2. To department of administration of the Agency of the Republic of Kazakhstan on protection of the competition (The anti-monopoly agency) (further - the Agency) (Kaldykarayev K. M.) to bring this order to the attention of structural and territorial subdivisions of the Agencies.

3. To impose control of execution of this order on the Responsible secretary of the Agency Abdi N. A.

4. This order becomes effective after ten calendar days from the date of its first official publication.

Method of carrying out the analysis and assessment of condition of competitive environment concerning financial institutions

1. General provisions

1. The method of carrying out the analysis and assessment of condition of competitive environment concerning financial institutions (further - the Technique) is developed for the purpose of realization of the basic provisions provided by the subitem 14) of article 39 of the Law of the Republic of Kazakhstan "About the competition" (further - the Law) determines the procedure of carrying out the analysis and assessment of competitive environment in the market of the financial services provided by financial institutions (further - Financial services), and is used in the following cases:

1) when carrying out market research of financial services for the purpose of determination of competitive situation in these markets (economic concentration) and forming of the State register of the subjects of the market holding the dominating or monopoly position (further - the Register);

2) in case of the state control of economic concentration;

3) in case of appeal to the court about forced separation (allocation) of the subjects of the market holding the dominating or monopoly position.

In this Technique the concepts determined by the laws of the Republic of Kazakhstan "About the competition" and "About state regulation, control and supervision of the financial market and financial institutions" and also by other corresponding legal acts of the Republic of Kazakhstan in the field of regulation of the financial market are used.

3. Carrying out the analysis and assessment of condition of competitive environment in the market of financial services includes the following stages:

1) determination of criteria of interchangeability of financial services;

2) delimitation of the market of financial services;

3) determination of time frame of research of the market of financial services;

4) determination of list of the subjects of the market acting in the market of financial services;

5) calculation of size of the market of financial services and shares of subjects of the market;

6) determination of level of concentration of the market of financial services;
