ORDER OF THE GOVERNMENT OF THE REPUBLIC OF MOLDOVA

About approval of the Regulations on mobile groups of Boundary police and about entering of amendments into the Order of the Government of May 13, 2009 No. 357

(as amended of the Order of the Government of the Republic of Moldova of 21.11.2018 No. 1145)

For the purpose of execution of provisions of part (2) article 8 of the Law No. 215 of November 4, 2011 on frontier (The official monitor of the Republic of Moldova, 2012, No. 7680, the Art. 243), the subitem f) parts (4) Article 6 and the subitem n) parts (1) article 7 of the Law No. 283 of December 28, 2011 on Boundary police (The official monitor of the Republic of Moldova, 2012, No. 76-80,ст. 245) DECIDES: the Government

1. Approve Regulations on mobile groups of Boundary police it (is applied).

2. Creation and equipping of mobile groups are performed by the General inspectorate of Boundary police of the Ministry of Internal Affairs for the account and within the total number of units of personnel and assignments approved for the corresponding year for Boundary police and from other sources which are not contradicting the law.

3. Internal regulations of the organization, equipment and activities of mobile groups, conditions of mobilization, selection, professional training of their personnel are established by the chief of the General inspectorate of Boundary police.

4. In the Traffic regulations approved by the Order of the Government No. 357 of May 13, 2009. (Official monitor of the Republic of Moldova, 2009, Art. No. 92-93, 409), with subsequent changes and amendments, to make the following changes:

to add Item 7 after the concept "public road" with the concept "mobile group of Boundary police" of the following content:

"mobile group of Boundary police - the operational education consisting of the boundary police officers performing the activities according to the established powers with use of mobile automeans of Boundary police which are identified by distinctive marks of organization;";

2) of Item 10 after words of "the employee of police" to add the subitem with words "boundary police or";

in the subitem i) Item 11 after the paragraph "-the employee of police;" to add with the paragraph of the following content:

"-member of mobile group of Boundary police".

5. To impose control over the implementation of this Resolution on the Ministry of Internal Affairs.

Regulations on mobile groups of Boundary police

I. General provisions

1. The regulations on mobile groups of Boundary police (further - the Provision) establish the main mission, procedure for creation and type of mobile groups of Boundary police, their role, obligations and the rights within tactical and prompt actions of Boundary police, in the course of accomplishment of tasks on providing procedure and the public safety assigned to the Ministry of Internal Affairs by means of its specialized structures, and also cooperation with other law enforcement agencies, organizations and/or bodies of the central and local public authority.

2. Mobile groups participate in special missions and transactions according to part provisions (6) article 9 of the Law No. 283 of December 28, 2011 on Boundary police.

3. In this Provision the used concepts have the following value:

a) transactions on border - set of tasks and general actions of Boundary police for realization of the main mission initiated by the order of the chief of Boundary police based on data / information received in risk analysis result;

b) action on border - tactical action in which the mobile group can participate, carried out according to the office order published based on routine planning or based on the notification established in the course of risk analysis;

c) The national coordination center - specialized division of the General inspectorate of Boundary police which coordinates activities of mobile groups based on analysis results of risks and the situational card;

d) mobile group - the operational division consisting of the boundary police officers performing the activities based on the established powers with use of mobile automeans of Boundary police which are identified by distinctive marks of organization;

e) the head of mobile group - the boundary police officer appointed for implementation of management of mobile group during actions on border;

f) the situational card - the graphical/information representation developed and managed by the National coordination center, intended for acquaintance/coordination/management in real time by situations/actions of mobile groups.

4. Along with the basic principles of activities of Boundary police mobile groups observe the following principles of actions:

a) economy of forces and means of mobile group for accomplishment of objective;

b) freedom of action;

c) concentration of efforts of mobile group based on risk analysis in the directions and possible hour intervals of development of illegal actions on border, within provisions of Item 5 of this provision;

d) maneuvering depending on feature of operational situation;

e) ensuring unity of actions by means of the National coordination center;

f) ensuring suddenness by change of procedure and frequency of actions of mobile groups;

g) continuous cooperation of mobile groups with other stationary divisions of Boundary police, with the structures connected with risk analysis and special search activities;

h) information, financial and material security of actions;

i) observance of the rights and fundamental freedoms of the person.
