1. Approve the enclosed Instructions for use by heat energy.

2. This resolution becomes effective after ten calendar days after the first official publication.

Instructions for use heat energy

1. General provisions

1. These rules of use of heat energy (further - Rules) are developed according to the subitem 19) of article 4 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and determine procedure for use of heat energy.

2. In these rules the following concepts and determinations are used:

1) settlement period - the period of time determined by the agreement on heat supply for which the consumed heat energy is considered and shown for payment to the consumer;

2) balance sheet accessory of thermal network - the site of the thermal network which is power making, power transferring the organizations and the consumer, belonging to them on the property right or other legal cause;

3) border of balance sheet accessory of thermal network - point (line) of the Section of thermal network between the power making, power transferring organizations and the consumer according to their balance sheet accessory;

4) heat carrier expense - the mass (amount) of the heat carrier which passed through the cross section of the pipeline for unit of time;

5) system of heatconsumption - complex of the heatconsuming installations which are intended for consumption of one or several types of thermal loadings;

6) system of heat supply - set of sources of warmth, thermal networks and the heatconsuming installations;

7) rate for heat energy - the monetary value of cost of heat energy approved by the state body performing management in spheres of natural monopolies and in the controlled markets;

8) thermal loading - amount of heat energy which can be accepted the heatconsuming installation for unit of time;

9) thermal network - set of the devices intended for transfer, distribution of heat energy;

10) heat energy - the energy transferred by the heat carrier in case of which consumption thermodynamic parameters of the heatconsuming installations change (temperature, pressure);

11) the heat carrier - the substance (water, vapor) used in system of heat supply for transfer of heat energy;

12) the heatconsuming installation - the device, held for use heat energy, the heat carrier for needs of the consumer of heat energy;

13) heat supply - actions for provision to consumers of heat energy;

14) the subconsumer - the consumer whose thermal installations are attached to thermal networks of the consumer;

15) checking of measuring instruments - set of the transactions which are carried out by the public metrological service or other accredited legal entities for the purpose of determination and confirmation of conformity of measuring instruments (the device of commercial accounting) to the established technical and metrological requirements;

16) energy examination - the expertize which is carried out in the field of power industry on the operating objects, projects of the reconstructed, modernized and again under construction objects, in case of investigation of technology violations and accidents on the energy equipment in thermal networks, and also in cases of industrial traumatism on them, on compliance to regulatory legal acts of the Republic of Kazakhstan;

17) specifications - the technical requirements necessary for connection to thermal networks;

18) the payment document - the document (the account, the notification, the receipt, schetpreduprezhdeniye) based on which consumers make payment for the consumed heat energy;

19) the consumer - the physical person or legal entity consuming heat energy based on the agreement;

20) metering station - the system of devices and devices providing accounting of heat energy;

21) the expert organization - the organization accredited for conducting energy examination concerning power industry;

22) the power supplying organization - the organization performing sale to consumers of the purchased heat energy;

23) the power transferring organization - the organization performing on the basis of agreements transfer thermal energies;

24) the power making organization - the organization performing production of heat energy for own needs and (or) realization.

2. Procedure for use of heat energy

3. Connection to the operating thermal networks of the power transferring (power making) organization and the conclusion of the agreement on heat supply with the power supplying organization are necessary for the consumer for use of heat energy.

4. Connection to the operating thermal networks and the conclusion of the agreement on heat supply are performed after fulfillment of requirements of specifications.

5. Specifications on accession of objects of consumers to thermal networks of the power transferring (power making) organization are issued in cases:

1) accessions to thermal networks of again entered objects;

2) changes of amount of the consumed energy or parameters of the heat carrier over the established specifications and terms of the contract connected with reconstruction or expansion of the heatconsuming installations of the consumer;

3) changes of the scheme of external heat supply;

4) accessions to thermal networks of earlier not attached object.

6. For receipt of specifications the consumer submits the application to the energoperedayushy (power making) organization. In the request are specified:

1) name of object;

2) location of object;

3) full name of the organization of the customer, address and phone;

4) in case of project availability the data characterizing designed project (for the consumers using energy for household consumption, technical data sheet).

7. The power transferring (power making) organization after receipt of the request from the consumer within fourteen working days issues specifications on joining of the consumer to system of heat supply.

8. The power transferring organization has no right to refuse connection to consumers to thermal networks, and also transfer of heat energy on condition of accomplishment of the requirements established by regulatory legal acts of the Republic of Kazakhstan by them.

9. In specifications are specified accession of object of the consumer to thermal networks:

1) heat supply source, point of accession to thermal networks, quality of the released heat energy;
