About approval of the Procedure for import to customs area of Ukraine by initiators of creation of industrial (industrial) parks - subjects of managing, managing companies of such parks for their arrangement and members of industrial (industrial) parks for implementation of economic activity within the specified parks of the equipment, equipment and components to them, materials which are not made in Ukraine are not excise goods and are exempted from taxation by duty

According to part six of Article 287 of the Customs code of Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for import to customs area of Ukraine as initiators of creation of industrial (industrial) parks - subjects of managing, managing companies of such parks for their arrangement and members of industrial (industrial) parks for implementation of economic activity within the specified parks of the equipment, equipment and components to them, materials which are not made in Ukraine are not excise goods and are exempted from taxation by duty which is applied.

2. This resolution becomes effective from the date of publication.

1. This Procedure establishes requirements to import to customs area of Ukraine by initiators of creation of industrial (industrial) parks - subjects of managing, managing companies of such parks for their arrangement and members of industrial (industrial) parks for implementation of economic activity within the specified parks of the equipment, equipment and components to them, materials which are not made in Ukraine are not excise goods and according to part six of Article 287 of the Customs code of Ukraine are exempted from taxation by duty (further - goods).

2. In this Procedure terms are used in the value given in the Law of Ukraine "About industrial the park".

3. For determination of the list and amounts of commodity importation the initiator of creation of industrial (industrial) parks - the subject of managing (further - the initiator of creation), managing company of the industrial (industrial) park (further - managing company), the member of the industrial (industrial) park (further - the participant) gives Ministry of Economics the written address to which the creations certified by the initiator are applied (managing company, the participant):

copies of constituent documents (for legal entities);

copies of documents which confirm the status of the initiator of creation (managing company, the participant) (the decision on creation of the industrial (industrial) park - for the initiator of creation; agreements on creation and functioning of the industrial (industrial) park - for managing company; agreements on carrying out economic activity within the industrial (industrial) park - for the participant);

copies of documents which confirm need of commodity importation. The initiator of creation and managing company submit also the copy of the business plan of the industrial (industrial) park;

the list and amounts of goods, necessary for arrangement by the initiator of creation (managing company) of the industrial (industrial) park or carrying out economic activity by the participant within the industrial (industrial) park, in form according to appendix 1.

The initiator of creation (managing company, the participant) bears responsibility for accuracy of the information which contains in the filed documents.

4. The Ministry of Economics registers documents in the special magazine in the form approved by it what in writing reports to the initiator of creation about (managing company, the participant) in three-day time from day of registration.

5. After conducting check by the provided initiator of creation (managing company, the participant) of documents of Ministry of Economics in coordination with the Ministry of Finance and DFS, based on approval and information of the central executive bodies within which competence the sphere of production of such goods is that the corresponding goods are not made in Ukraine, in a month from the date of their receipt submits for approval of the Cabinet of Ministers of Ukraine the list and amounts of goods for each initiator of creation (managing company, the participant), and in case of refusal in approval sends to the initiator of creation (managing company, the participant) the reasonable message.

6. The bases for refusal in approval of the list and amounts of goods are:

representation by the initiator of creation (managing company, the participant) of incomplete document package, stipulated in Item 3 this About which are necessary for decision making about approval of the list and amounts of goods;

identification in the documents filed by the initiator of creation (managing company, the participant), false information;

availability in the inventory, necessary for arrangement of the industrial (industrial) park or carrying out economic activity within the industrial (industrial) park, served the initiator of creation (managing company, the participant), equipment, the equipment and components, materials which are made in Ukraine or are excisable.

7. In case of need for modification of the list and amounts of goods the initiator of creation (managing company, the participant) gives Ministry of Economics the new list certified according to Item 3 of this Procedure and amounts of the goods necessary for arrangement of the industrial (industrial) park or carrying out economic activity within the industrial (industrial) park (together with reasons) which affirms according to Item 5 of this Procedure.

7-1. Commodity importation by the initiator of creation (managing company, the participant) on customs area of Ukraine is performed according to the procedure, established by the legislation concerning the public customs affairs.
