About activities of public ecologists, and also sampling and carrying out measurements in the field of environmental protection

Based on Item 5 of Article 17 and Item 6 of article 103 of the Law of the Republic of Belarus of November 26, 1992 "About environmental protection" the Council of Ministers of the Republic of Belarus DECIDES: No. 1982-XII

1. Approve:

The regulations on procedure for activities of public ecologists (are applied);

The regulations on procedure for sampling and carrying out measurements in the field of environmental protection (are applied).

2. Ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 27.04.2021 No. 252

3. Certificates of the public inspector of conservation are subject to exchange within two months from the date of entry into force of this resolution on the certificate of the public ecologist according to the statement of the public inspector of conservation submitted in corresponding regional (Minsk city) committee of natural resources and environmental protection.

4. To the Ministry of Natural Resources and Environmental Protection to approve procedure for the organization and carrying out republican tender on the best public ecologist.

5. This resolution becomes effective since July 26, 2013.

Regulations on procedure for activities of public ecologists

Chapter 1. General provisions

1. This Provision establishes procedure for activities of public ecologists.

2. Activities of public ecologists are performed according to the Law of the Republic of Belarus "About environmental protection", this Provision and other acts of the legislation.

3. The Ministry of Natural Resources and Environmental Protection will organize network of public ecologists.

Chapter 2. Procedure for forming of network of public ecologists

4. The physical persons specified in Item 1 of article 17 of the Law of the Republic of Belarus "About environmental protection" based on the order of the chairman regional (Minsk city) committee of natural resources and environmental protection on representation of chiefs of structural divisions of the Ministry of Natural Resources and Environmental Protection, regional (The Minsk city) committees of natural resources and environmental protection, chiefs of district, city, city and district inspections of natural resources and environmental protection are enlisted in the list of public ecologists (further – chiefs of structural divisions).

5. After studying of business and moral qualities of the candidate for public ecologists the chief of structural division represents to the chairman regional (Minsk city) committee of natural resources and environmental protection for transfer to the list of public ecologists:

5.1. statement of the candidate for public ecologists;

5.2. representation according to item 4 of this provision in which it is specified what knowledge and experience in the field of environmental protection and rational (steady) use of natural resources the candidate for public ecologists has;

5.3. the characteristic from place of employment (training) or the residence;

5.4. two photos 3 x 4 cm (color).

6. On each public ecologist the registration card in form according to appendix 1 is got and the certificate in form according to appendix 2 by effective period for three years with the prolongation right is issued. Data on the issued certificates of the public ecologist are registered in the magazine in form according to appendix 3.

Prolongation of effective period of the certificate of the public ecologist is made according to the procedure, established regional (Minsk city) committee of natural resources and environmental protections for issue of such certificate.

For prolongation of effective period of the specified certificate the public ecologist submits the report on the done work.

7. The public ecologist regional (Minsk city) committee of natural resources and environmental protection is excluded by the order of the chairman from the list of public ecologists in cases:

adoptions by it of the decision on the termination of activities as the public ecologist and the address with the corresponding statement;

attraction to administrative and (or) criminal liability for offenses (crimes) against ecological safety, the environment and procedure for environmental management;

not prolongation of effective period of the certificate of the public ecologist.

8. The public ecologist excluded from the list of public ecologists hands over the certificate of the public ecologist in regional (Minsk city) the committee of natural resources and environmental protection which performed its issue.

Chapter 3. Organization of work of public ecologists

9. Regional (The Minsk city) committees of natural resources and environmental protection together with district, city, city and district inspections of natural resources and environmental protections:

will organize and estimate work of public ecologists;

will organize work on training of public ecologists;

provide public ecologists with ecological information;

develop actions for increase in efficiency of activities of public ecologists;

ensure safety of public ecologists when holding nature protection actions.

10. Coordination of activities of public ecologists, and also the organization of their participation in the nature protection events held by the Ministry of Natural Resources and Environmental Protection and its territorial authorities are performed by chiefs of structural divisions on which representation they are enlisted in the list of public ecologists.

11. Public ecologists render assistance to the Ministry of Natural Resources and Environmental Protection and its territorial authorities in time, free from work (training).

12. It is not allowed to charge to public ecologists independent production of the actions constituting exclusive competence of officials of the Ministry of Natural Resources and Environmental Protection and its territorial authorities.

13. It is forbidden to acquaint public ecologists with the documents containing information carried to the state secrets, distribution and (or) provision of which is limited according to legal acts.
