1. These rules establish procedure for provision to the government civil servant who replaces the reduced position of the public civil service in state body or position of the public civil service in the abolished state body, in case of lack of vacant positions in state body in which positions of the public civil service, or state body to which functions of the abolished state body are transferred, to vacant position of the public civil service in other state bodies are reduced.
2. In the absence of the vacant positions of the public civil service meeting the requirements of part 1 of article 31 of the Federal law "About the Public Civil Service of the Russian Federation" in state body in which positions of the public civil service, or state body to which functions of the abolished state body are transferred are reduced the personnel service of the specified bodies not later than 30 days about day of the forthcoming dismissal of the government civil servant in connection with reducing positions of the public civil service or abolition of state body performs search of vacant positions of the public civil service in other state bodies, including by means of the official site of federal state information system "Unified information system of management of personnel structure of the public civil service of the Russian Federation, taking into account category and group of the position of the public civil service, area and type of its professional office activity, level of its qualification, professional education and years of service of the public civil service or occupational work replaced by the government civil servant, to the direction of preparation.
3. The vacant positions of the public civil service, and also vacant positions of the public civil service posted on the official site of federal state information system "Unified information system of management of personnel structure of the public civil service of the Russian Federation, information on which is obtained by personnel service of state body in which positions of the public civil service, or personnel service of state body to which functions of the abolished state body are transferred are reduced, are subject to inclusion in the list of vacant positions of the public civil service in the state bodies offered the government civil servant. The list joins positions of the public civil service in other state bodies located in the same area (the area within administrative-territorial borders of that settlement where the state body in which positions of the public civil service, or state body to which functions of the abolished state body are transferred are reduced is located). In the absence of vacant positions of the public civil service in other state bodies located in the same area the list can join vacant positions of the public civil service in other state bodies located in other area within the Russian Federation.
4. The notification on the offer to the government civil servant of vacant positions of the public civil service in other state bodies with application of the list of these vacant positions signed by the representative of the employer or person authorized by it is handed by personnel service to the government civil servant under list not later than 25 days about day of the forthcoming dismissal in connection with reducing positions of the public civil service in state body in which positions of the public civil service, or with abolition of state body are reduced.
5. The government civil servant represents within 2 working days from the date of acquaintance with the notification specified in item 4 of these rules to personnel service the statement with request refuses to send its questionnaire to state bodies in which the government civil servant chooses vacant positions of the public civil service or from the vacant positions of the public civil service offered by personnel service.
6. The personnel service sends no later than 2 working days from the date of receipt of the statement specified in Item 5 of these rules to state bodies of the letter with use of means of fax connection, e-mail or other means of communication allowing to fix the fact of their obtaining by the addressee (further - means of communication), with request to consider the candidacy of the government civil servant for replacement of vacant position of the public civil service and to provide to state body in which positions of the public civil service, or state body to which functions of the abolished state body, the relevant information are transferred are reduced. In the letter the vacant positions of the public civil service chosen by the government civil servant with appendix of the questionnaire of the government civil servant in the form approved by the order of the Government of the Russian Federation of May 26, 2005 No. 667-r and also end date of 2-month term after the warning of the government civil servant of dismissal according to part 2 of article 31 of the Federal law "About the Public Civil Service of the Russian Federation" are specified.
