About insurance premiums of obligatory motor vehicle liability

(as amended on 21-01-2019)

In pursuance of provisions of Art. 11 of the h. (1) and h. (2) the Law No. 414-XVI of December 22, 2006 on obligatory civil liability insurance for the damage caused by vehicles (The official monitor of the Republic of Moldova, 2007, No. 32-35, the Art. 112), with subsequent changes and amendments, the National commission on the DECIDES: financial market

1. Approve Regulations on method of calculation of basic insurance premium and adjusting factors on compulsory third party car insurance according to appendix No. 1.

2. Establish loading share in basic insurance premium in case of internal and external compulsory third party car insurance according to appendix No. 2.

3. Approve basic insurance premium and value of adjusting factors for:

- internal compulsory third party car insurance according to appendix No. 3;

- external compulsory third party car insurance according to appendix No. 4.

4. Declare invalid the Resolution of the National commission on the financial market No. 53/5 of October 31, 2008 about establishment of basic insurance premium and cost of adjusting factors for internal and external compulsory third party car insurance, with subsequent changes and amendments.

5. To impose control over execution of this resolution on general management of supervision of insurance.

6. This resolution becomes effective from the date of publication.

Appendix No. 2

to the Resolution of the National commission on the financial market of the Republic of Moldova of June 13, 2013 No. 26/10

Loading share in basic insurance premium in case of internal and external compulsory third party car insurance

1. The loading share in basic insurance premium in case of internal compulsory third party car insurance includes:

a) expenses of the insurer, others what provided in subitems b), c) and e), – to % 37,7;

a-1) ceased to be valid;

b) fees in Fund of protection of the victims of accidents – according to item 4 of the Regulations on Fonda of protection of the victims of accidents approved by the Resolution NKFR No. 19/11 of April 9, 2009;

c) regulatory payments – 1%;

d) profit margin – to 5%;

e) payments for maintenance and upgrade of the State automated information system RCA Data – % 0,4.

2. The loading share in basic insurance premium in case of external compulsory third party car insurance includes:

a) expenses of the insurer, others what provided in subitems c), d) and f), – to % 25,3;

a-1) ceased to be valid;

b) ceased to be valid;

c) fees in Fund of compensations – the fee size established according to Item 7 of the Regulations on Fonda of compensation approved by the Resolution NKFR No. 23/3 of May 29, 2008;

d) regulatory payments – 1%;

e) profit margin – to 1%;

f) payments for maintenance and upgrade of the State automated information system RCA Data – % 0,15.

3. Insurers shall observe the limits of shares of loading set in Items 1 and 2.

4) It is forbidden:

- to insurance and/or reinsurance intermediaries to accept remunerations/commission charges / other payments when implementing mediation for agreements of internal and external compulsory third party car insurance;

- to insurers and insurance and/or reinsurance intermediaries to provide to insurers any minor benefit in case of the conclusion of the agreement AGO (in the form of gifts, bonuses, discounts, certificates, awards, etc.) at the expense of profit margin or other expenses.

1. The basic insurance premium for internal compulsory third party car insurance is established in the amount of 651 lei.

2. The size of adjusting factor K1 for the vehicle is established in the table No. 1.
