About approval of the Regulations on federal state control (supervision) in the field of transport safety

According to article 11.1 of the Federal law "About Transport Safety" Government of the Russian Federation decides:

1. Approve the enclosed Regulations on federal state control (supervision) in the field of transport safety.

2. To the Ministry of Transport of the Russian Federation in coordination with the Ministry of Internal Affairs of the Russian Federation, Federal Security Service of the Russian Federation and the Ministry of Economic Development of the Russian Federation within 6 months from the date of adoption of this resolution to approve:

the list of the objects of transport infrastructure and vehicles referred to the first category on which remote observation of execution of requirements in the field of transport safety using audio-and video systems is performed, stipulated in Item 8 Provisions, approved by this resolution;

Regulations on federal state control (supervision) in the field of transport safety

1. This Provision establishes procedure of federal state control (supervision) in the field of transport safety directed to the prevention, identification and suppression of violations by subjects of transport infrastructure, carriers, builders of objects of transport infrastructure (further - subjects of supervision) the mandatory requirements established according to the Federal Laws and other regulatory legal acts of the Russian Federation in the field of transport safety (further respectively - federal state control (supervision), requirements in the field of transport safety).

2. Authorized federal executive body on implementation of federal state control (supervision) is the Federal Service for the Oversight of Transport and its territorial authorities.

Federal state control (supervision) is exercised by the state transport inspectors - officials of Federal Service for the Oversight of Transport and its territorial authorities (further - the state transport inspector).

3. Subject of implementation of federal state control (supervision) is execution by subjects of supervision in the course of implementation of their activities of requirements in the field of transport safety.

4. Provisions of the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" taking into account features of the organization and conducting the checks established by parts 3 - the 6th article 11.1 of the Federal law "About Transport Safety" are applied to the relations connected with implementation of federal state control (supervision), the organization and conducting checks of legal entities and individual entrepreneurs.

4(1). Federal state control (supervision) is exercised using risk - the oriented approach according to the procedure, established by this Provision.

4(2). For the purpose of application risk - the oriented approach when implementing federal state control (supervision) activities of subjects of supervision are subject to reference to one of categories of risk according to Rules of reference of activities of legal entities and individual entrepreneurs and (or) used by them production facilities to certain category of risk or certain class (category) of danger approved by the order of the Government of the Russian Federation of August 17, 2016 No. 806 "About application risk - the oriented approach under the organization of separate types of the state control (supervision) and introduction of amendments to some acts of the Government of the Russian Federation".

4(3). Reference of activities of subjects of supervision to categories of risk is performed by the decision of the head of territorial authority of Federal Service for the Oversight of Transport or person fulfilling its duties in the location of the subject of supervision according to criteria of reference of activities in the field of transport safety to certain category of risk according to appendix.

If the subject of supervision performs the activities which are subject to federal state control (supervision) by several territorial authorities of Federal Service for the Oversight of Transport, the decision on reference of its activities to categories of risk is made by the decision of the Head of the Federal Service for the Oversight of Transport or person fulfilling its duties according to the criteria of reference of activities in the field of transport safety to certain category of risk provided by appendix to this Provision.

4(4). In the absence of the decision on reference of activities of the subject of supervision to certain category of risk its activities are considered referred to category of low risk.

4(5). Change of the decision on reference of activities of the subject of supervision to category of risk is accepted by the officials specified in item 4 (3) this provision, in case of receipt in Federal Service for the Oversight of Transport or its territorial authorities of information on change of the indicators of activities of the subject of supervision specified in the criteria of reference of activities in the field of transport safety to certain category of risk provided by appendix to this Provision.

4(6). Conducting planned inspections of subjects of supervision depending on the category of risk appropriated to their activities is performed with the following frequency if other is not provided by the Federal Laws:

a) for category of extremely high risk - once a year;

b) for category of high risk - 1 time in 2 years;

c) for category of significant risk - 1 time in 3 years;

d) for category of average risk - is not more often than 1 time in 4 years;

e) for category of moderate risk - is not more often than 1 time in 5 years;

e) for category of low risk - is not more often than 1 time in 10 years.

4(7). Inclusion in the annual plan of conducting planned inspections of legal entities and individual entrepreneurs of check concerning subject of supervision which activities are referred to categories of extremely high, high, considerable, average, moderate or low risk is performed in case of the expiration (in year of conducting planned inspection) stipulated in Item 4(6) this provision of period of time from the date of:
