considered in meeting without carrying out hearing case on check of constitutionality of paragraph two of Item 14 of article 15 of the Federal law "About the Status of the Military Personnel".

Reason for consideration of the case were claims of citizens A. S. Zorin, A. G. Kozhushny, E. V. Lapshin, A. E. Mikhaylov, E. T. Tatarenkov and A. A. Timoshenkov. established:

1. According to the paragraph of Item 14 of the article 15 "Right to housing" of the Federal Law of May 27, 1998 No. 76-FZ "About the status of the military personnel" in case of impossibility to provide with premises of the citizens discharged from military service accepted till January 1, 2005 on accounting by local government bodies as persons in need in premises to them monthly is paid to the second monetary compensation at the expense of means of the federal budget according to the procedure and the sizes determined by the Government of the Russian Federation.
