About approval of the Procedure for the organization of public conveyances and baggage road transport
According to the Law of Ukraine "About road transport", subitem 4.8.14 of subitem 4.8 of item 4 of the Regulations on the Ministry of infrastructure of Ukraine approved by the Presidential decree of Ukraine of May 12, 2011 No. 581, Item 3 of the Rules of provision of services of passenger road transport approved by the resolution of the Cabinet of Ministers of Ukraine of February 18, 1997 No. 176, I ORDER:
1. Approve the Procedure for the organization of public conveyances and baggage by road transport which is applied.
2. To provide to department of road transport submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.
4. This order becomes effective from the date of its official publication.

1.1. This Procedure determines the mechanism of the organization of preparation for opening of bus routes public (except international) and inspections of passenger traffics for the purpose of studying of demand of the population for passenger traffic on city, suburban, long-distance bus routes public.
1.2. The organization of public conveyances shall provide:
timely, complete and high-quality requirements satisfaction of the population in transportation by road transport;
consumer protection during transport servicing;
the organization of inspection and arrangement of bus routes public which are planned for opening.
2.1. The organization of inspection and arrangement of routes which are planned for opening is assigned to organizers of passenger traffic by road transport public and provides:
studying of demand of the population for transportation by poll or inspection of passenger traffics on the existing transportation network or on separate routes or sites of bus routes public;
inspection of roads and determination of the actions necessary for arrangement (after-arrangement) of routes for safe public conveyances;
creation of schedules of movement;
production, approval and approval of the scheme of bus route.
2.2. Studying of demand of the population for transportation is performed in the way:
distribution, collection and study of questionnaires;
uses and analyses of appeals of legal entities and physical persons;
inspections of passenger traffics.
2.3. Inspection of passenger traffics is provided with the corresponding organizers of passenger traffic.
2.4. For studying of demand or determination of level of ensuring requirements of the population with services of passenger road transport, enhancement of route network, optimization of structure of railway vehicles, determination and reasons for rates for transportation tabular, accounting and visual survey methods of passenger traffics are used.
2.5. Preparation and carrying out inspection of passenger traffics on routes are performed tabular, accounting and visual by methods according to the plan of inspection of passenger traffics which sample is given in appendix 1 to this Procedure.
2.6. Information processing algorithms about passenger traffics provide determination of passenger traffics on bus routes on runs, along route in general, on hours of days, and also in case of additional requirement of modeling of initial information - using computer aids.
2.7. The tabular method is applied to inspection of passenger traffics on the most loaded routes where the number of passengers who at stops entered the bus is determined and left it. This method is applied on city and suburban bus routes public.
2.8. The accounting method of determination of starting and terminal points of trip of passengers is applied to processing of data on the tickets sold on each run with systematization of this information and with further modeling of passenger traffics. This method is applied on long-distance bus routes public.
2.9. The visual survey method of passenger traffics is carried out by visual determination of level of fullness of buses in hours "peak" on the passenger traffic determined by the organizer or automobile carrier the most loaded stops of route and (or) in Items of changes on other routes.
Results of inspection on visual method are used for studying and enhancement further of the schedule of movement and the route pattern on the operating bus route public.
2.10. Inspection of passenger traffics is performed:
in a complex - on all city, suburban and long-distance bus routes public at least once in three years;
selectively - on city, suburban, long-distance bus routes public if passenger traffics experience considerable changes;
adjusting - on any route in four months after its opening.
2.11. Before opening city, suburban, long-distance internally - regional and interregional bus routes the corresponding organizer of transportations creates the commission with the assistance of Ukrtransbezopasnosti's representatives (its territorial authorities), State traffic inspectorates, the relevant road and operational organizations (in consent). The commission performs inspection of roads and road objects based on which draws up the statement of readiness of bus route for opening with indication of date of its opening and implementation of trial run with the assistance of the representative of the corresponding organizer of passenger traffic.
In the presence of shortcomings the commission specifies in the act terms of their elimination and persons, responsible for it. In this case the bus route opens taking into account the terms of remedial action specified in the act.
