AGREEMENT BETWEEN THE GOVERNMENTS OF THE STATE PARTIES OF COMMONWEALTH OF INDEPENDENT STATES

About cooperation in the field of engineering support of armed forces of the State Parties of the Commonwealth of Independent States

The governments of the State Parties of the Commonwealth of Independent States which are hereinafter referred to as with the Parties

proceeding from need of combination of efforts for development and enhancement of engineering support of armed forces of the State Parties of the Commonwealth of Independent States (further - the CIS),

agreed as follows:

Article 1

The parties according to this agreement, the national legal system and the conventional principles and rules of international law cooperate in the following main directions:

interaction in questions of engineering support;

development of general approaches to the solution of organizational and technical issues of engineering support of armed forces of the State Parties of the CIS;

coordination of activities when carrying out scientific developments, designing, production, acquisition and implementation of utilities, including by development of joint programs for enhancement of methods of engineering support of armed forces of the State Parties of the CIS;

assistance to development of joint research and developmental activities for the benefit of engineering support of armed forces of the State Parties of the CIS;

development of humanitarian activities of engineering troops of armed forces of the State Parties of the CIS;

training for engineering troops of armed forces of the State Parties of the CIS;

interaction in the field of standardization, cataloguing, certification and metrology in case of realization of joint projects on development and production of the engineering equipment;

on other questions of multilateral cooperation in the field of engineering support of armed forces of the State Parties of the CIS which are of mutual interest.

Article 2

The basic principles of cooperation are:

equality in development and implementation of the made decisions;

collective discussion and the problem resolution, the tasks of engineering support arising in case of accomplishment;

mutual exchange of information about questions of engineering support;

mutual respect of national interests.

Article 3

The parties develop cooperation in the field of engineering support in the following forms:

preparation and implementation of international treaties and decisions of bodies of the CIS in the field of engineering support of armed forces of the State Parties of the CIS;

solution of organizational and technical issues engineering and engineering facilities of armed forces of the State Parties of the CIS;

mutual exchange of information between engineering troops of armed forces of the State Parties of the CIS about engineering support, opportunities of the engineering equipment and perspectives of its development and enhancement;

planning and organization of works on creation of information systems and databases;

development of the approved approaches to use of engineering troops and accomplishment of tasks of engineering support by them;

use of engineering troops of armed forces of the State Parties of the CIS for conducting humanitarian mine clearing;

development of general approaches to observance of regulations of international humanitarian law in case of application of antipersonnel mines;

carrying out joint special exercises;

organization of joint charges of divisions of engineering troops;

carrying out joint research and development works in the field of creation of means of engineering arms and development of methods of application of parts and divisions of engineering troops in case of the solution of tasks of engineering support according to additional arrangements;

planning and the organization of works on creation of the joint certified center for repair and servicing of the engineering equipment and engineering property.

Article 4

Coordination of sales activity of this agreement is assigned to the Council of Ministers of Defense of the State Parties of the Commonwealth of Independent States.

Article 5

Coordination of actions concerning engineering support of armed forces of the State Parties of the CIS is performed by Coordinating committee concerning engineering support under the Council of Ministers of Defense of the State Parties of the Commonwealth of Independent States (further - Committee).

Article 6

Exchange of information between the Parties and its protection are performed according to the national legal system of the State Parties of the CIS.

Procedure for the address with interstate secrets and their protection are performed according to the Agreement on mutual ensuring safety of interstate secrets from January 22, 1993 and bilateral agreements on mutual protection (protection) of the classified information (the state secrets).

Information obtained during implementation of this agreement of one of the Parties cannot be used by it to the detriment of interests of other Parties.

Article 7

The procedure for preparation, advanced training and retraining of military personnel and specialists in the field of engineering support of armed forces of the State Parties of the CIS is determined based on additional arrangements.

Preparation and retraining of specialists in the field of engineering support of troops are performed by the approved techniques and programs.

Article 8

The parties independently incur expenses which will arise during the course of performance them this agreement if in each case other procedure is not approved.

Article 9

Each Party determines authorized body to which implementation of this agreement is assigned what informs depositary along with the notification on accomplishment of the interstate procedures necessary for its entry into force on.

In case of change of the name of authorized body the relevant Party within 30 days informs on it depositary which within 30 days informs other Parties.

Article 10

The matters of argument between the Parties arising in case of application and interpretation of this agreement are solved by consultations and negotiations of concerned parties within Committee or by means of other procedure approved by concerned parties.

Article 11

This agreement does not affect the rights and obligations of each of the Parties following for it from other international treaties which participant is its state.

Article 12

In the consent of the Parties changes and additions which are its integral part which are drawn up by the relevant protocol which is becoming effective according to the procedure, provided for entry into force of this agreement can be made to this agreement.
