1. Approve:

Regulations on licensing of activities for production of precious and rare-earth metals, gemstones according to appendix No. 1;

structure of the Commission of the Cabinet of Ministers on licensing of activities for production of precious and rare-earth metals, gemstones according to appendix No. 2.

2. Commissions of the Cabinet of Ministers on licensing of activities for production of precious and rare-earth metals, gemstones:

in two weeks to develop and approve regulations on the Commission, and also members and provision about expert, group on preparation of the conclusions about issue of licenses;

in a month to determine the list of the legal entities performing types of activity which are subject to licensing according to this resolution.

3. To impose control over the implementation of this resolution on the Deputy prime minister of the Republic of Uzbekistan Sultanov U. T.

Regulations on licensing of activities for production of precious and rare-earth metals, gemstones

I. General provisions

1. This Provision determines procedure for licensing of activities for production of precious and rare-earth metals, gemstones.

2. Decisions on issue of licenses, suspension or cancellation of the license, and also its cancellation and renewal are accepted by the Commission of the Cabinet of Ministers on licensing of activities in the field of production of precious and rare-earth metals, gemstones (further - the Commission).

Activities of the Commission will be organized according to the provision approved by it.

3. Functions of working body of the Commission are performed by the State inspectorate for supervision of safe operation in the industry and to mountain supervision the State inspectorate for supervision of geological studying of subsoil, safe operation in the industry, mining and the household sector under the Cabinet of Ministers of the Republic of Uzbekistan (further - working body).

For consideration, preparation and introduction on commission sessions of materials about licensing or prolongation of term of their action in working body the expert group of number of specialists of Goskomecology, Goskomgeologiya, the Ministry of Internal Affairs, Ministry of Finance, Ministry of Health, Service of state security of the Republic of Uzbekistan, the State inspection Sanoatgeokontekhnazorat, the Agencies on precious metals is created under the Central bank and other organizations. Members of expert group and regulations on it affirm the Commission.

4. Only legal entities can be license applicants.

5. On the right of implementation of activities for production of precious and rare-earth metals, gemstones standard (simple) licenses are granted.

availability of the necessary specifications and technical documentation regulating implementation of production of precious and rare-earth metals, gemstones;

respect for project technology of mineral processing;

observance of requirements for safety, storage and transportation of precious and rare-earth metals, gemstones, procedure for their delivery and realization;

availability of the registration certificate of the State assay chamber of the Agency on precious metals under the Central bank of the Republic of Uzbekistan (in case of implementation of production of precious metals and stones) the execution of the license received later;

providing in accordance with the established procedure accounting and inventory count of precious and rare-earth metals, gemstones;

availability of necessary number of the specialists having the higher or secondary vocational education in the field of production of precious and rare-earth metals, gemstones;

absence among employees of persons who are staying on the dispensary registry concerning chronic mental diseases, drug addiction, and also having the outstanding or not removed criminal record for intentional crime in the field of turnover of precious and rare-earth metals, gemstones;

providing the admission on the company to representatives of the State assay chamber and Agency on precious metals, and also other authorized bodies for implementation by them of the state control of production of mineral raw materials.

8. Requirements to material and technical resources, the equipment and other technical means used when implementing production of precious and rare-earth metals, gemstones affirm the Commission based on offers of the State inspection Sanoatgeokontekhnazorat, the Agencies on precious metals, Goskomecologies, Goskomgeologiya.

III. Documents necessary for receipt of the license

9. For receipt of the license the license applicant submits the following documents:

the statement for licensing with indication of: the name and form of business of the legal entity, the place of its stay (postal address), the name of organization of bank and the room of the settlement account in organization of bank, the licensed type of activity (its part) which the legal entity intends to perform;

copy of the certificate on state registration of the legal entity;
