1. Approve:

1) Regulations on the Commission on questions of issue of the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components (further - the commission) according to appendix 1 to this order;

2) structure of the commission on questions of issue of the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components, according to appendix 2 to this order.

2. To impose control of execution of this order on the Vice-Minister of Health of the Republic of Kazakhstan Bayzhunusov E. A.

3. This order becomes effective from the date of its signing.

Regulations on the Commission of the Ministry of Health of the Republic of Kazakhstan concerning issue of the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components of the person

I. General provisions

1. This Regulations on the Commission on questions of issue of the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components (further - the commission) are developed according to the subitem 17) of Item 16 of the Regulations on the Ministry of Health of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 28, 2004 No. 1117 and determines procedure for decision making concerning issue of the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components of the person, including biological liquids.

2. According to this Provision the import permit and export of fabrics and (or) bodies (part of bodies), blood and its components (further - permission) get the organizations of health care having the corresponding license for occupation medical activities.

3. The organization of work of the Commission is provided by Department of the organization of the help of the Ministry of Health of the Republic of Kazakhstan (further - Department).

4. The commission - is created for review of the documents submitted by the organizations of health care, determination of degree of competence and their compliance, to requirements of the legislation in the field of health care, and also feasibility of import or export of fabrics and (or) bodies (part of bodies), blood and its components of the person, including biological liquids.

Following the results of meeting the Commission makes the decision on issue or refusal in issue of permission.

II. Structure of the Commission

5. The commission is created of representatives of central office of the Ministry of Health of the Republic of Kazakhstan (further - the Ministry), Committee of control of medical and pharmaceutical activities of the Ministry.

Commission chairman is the deputy manager of the Ministry.

6. The structure of the Commission affirms the order of the head of the Ministry.

7. The total quantity of members of the commission shall constitute odd number and to be at least 7 people.

8. Commission chairman:

1) performs the common directorship of work of the Commission;

2) appoints date of the regular meeting of the Commission;

9. Secretariat of the Commission:

1) performs preparation of materials;

2) provides preparation and signing of the protocol following the results of commission session;

3) will be organized by carrying out commission session.

III. Regulations of work of the accreditation commission

10. Commission:

- performs consideration of requests of the organizations of health care for issue of permission (in process of their receipt);

- resolves issue of issue or refusal in issue of permission.

11. The organizations of health care sending inquiries for issue of permission for the purpose of import (export) of fabrics and (or) bodies (part of bodies) of blood and its components provide the following documents:

1) request of the organization of health care;

2) copy of the certificate on state registration (state re-registration) of the legal entity;

3) the copy of the license for medical activities and appendices to the license on the corresponding specialty.

12. As a result of discussion of the provided materials Commission makes the decision by a majority vote, in the presence of 2/3 members of the commission.

13. Following the results of commission session by the commission chairman the decision issue or refusal of issue of permission is made.

14. Permission is issued in the form of the letter with indication of about the consent of the Ministry to import or export of fabrics and (or) bodies (part of bodies), blood and its components of the person, including biological liquids.
