Regulations on implementation of federal state energy supervision

1. This Provision determines procedure of federal state energy supervision (further - the state supervision).

2. The state supervision in the field of power industry is exercised by Federal Service for Environmental, Technological and Nuclear Supervision and other authorized federal executive bodies (further - state supervision bodies) and is directed to the prevention, identification and suppression of violations by subjects of power industry and consumers of electrical energy of requirements for safe operation on power generation facilities, requirements to safety in the field of power industry, including special conditions of use of the parcels of land in borders of conservation zones of the power generation facilities established by the Federal Laws and other regulatory legal acts of the Russian Federation accepted according to them in the field of power industry (further - mandatory requirements in the field of power industry), and also rules on labor protection, by means of the organization and conducting checks, acceptances of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations, to attraction of persons which violated such requirements to responsibility and activities of state supervision bodies for systematic observation of execution of mandatory requirements in the field of power industry, to the analysis and forecasting of condition of execution of mandatory requirements in the field of power industry when implementing activities by subjects of power industry and consumers of electrical energy.

2(1). The state supervision is not exercised concerning activities of consumers of the electrical energy connected with operation of the power receiving devices which are used for domestic needs, and also other power receiving devices which total maximum capacity does not exceed 150 kilowatts with rated voltage up to 1000 volts and which are attached to one source of electric utility service.

2(2). The state supervision in the field of heat supply is exercised by state supervision bodies and is directed to the prevention, identification and suppression of violations by the heatsupplying organizations and the heatnetwork organizations of requirements for safe operation on the objects of heat supply, safety requirements in the field of heat supply established by the Federal Law "About Heat Supply", technical regulations, rules of technical operation of objects of heat supply and the heatconsuming installations (further - mandatory requirements in the field of heat supply), and also rules on labor protection, by means of the organization and conducting checks, acceptance of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of effects of the revealed violations, to attraction of persons which violated mandatory requirements in the field of heat supply to responsibility, and also activities of state supervision bodies for systematic observation of execution of mandatory requirements in the field of heat supply, to the analysis and forecasting of condition of execution of mandatory requirements in the field of heat supply.

2(3). Concerning the objects of heat supply which are hazardous production facilities, scheduled inspections of observance of safety requirements in the field of heat supply are carried out when implementing federal state supervision in the field of industrial safety with the frequency established by the Federal Law "About Industrial Safety of Hazardous Production Facilities".

3. Officials of state supervision bodies, representatives to exercise the state supervision on behalf of these bodies, are:

a) heads of state supervision bodies;

b) deputy managers of state supervision bodies;

c) heads of structural divisions of state supervision bodies, their deputies;

d) chiefs of departments of structural divisions of state supervision bodies, their deputies;

e) other officials of state supervision bodies, representatives in accordance with the established procedure on implementation of the state supervision;

e) heads of territorial authorities of state supervision body, their deputies;

g) chiefs of departments of territorial authorities of state supervision body, their deputies;

h) other officials of territorial authorities of state supervision body, representatives in accordance with the established procedure on implementation of the state supervision.

4. The state supervision is exercised by means of conducting scheduled and unscheduled, documentary and exit inspections according to Articles 8. 1, 9 - 13 and 14 Federal Laws "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" (further - checks).

4(1). The officials of Federal Service for Environmental, Technological and Nuclear Supervision exercising the state supervision when conducting planned inspection shall use checking sheets (lists of control questions).

Use of checking sheets (lists of control questions) is performed when conducting planned inspection of all legal entities and individual entrepreneurs.

Checking sheets (lists of control questions) contain the questions mentioning the mandatory requirements shown to the legal entity and the individual entrepreneur which observance is the most significant from the point of view of non-admission of emergence of threat of damnification of life, to health of citizens, harm to animals, plants, the environment, objects of cultural heritage (historical and cultural monuments) of the people of the Russian Federation, safety of the state, and also threat of emergency situations of natural and technogenic nature.

The subject of scheduled inspection of legal entities and individual entrepreneurs is limited to the list of the questions included in checking sheets (lists of control questions).

5. Officials of state supervision bodies when conducting checks have the right:

a) freely upon presentation of the official ID and the copy of the order (order) of state supervision body on purpose of check to visit the territories, buildings, rooms, constructions located in borders of conservation zones of power generation facilities, and also the territory, buildings, rooms, constructions of objects of heat supply of the heatsupplying organizations, the heatnetwork organizations;
