About approval of the Procedure for issue of the duplicate of the registration certificate of issue of securities

According to Item 13 of article 8 of the Law of Ukraine "About state regulation of the security market in Ukraine" the National commission on securities and the stock market RESHILA:

1. Approve the Procedure for issue of the duplicate of the registration certificate of issue of securities which is applied.

2. Declare invalid the decision of State commission on securities and the stock market of June 24, 2003 No. 287 "About approval of the Procedure for issue of the duplicate of the registration certificate of issue of securities", registered in the Ministry of Justice of Ukraine on July 15, 2003 for No. 597/7918.

3. And corporate finances (A. Papaik) to provide to corporate management department submission of this decision on state registration in the Ministry of Justice of Ukraine.

4. To provide to management of information technologies, external and internal communications (A. Zaik):

promulgation of this decision on the official website of the Commission;

publication of this decision in the official printing publication of the Commission.

5. This decision becomes effective from the date of its official publication.

6. Control over the implementation of this decision to assign to the member of the National commission on securities and the stock market A. Amelin.

Procedure for issue of the duplicate of the registration certificate of issue of securities

1. According to this Procedure issue by the National commission on securities and the stock market of the duplicate of the certificate / the interim certificate on registration of issue of securities is performed (further - the registration certificate of issue of securities).

2. Documents for receipt of the duplicate of the registration certificate of issue of securities are submitted by the issuer to structural division of the National commission on securities and the stock market in which the corresponding release (releases) of securities was registered (if the corresponding release (releases) of securities was registered by the relevant territorial authority of the National commission on securities and the stock market or territorial authority of the National commission on securities and the share market / State commission on securities and the stock market which was in the territory of administrative and territorial unit of the relevant structural division of the National commission on securities and the stock market, - in structural division of the National commission on securities and the stock market in the respective region).

3. In case of loss (damage) of the registration certificate of issue of securities its duplicate with text in the right upper corner of the word "Duplicate" and specifying of date of issue of the duplicate is issued to the issuer.

4. For receipt of the duplicate of the registration certificate of issue of securities issuers provide in the National commission on securities and the stock market (further registering body) the following documents;

1) the statement for issue of the duplicate of the registration certificate of issue of securities constituted according to appendix;

2) the copy of the announcement of loss of the original certificate published in printing mass media (in case of loss of the original certificate) certified by the signature of the head and the issuer's seal;

3) the copy of the registration certificate of issue of securities which original is lost (in case of availability of such copy);

4) the registration certificate of issue of securities, not suitable for use (in case of damage).

5. The registering body within seven working days from receipt date of the statement and all necessary documents specified in Item 3 of this Procedure issues the duplicate of the registration certificate of issue of securities.

The notification of the issuer on possibility of receipt of the duplicate of the certificate is performed by means of telecommunication communication.

6. The impress of a seal is not obligatory detail of documents which submission to registering body is provided by this Procedure. Copies of documents which submission to registering body is provided by this Procedure are considered certified in accordance with the established procedure if on such copies the authorized signature of the subject of managing is put down.
