1. This Procedure determines general procedure of the organization and carrying out selection, approval and registration of investment projects in priority industries of economy for which realization the state support according to the Law of Ukraine "About stimulation of investing activities in priority industries of economy for the purpose of creation of new workplaces" is provided (further - investment projects).
2. Subjects of managing which intend to provide projects for participation in selection of investment projects in priority industries of economy (further - selection) represent to Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations the statement together with the following documents:
conclusions of the independent expert organizations (in the presence);
the copy of the investment project, is stitched, numbered, certified by the authorized signature of the subject of managing, and also is under seal (for the legal entity);
the certificate of absence at the company of overdue debt for tax payment and charges (obligatory payments);
the document on absence concerning the subject of managing of the initiated proceedings on bankruptcy;
the certificate of absence at the company of overdue debt for payment of single fee on obligatory, national social insurance;
the extract from the Unified State Register of Legal Entities and physical persons - entrepreneurs.
3. For participation in selection investment projects are not allowed if:
subjects of managing which realize them are declared by bankrupt, are in termination stage, have overdue debt on tax payment and charges (obligatory payments), single fee on obligatory, national social insurance, and also on the salary or on whom proceedings on bankruptcy are initiated;
such projects do not conform to the requirements to investment projects approved by the Cabinet of Ministers of Ukraine in priority industries of economy (further - requirements).
4. The application form for participation in selection, and also the instruction for its filling Ministries of Economics affirm.
Responsibility for completeness and reliability of the data specified in documents is assigned to managing subjects.
5. The applications submitted by subjects of managing together with documents, the stipulated in Item 2 presents of the Procedure, are checked by Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations within five working days from the date of their receipt and in case of their discrepancy of Item 2 and the paragraph third Item 3 presents of the Procedure return to the subject of managing.
The Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations provide nondisclosure of the confidential information specified in the documents submitted by subjects of managing by them.
6. The company after completion of the returned documents can repeatedly provide to Council of Ministers of the Autonomous Republic of Crimea, regional, Kiev and Sevastopol city state administration the statement together with documents, the stipulated in Item 2 presents of the Procedure, having noted results of preliminary consideration and the taken measures.
7. Selection is performed by Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations taking into account requirements on regular basis, but at least once a week (in the presence of relevant proposals of subjects of managing).
8. The investment projects selected for representation to the Cabinet of Ministers of Ukraine for the purpose of their approval move not later than for the third calendar day after carrying out selection by Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city administrations of Ministry of Economics together with statements of subjects of managing and documents, are attached to them.
9. The Ministry of Economics in fifteen-day time from the date of receipt from Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations of the selected investment projects and documents, the stipulated in Item 8 presents About, considers them and represents in accordance with the established procedure to the Cabinet of Ministers of Ukraine offers concerning approval of investment projects.
10. After approval by the Cabinet of Ministers of Ukraine of investment projects Ministry of Economics within five working days performs their state registration by entering of the corresponding data into the State register of investment projects in priority industries of economy (further - the Register) which is posted on the official site of Ministry of Economics.
11. Entering of data into the Register is performed by filling of registration card of the investment project in the form approved by Ministry of Economics, contains:
general information about the subject of managing;
indicators indicators of the investment project after registration (total estimated cost of the project, quantity of the created new workplaces for workers who are directly involved in production processes, the average salary of workers).
12. After state registration of investment projects of Ministry of Economics reports in two-day time Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations about approval by the Cabinet of Ministers of Ukraine of the specified projects and their state registration.
