About approval of the Procedure for maintaining the Register of seaports of Ukraine

In pursuance of article 6 of the Law of Ukraine "About seaports of Ukraine" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for maintaining the Register of seaports of Ukraine which is applied.

2. To submit to the ministry of infrastructure in accordance with the established procedure proposals concerning reduction of acts of the Cabinet of Ministers of Ukraine in compliance with this resolution.

Procedure for maintaining Register of seaports of Ukraine

1. This Procedure determines the mechanism of maintaining the Register of seaports of Ukraine (further - the Register) as single electronic database about seaports, terminals and subjects of managing which carry out the activities in the territory of seaports.

The purpose of maintaining the Register is providing with the data necessary for task performance in the field of safety of navigation, protection of the surrounding environment, strategic development of seaports, and also for implementation of the state supervision (control) of objects of port infrastructure.

2. The administrator Reestra - the state company "Administration of Seaports of Ukraine" which collects records, generalizes, systematizes, analyzes and performs data which move administrations of seaports, enters data in the Register or excludes from it and resolves organizational matters in the course of its maintaining, and also Reestra, access to it, preserving and data protection which contain in Reestra provides technical and technological maintenance.

3. The Ministry of Infrastructure provides forming of the Register and control of its maintaining.

4. Such data are entered in the Register:

serial number of seaport (it is appropriated to seaport automatically by the software during entering of data on seaport into the Register);

name of seaport and its location;

name and location of administration of seaport;

date and basis of opening of seaport;

the list of services which are provided in the territory of seaport;

the list of moorings and maritime terminals within seaport;

the list of port operators, operators of terminals and services which they provide (full name, the location and the postal address, technical characteristics of the terminal and so forth);

the list of the suppliers of liquid fuel rendering services in seaports (full name, the location and the postal address, the e-mail address, phone number);

the basic technical characteristics of seaport, in particular its opportunities concerning amounts of cargo handling, servicing of courts and/or passengers (the number of moorings (with indication of length of the mooring front and depth at the mooring) and other hydraulic engineering constructions; handling capacity of terminals, the area of the covered and ground storages);

borders of the territory and water area of seaport;

groups of loads which are processed in seaport;

type and the size (draft, length, width) of water vehicles which are serviced in seaport;

shipping season;

bases and date of exception of seaport of the Register;

restrictions on safety of navigation in the seaport water area.

5. For entering of data into the Register information moves subjects of managing of administration of the relevant seaport taking into account requirements to technological support of the Register.

6. The register is kept in electronic form in the Ukrainian and English languages.

7. Data are subject to entering into the Register within five working days from the date of their receipt from administration of the relevant seaport.

8. In case of submission of incomplete information and/or detection of false information the administrator Reestra within three working days by means of the corresponding software sends to administration of the relevant port the electronic message concerning need of elimination of the revealed shortcomings.

9. Reliability and completeness of the submitted information for entering of data into the Register are provided by subjects of managing which give it to administration of seaport.

10. The administrator Reestra provides reliability, completeness, updating and timeliness of entering of the submitted data into the Register.

11. The register is posted on the official site of the state company "Administration of Seaports of Ukraine".

12. Access to data of the Register is open and free.