2.12. Inspection of roads and road objects is carried out for the purpose of determination of compliance of condition, type of covering and width of travel part of the road and roadsides, horizontal and vertical radiuses of curve, longitudinal biases, visibility and arrangement of roads, and also railroad crossings to requirements of Single rules of repair and content of highways, streets, railroad crossings, instructions for use by them and protection, No. approved by the resolution of the Cabinet of Ministers of Ukraine of March 30, 1994 198, DSTU 3587-97 "Traffic safety. Highways, streets and railway crossings. Requirements to operational condition".
2.13. According to requirements concerning the equipment of road objects on bus routes public availability is provided:
turnaround areas and the short-term parking of buses in starting and terminal points of city and suburban bus routes;
landing sites, pavilions, and also depending on the passenger traffic size - bus stations at stops of suburban and long-distance bus routes.
2.14. In case of need in additional equipment of road objects on bus route at the same time with the route pattern the actions plan on their arrangement with conditioning of term of performance of works is developed.
2.15. Requirements to placement, the equipment and content of stops on routes of passenger road transport are determined by DBN 360-92 "Town-planning. Planning and building of residential and rural locations", DSTU 4100-2002 "Route signs. General technical specifications. Rules of application", DSTU 2587-2010 "Traffic safety. Marking road. General technical requirements. Monitoring methods. Rules of application", GOST 25869-90 "Distinctive marks and information support of railway vehicles of the passenger land transport, stopping points and passenger stations. General technical requirements".
2.16. Stops on city bus routes are equipped according to requirements of article 28 of the Law of Ukraine "About bases of social security of disabled people in Ukraine", the order of the State committee of Ukraine on housing and communal services of May 15, 1995 No. 21 "About approval of Rules of placement and the equipment of stops of urban electro-and road transport", registered in the Ministry of Justice of Ukraine on May 30, 1995 for No. 160/696.
2.17. Stops on city bus routes public shall be located near complexes of apartment buildings, cultural and community institutions, malls, places of mass rest of the population, railway stations, river and seaports, the airports, stations of the subway, etc.
2.18. In case of placement of stops on street road net shall be provided:
convenient and safe approach to the main objects which are visited in large quantities by citizens;
the smallest capacity reduction of the city street (road);
the smallest mutual obstacles between different types of urban transportation;
convenience during change from one type of urban transportation or route on another;
traffic safety.
2.19. In places of crossing, branch or convergence of bus routes public placement of stops shall provide convenience of changes, and also convenience of use of routes of one direction.
2.20. In places of crossing of bus routes public stops are placed so that passengers did not cross travel part of the street (road).
2.21. Placement of bus-stops near the intersection of streets and roads is allowed in exceptional cases if:
near the intersection there is object visited by citizens big in large quantities or entrance to the underground crosswalk;
the reserve of handling capacity of travel part of the street (road) to the intersection is more, than behind it;
time which passengers spend on change is considerably reduced;
near the intersection the entrance to the bridge, platform, tunnel, the overpass begins or there is railroad crossing.
2.22. On landing sites there shall not be green plantings, booths and other objects and constructions (except booths for sale of tickets and canopies or pavilions for passengers) which would create obstacles to normal functioning of stop.
Exception are landing sites which are placed on sidewalks or distribution strips between them and travel part where trees grow.
3.1. The schedule of movement is necessary part of the organization of public conveyances on bus routes public.
3.2. The schedule of movement of buses is developed according to requirements of the order of the Ministry of Transport and Communications of Ukraine of May 07, 2010 No. 278 "About approval of the Procedure for development and approval of the passport of bus route", registered in the Ministry of Justice of Ukraine on June 17, 2010 for No. 408/17703.
3.3. The schedule of movement is developed:
summary - for city, suburban, long-distance routes public - in the form of tables. In it departure time of buses from initial, intermediate points and arrival in terminal point and, similarly, in the opposite direction is specified;
autostation - on suburban, long-distance and interregional (for terminal and intermediate points of routes). In it arrival time and departures from initial and intermediate points, arrival in terminal point, duration of stops and all run are specified.
