"About approval of services of dialysis for public and private partnership" (The official monitor of the Republic of Moldova, 2012, No. 126-129, the Art. 462) the Government DECIDES:

1. Offer the services of dialysis provided by dialysis divisions (centers) in public medical and sanitary organizations for public and private partnership.

2. Approve the purposes and conditions of public and private partnership for dialysis services, and also general requirements to selection of the private partner (are attached).

3. To the Ministry of Health, work and social protection in coordination with bodies of local public authority to provide proper holding procedure of the choice of the private partner in compliance with the Regulations on standard procedures and general terms of selection of the private partner approved by the Order of the Government No. 476 of July 4, 2012, to sign the agreement on public and private partnership, and also to perform monitoring of its implementation.

4. The national company of medical insurance annually to sign the service provision agreement of dialysis within compulsory medical insurance.

5. Recommend to Chisinau Local government board, Local government board of Belts, People's assembly of Gagauzia and regional councils Kakhul, Ungen, Edinets, Drokiya, Forty and Keushen to consider feasibility of decision making about participation in the project of public and private partnership for services in dialysis in the corresponding administrative and territorial units.

6. To impose control over the implementation of this resolution on the Ministry of Health, work and social protection, the Ministry of Economics within official competences.

Purposes and conditions of public and private partnership for dialysis services, and also main requirements to the choice of the private partner

Section 1. Purposes of public and private partnership

1. The main to the purposes of public and private partnership for services of dialysis are:

1) upgrade of the centers of dialysis in the following republican, local and district public medical and sanitary government offices: Republican hospital of Timofey Moshnyagi, Institute of mother and child, Institute of emergency medical service, municipal hospital "Holy Trinity", municipal hospital of Belts, district hospital Kakhul, district hospital Comrat by attraction of private investments and reducing budgeted expenses on these purposes;

2) creation of the dialysis centers in the following public medical and sanitary organizations: district hospital Edinets, district hospital of Drokiya, district hospital of Ungen, district hospital Forty, district hospital of Keushen;

3) providing and complete covering of needs of the population for high-quality services of dialysis;

4) attraction of private financial resources for development of health care sector.

2. The realization of the agreement on public and private partnership will be enabled by rehabilitation – operation - transfer of state-owned property to the private partner who shall rehabilitate, operate and support him during the established period. After the duration of the agreement the private partner gives free of charge to the state all property within public and private partnership.

3. The specific purpose consists in reconstruction and/or construction, equipping, financing and operation of services of dialysis in the following public medical and sanitary organizations: Republican hospital of Timofey Moshnyagi, Institute of mother and child, Institute of emergency medical service, municipal hospital "Holy Trinity", municipal hospital of Belts, district hospital Kakhul, district hospital Comrat, district hospital Edinets, district hospital of Drokiya, district hospital of Ungen, district hospital Forty, district hospital of Keushen. This purpose provides:

1) financing, delivery, acceptance in operation and content of the medical equipment necessary for the centers of dialysis in the specified public medical and sanitary organizations;

2) financing of designing, construction and upgrade of rooms in the specified public medical and sanitary organizations where the medical equipment for dialysis with use of the advanced information system of management of planning of treatment and the applied medical procedures will be placed;

3) observance of the high quality standards and practice in dialysis approved by the Ministry of Health, work and social protection.

Section 2. General requirements to selection of the private partner

4. The procedure of selection of the private partner consists of two stages: technical and financial that the interested ofertant could provide one technical and one financial proposal.

The technical proposal is estimated on the basis of the principle "is allowed/is refused", the applied to legal and technical criterions, financial potential, quality and the minimum experience.

5. The Ofertant can be the legal entity of private law, physical person or consolidation of these persons.

6. Only ofertant who meet the legal, technical requirements and financial opportunities at technical stage of the procedure of selection are estimated at financial stage.

7. At evaluation stage of financial offers ofertant compete on the evaluation criteria established by the Commission on selection of the private partner on the basis of the principle cost efficiency.

8. If the ofertant-winner of the tender or the leading member of the won consortium is not resident of the Republic of Moldova, he shall have or create commercial society for implementation of the public and private partnership registered in the Republic of Moldova according to the procedure, established by the current legislation.
