For the purpose of further enhancement of system of regulation of import, increase in efficiency of transactions on import of food products for the state needs the Cabinet of Ministers decides:

1. Approve:

Regulations on the Agency on tendering process of Uzbektenderkonsalting according to the appendix N1.

2. Declare invalid the Order of registration of import contracts in the Ministry of Foreign Economic Relations approved by the resolution of the Cabinet of Ministers of October 1, 1996 No. 342, regarding registration of import contracts of food products for the state needs.

3. To impose control over the implementation of this resolution on Department of the Cabinet of Ministers on coordination of foreign economic activity.

Regulations on the Agency on tendering process of Uzbektenderkonsalting under the Ministry of external commercial relations of investments and trade of the Republic of Uzbekistan

I. General provisions

1. The tendering process agency under the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan Uzbektenderkonsalting, hereinafter referred to as "Agency", is the subordinated organization of the Ministry of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan.

2. The agency is the specialized organization for holding tenders, tenders for purchase, sales of goods, works, services.

II. Tasks of the Agency

1. The main objectives of the Agency are:

- ensuring economic interests of the Republic of Uzbekistan;

- development of the methodical and regulating documentation on tendering, tenders on purchases of main type of food for the state needs according to orders of the Cabinet of Ministers of the Republic of Uzbekistan;

- carrying out precompetitive selection of direct producers and suppliers of goods, works, services;

- providing equal competitive conditions for participants of the tender;

- implementation of prequalification selection of suppliers, expert evaluation of the arriving offers, the organization of advertizing work.

III. Legal position of the Agency

1. The agency is legal entity, has, the isolated property, has separate balance, accounts in one of the bank institutions having the right to sign on its own behalf agreements, to acquire the property and personal non-property rights and to perform duties, to be claimant and the defendant in courts.

2. The agency answers for the obligations all property belonging to it.

3. The agency builds the activities according to the principle of objectivity of preparation and tendering process, is guided by the Constitution of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees and resolutions of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, orders of the Minister of Foreign Economic Relations, Investments and Trades of the Republic of Uzbekistan, international treaties of the Republic of Uzbekistan, and also this Provision.

4. The agency performs the activities on the terms of complete economic independence.

5. Relations of the Agency with other partners in financial and economic activities are performed on contractual basis.

6. The agency has seal with the image of the State Emblem of the Republic of Uzbekistan, with the name in the Uzbek and English languages, forms and other means of visual identification.

IV. Functions of the Agency

For providing the specified tasks the Agency according to the legislation of the Republic of Uzbekistan performs the following functions:

- develops the tender documentation for the biddings on delivery of goods, works and services;

- makes precompetitive selection of potential suppliers of goods, works and services;

- performs preparation and will organize direct tendering process;

- performs information activities in the Republic of Uzbekistan and abroad under the terms and to procedure for tendering process;

- studies foreign work experience on tendering process and other types of service in the field of tendering process;

- renders consulting services for the state consumers on acceptance and action of regulations regarding government procurement.

V. Rights of the Agency

1. For implementation of the Agency functions has the right:

- conclude with other foreign agencies on tendering process of the agreement on provision (acquisition) of information on tendering process on terms of the exchange or on commercial basis;

- receive in accordance with the established procedure at the ministries, the state committees, departments, local authorities of the government, legal entities of the Republic of Uzbekistan and foreign states information necessary for the Agency for implementation of the tasks;

- publish and distribute in the Republic of Uzbekistan and abroad the information bulletins and other information products;

- provide on contractual basis information about tendering process to the foreign and domestic organizations;

- obtain the credits, sign on its own behalf agreements, acquire the property and personal non-property rights, plead the claimant and the defendant at the bar, economic and reference tribunal;

- create with the consent of MVESIT regional departments for distribution of information on tendering process;

- perform the economic, including foreign economic activity which is not contradicting the purposes and tasks of the Agency determined by this Provision according to the legislation of the Republic of Uzbekistan.

2. The agency for the solution of tasks, the determined this Provision, has the right to perform other types of activity which are not prohibited by the legislation of the Republic of Uzbekistan.