3.4. Production and approval of schemes of bus route public are performed according to requirements of the order of the Ministry of Transport and Communications of Ukraine of May 07, 2010 No. 278 "About approval of the Procedure for development and approval of the passport of bus route", registered in the Ministry of Justice of Ukraine on June 17, 2010 for No. 408/17703.
4.1. Prior to implementation of public conveyances on bus route public which opens it is previously necessary for the organizer of passenger traffic:
coordinate the schedule of movement of buses on route with other bus routes, and also with schedules of movement of other types of passenger transport;
hold in the procedure established by the legislation competition on determination of automobile carriers for work on bus route public;
provide control of movement of buses on bus routes public.
4.2. To each route the corresponding organizer of passenger traffic within its powers assigns number.
4.3. Bus routes public shall have single numbering:
city - in city boundaries;
suburban and long-distance which do not go beyond the territory of the Autonomous Republic of Crimea, area - respectively within the Autonomous Republic of Crimea, area;
long-distance and suburban which go beyond the area territory, - within Ukraine.
4.4. On long-distance and suburban bus routes public which go beyond the area territory numbers are assigned to each run of the bus (separately in the direct and return directions).
4.5. Number and the name of bus route public which opened in the procedure established by the legislation are entered in the corresponding register of bus routes by the organizer of passenger traffic on this route.
4.6. About opening, closing of route and changes of the schedule of movement on the corresponding bus routes public it is reported through the announcement in buses, on bus-stops and at bus stations.
5.1. Studying of passenger traffics is carried out with use of tabular, accounting methods (with processing and modeling of initial information) and with use of visual method.
5.2. Materials of studying of demand of the population for passenger traffic are used by road transport for creation or correction of schedules of movement of buses.
6.1. With use of tabular method calculation of number of passengers who came into the bus is performed and came out it at stops, accountants who are in it, with entering of these data into the route table which sample is given in appendix 2 to this Procedure. Previously in the route table number of bus route, departure time of the bus, the name of stops are specified.
Route tables are completed for each accountant in the separate folder by the number of runs which are surveyed. On the folder numbers of route, doors and operating time of the accountant are specified.
6.2. Sufficient reliability of results of determination and modeling of passenger traffics is provided with accomplishment of indicators of selectivity of their studying which model is given in appendix 3 to this Procedure.
6.3. Before carrying out inspection the corresponding folder and individual information card are issued to each accountant. Places at each doors of the bus are allocated to accountants.
6.4. When carrying out inspection on each run by the accountant the trip leaf which sample is given in appendix 4 to this Procedure which contains information on mode of transport, number of route, driving direction of vehicles, time of the beginning and the end of run, brand of railway vehicles and type of transport is filled.
6.5. The normative reference documentation consists of route tables, trip leaves, the characteristic of route system, the list of stops and distance between them, characteristics of railway vehicles (samples are given in appendices 2 - 8 to this Procedure).
6.6. Results of processing of materials of inspection of passenger traffics with use of visual method systematize along bus routes, on modes of transport and in general on route system.
6.7. Output data of bus route (samples are given in appendices 9 - 23 to this Procedure) contain general characteristic of such indicators:
poreysovy indicators (samples are given in appendices 10, 11 to this Procedure);
daily indicators of route (it is total on runs) (samples are given in appendices 12, 13 to this Procedure);
hourly indicators on passenger traffics (samples are given in appendices 14, 15 to this Procedure);
the unrolled hourly indicators of passenger traffic (samples are given in appendices 16, 17 to this Procedure);
determination of most loaded distillations (samples are given in appendices 18, 19 to this Procedure);
determination of peak periods (the sample is given in appendix 20 to this Procedure);
peak periods with most loaded sites (the sample is given in appendix 21 to this Procedure);
the unrolled indicators of peak periods (samples are given in appendices 22, 23 to this Procedure).
