About approval of Licensed conditions of carrying out economic activity on trade in pesticides and agrochemicals (only regulators of growth of plants)

According to article 6 of the Law of Ukraine "About licensing of certain types of economic activity" and on accomplishment of the resolution of the Cabinet of Ministers of Ukraine of November 14, 2000 No. 1698 "About approval of the list of bodies of licensing" PRIKAZYVAYU:

1. Approve Licensed conditions of carrying out economic activity on trade in pesticides and agrochemicals (only by regulators of growth of plants) which are applied.

2. To department of agriculture (Demidov O. A.) provide submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of the order on the deputy minister Davidenko V. M.

Licensed conditions of carrying out economic activity on trade in pesticides and agrochemicals (only regulators of growth of plants)

I. General provisions

1. These Licensed conditions determine the organizational, qualification and special requirements obligatory for accomplishment when carrying out economic activity by trade in pesticides and agrochemicals (only regulators of growth of plants).

2. Action of these Licensed conditions extends to all subjects of managing who perform economic activity on trade in pesticides and agrochemicals (only regulators of growth of plants).

3. The list of bodies of licensing is approved by the resolution of the Cabinet of Ministers of Ukraine of November 14, 2000 No. 1698 "About approval of the list of bodies of licensing".

4. The procedure for licensing of economic activity on trade in pesticides and agrochemicals (only regulators of growth of plants) is established by the Law of Ukraine "About licensing of certain types of economic activity".

5. Application forms about licensing, data on availability of own or leased storage and trade facilities of material and technical resources and their compliance to the established requirements, statements for issue of the copy of the license, the statement for renewal of the license, the statement for issue of the duplicate of the license, and also form of the list of documents which are enclosed to the application for licensing are given in appendices 1-6 to these Licensed conditions.

6. The licensee shall report to body of licensing about all changes of the data specified in documents which were enclosed to the application for licensing. In case of such changes the licensee shall submit within ten working days to body of licensing the corresponding message in writing together with documents or their notarially certified copies which confirm the specified changes.

In case of creation by the licensee - the legal entity of new branch, other separate division where he will carry out the type of economic activity specified in the license, and for the physical person - the entrepreneur - the new venue of economic activity such licensee shall submit to body of licensing the application of the established sample for issue of the copy of the license, and also documents according to article 10 of the Law of Ukraine "About licensing of certain types of economic activity".

II. Requirements to carrying out economic activity on trade in pesticides and agrochemicals (only regulators of growth of plants)

1. Organizational requirements:

1) the licensee when carrying out trade in pesticides and agrochemicals (only regulators of growth of plants) shall adhere to requirements:

Laws of Ukraine:

"About pesticides and agrochemicals";

"About protection of plants";

"About licensing of certain types of economic activity";

resolutions of the Cabinet of Ministers of Ukraine of September 18, 1995 No. 746 "About approval of the Procedure for receipt of the admission (certificate) on the right of the work connected with transportation, storage, application and trade in pesticides and agrochemicals";

The state health regulations "Transportation, storage and use of pesticides in the national economy. DSANPIN 8.8.1.2.001-98", approved by the resolution of the Chief state health officer of Ukraine of August 3, 1998 No. 1;

2) carrying out economic activity on trade in pesticides and agrochemicals before their state registration is forbidden;

3) the licensee shall:

record availability and use of pesticides and agrochemicals (only regulators of growth of plants) in account books (magazines) and to submit the statistical reporting under the forms approved by Public service of statistics according to the Procedure for the state accounting of availability and use of pesticides and agrochemicals approved by the resolution of the Cabinet of Ministers of Ukraine of November 2, 1995 No. 881;

report the central executive body which implements state policy in the field of protection of plants, about export/import from/in administrative and territorial unit of range of remedies of plants;

The licensee shall have 4):

instruction for labor protection;

job descriptions;

5) the licensee according to requirements of article 10 of the Law of Ukraine "About pesticides and agrochemicals" shall issue to the consumer on each commodity unit of pesticides and agrochemicals (only regulators of growth of plants) the recommendation concerning its application with indication of cultures and objects for which obrabatyvaniye pesticides and agrochemicals are intended, methods, regulations and frequency rate of use, waiting terms (for pesticides), prohibition and restriction for application, methods and means of neutralization of pesticides and agrochemicals, and also security measures in operating time, transportation and storages, liquidations of emergencies and their effects, died provisions of first aid in case of poisoning;

6) the licensee according to requirements of article 11 of the Law of Ukraine "About pesticides and agrochemicals" shall perform sale to the population of pesticides and agrochemicals (only regulators of growth of plants) in small packed up type and with obligatory availability of the instruction of their rather safe application;
