About approval of the Procedure for carrying out qualification of cogeneration installation

According to Items 3 and 6 of the Procedure for the carrying out qualification of cogeneration installation approved by the resolution of the Cabinet of Ministers of Ukraine of November 29, 2006 No. 1670, I ORDER:

1. Approve the Procedure for carrying out qualification of cogeneration installation which is applied.

3. (Pendzin O. V.) to provide to development department of real production sector submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

4. To impose control over the implementation of this order on the Chairman of the State agency on energy efficiency and energy saving of Ukraine Pashkevich M. O.

5. This order becomes effective from the date of its official publication.

Procedure for carrying out qualification of cogeneration installation

1. This Procedure determines the mechanism of carrying out qualification of cogeneration installation (further - qualification).

2. Qualification is carried out by the State agency on energy efficiency and energy saving of Ukraine (further - Gosenergoeffektivnosti of Ukraine) on free basis.

Can involve research and design organizations (organizations) in carrying out qualification of Gosenergoeffektivnosti of Ukraine.

3. Applicant of qualification is the owner of cogeneration installation or person authorized by him (further - the applicant).

4. The applicant submits Gosenergoeffektivnosti of Ukraine the application according to appendix to this Procedure, the technical information on cogeneration installation necessary for carrying out qualification, according to appendices 2 or 3 to this Procedure (further - technical information).

The applicant shall assist Gosenergoeffektivnosti of Ukraine in objective and complex consideration of technical information.

The applicant provides accuracy of the information which contains in the filed documents.

5. Documentation transferred to qualification is stored in the procedure established by the legislation in structural division of Gosenergoeffektivnosti of Ukraine to which competence the question concerning carrying out qualification belongs (further - structural division), for further analytical work.

6. During qualification compliance of conditions and indicators of operation of cogeneration installation which releases part or all amount of the developed electrical energy to consumers, except requirements of own consumption, to qualification indicators to one of two conditions determined by article 11 of the Law of Ukraine "About the combined production of heat and electrical energy (cogeneration) and use of waste power potential" is established.

7. The structural division by results of consideration of the application and the enclosed documents prepares the draft of the certificate on qualification of cogeneration installation (further - the certificate) according to appendix 4 to this Procedure or the decision on refusal in its issue.

The certificate or the decision on refusal in its issue is signed by the Chairman Gosenergoeffektivnosti of Ukraine (in case of its absence - the vice-chairman according to distribution of obligations and powers), the certificate is sealed by Gosenergoeffektivnosti of Ukraine.

The certificate or the decision on refusal in issue of the certificate (with reasons for the bases) shall be issued or sent to the applicant not later than 20 calendar days from receipt date of the statement and the enclosed documents to Gosenergoeffektivnosti of Ukraine.

8. The bases for refusal in issue of the certificate is discrepancy of results of qualification to requirements which are stipulated in Clause 11 Laws of Ukraine "About the combined production of heat and electrical energy (cogeneration) and use of waste power potential" to qualification indicators, representation of incomplete document package, determined in item 4 of this Procedure, identification in the documents filed by the applicant, false information.

9. The certificate is granted for a period of one year.

In case of loss or damage of the certificate of Gosenergoeffektivnosti of Ukraine issues the duplicate of the certificate based on the written address of the applicant within five working days from the date of its representation. In case of damage of the certificate the form of the certificate, unsuitable for use, is enclosed to the application.

The decision on refusal in issue of the certificate can be appealed in the central executive body which provides forming of state policy in the field of energy saving, or in the court in time determined by the Law.

10. In case of application as the main fuel of waste energy potential of engineering procedures it is necessary to notice that belong to this potential: combustion gases; domain and coke gases; gas methane of decontamination of coal fields; heated air which has the considerable pressure and temperature; pairs of high pressure which is by-product of the basic engineering procedure; energy of excessive pressure of gas.

11. In case when combustion of additional fuel is applied to maintenance of design electric power of cogeneration installation in case of temporary reduction of thermal power of waste energy potential concerning its value accepted in the engineering design of cogeneration installation the amount of expenses of additional fuel is approved by the owner of cogeneration installation with Gosenergoeffektivnosti of Ukraine.

For the purpose of approval of amount of expenses of additional fuel the applicant submits to Gosenergoeffektivnosti of Ukraine the application in any form where he specifies type of additional fuel, indicator of reduction of thermal power of waste energy potential (in GDzh) concerning its value accepted in the engineering design of cogeneration installation, calculation of the amount of its expenses necessary for ensuring support of design electric power of cogeneration installation (in tons of conditional fuel).

State energy efficiency of Ukraine within 10 working days from the date of receipt of the statement of Ukraine sends to Gosenergoeffektivnosti to the applicant the message on approval or on refusal in approval (with reasons for the bases) amounts of additional fuel.
