impossibility of decision making during this time the term of consideration can be prolonged for 15 calendar days.
2.2. By results of the carried-out kliniko-expert evaluation of quality and amounts of medical care and medical services KEK MZ of Ukraine constitutes the conclusion in the form given in appendix to the Procedure for the quality control of medical care approved by the order MZ of Ukraine of September 28, 2012 No. 752, registered in the Ministry of Justice of Ukraine on November 28, 2012 at No. 1996/22308.
3.1. Prepare for management of the Ministry of Health of Ukraine offers concerning ways of improvement of quality of medical care and medical services.
3.2. Inform the Ministry of Health of Ukraine, the Ministry of Health of the Autonomous Republic of Crimea, structural divisions concerning health care of the regional, Kiev and Sevastopol city public administrations on qualification of specialists, provided medical care and medical service, for taking measures according to Regulations on procedure for carrying out certification of doctors , approved by the order of the Ministry of Health of Ukraine of December 19, 1997 No. 359, No. 14/2454 registered in the Ministry of Justice of Ukraine on January 14, 1998.
3.3. Involve in carrying out kliniko-expert evaluation of quality of medical care and medical services of experts of KEK MZ of Ukraine for making the expert opinion.
3.4. Inform the Main accreditation commission of MZ of Ukraine, the accreditation commissions or the accreditation commissions which are formed under the Ministry of Health of the Autonomous Republic of Crimea, structural divisions concerning health care of the regional, Kiev and Sevastopol city public administrations, about the revealed shortcomings for taking measures according to the Procedure for accreditation of the healthcare institution approved by the resolution of the Cabinet of Ministers of Ukraine of July 15, 1997 No. 765.
