Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of assessment of conformity.

Article 2. Legislation on assessment of conformity

The legislation on assessment of conformity consists of this Law and other acts of the legislation. If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about assessment of conformity then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

accreditation - official confirmation by National authority on accreditation of competence of legal entities on performance of works in certain field of activity on assessment of conformity;

area of accreditation - the field of activity of conformity assessment body established by National authority on accreditation in case of accreditation;

inspection check-up - the procedure of periodic repeated assessment of products, production processes, services, systems of management, conformity assessment bodies performed for the purpose of confirmation of conformity to their requirements established during assessment of conformity;

 inspection body - the legal entity accredited in accordance with the established procedure for conducting pre-shipment and (or) unloading inspection and inspection check-up;

 national accreditation system - the system operating at the national level according to regulatory legal acts, and also the regulating documents in the field of technical regulation determining rules and the procedure of accreditation of conformity assessment bodies;

assessment of conformity - activities for determination of compliance of products, production processes, services, systems of management, personnel, conformity assessment bodies to requirements of regulatory legal acts, and also regulating documents in the field of technical regulation;

 conformity assessment bodies - inspection bodies, test and calibrating laboratories (centers), certification bodies of products, services, systems of management, personnel, being legal entities and accredited in accordance with the established procedure for performance of works on assessment of conformity;

the declaration of conformity - the document in which the producer, the seller or the contractor certifies that products conform to requirements of regulatory legal acts, and also regulating documents in the field of technical regulation;

confirmation of conformity - the documentary certificate (in the form of the certificate on accreditation, the certificate of conformity and the declaration of conformity) based on the decision accepted by National authority on accreditation or conformity assessment bodies that fulfillment of requirements of regulatory legal acts, and also regulating documents in the field of technical regulation is proved;

personnel - the specialists having preparation and qualification for work on assessment of conformity.

Article 4. Main objectives of assessment of conformity

The main objectives of assessment of conformity are:

safety of life and health of the person, property of legal, physical persons and state;

ensuring environmental protection, and also rational use of natural resources;

the certificate of compliance of products, production processes, services, systems of management, personnel to requirements of regulatory legal acts, and also regulating documents in the field of technical regulation;

confirmation of competence of conformity assessment bodies of performance of works in the established area of accreditation;

increase in product competitiveness and services in the internal and external markets;

 participation in international economic, sci-tech cooperation and international trade;

 elimination of technical barriers in trade.

Article 5. Basic principles of assessment of conformity

The basic principles of assessment of conformity are:

application of single rules and assessment procedures of compliance;

reliability and availability of information on assessment of conformity;

inadmissibility of creation of obstacles of use of services of accredited bodies in assessment of conformity and restrictions of the competition between them;

safety of the state secrets, the commercial and protected by the law other secret;

inadmissibility of combination of activities for accreditation with activities for certification, declaring of compliance, to implementation of pre-shipment and (or) unloading inspection, testing of products, issue of the sanitary and epidemiologic, veterinary, veterinary and sanitary, phytosanitary conclusions, conducting environmental assessment.

Article 6. Objects of assessment of conformity

Objects of assessment of conformity are:

 products;

production processes;

services;

systems of management;

 the legal entities applying for receipt of accreditation;

 the specialists applying for participation in the field of assessment of conformity as personnel;

 conformity assessment bodies when carrying out their inspection check-up.

Article 7. Implementation of assessment of conformity

Assessment of conformity is performed in the way:

 accreditations;

 certifications;

declaring of compliance;

inspection check-up;

 pre-shipment and (or) unloading inspection;

 testing of products;

sanitary and epidemiologic, veterinary, veterinary and sanitary, phytosanitary conclusions or environmental assessment.

Article 8. Accreditation implementation

Accreditation is performed for the purpose of confirmation of competence of the legal entities applying for receipt of accreditation.

Accreditation includes the analysis and examination of the documents developed by the legal entities applying for receipt of accreditation, assessment of the obtained evidence by carrying out inspection.

Article 9. Declaring of compliance

Declaring of compliance - confirmation by the producer, seller or contractor of compliance of products to requirements of regulatory legal acts, and also regulating documents in the field of technical regulation.

Rules, procedure and methods of confirmation of conformity when declaring compliance are established by the relevant regulating documents in the field of technical regulation.
