3. To head department of information technologies (A. E. Shashayev), to customs authority Central information technically (A. A. Timofeev) within six months from the date of entry into force of this order to provide upgrade of information software of the Single automated information system of customs authorities according to requirements of the Procedure.

4. For public relations (A. V. Smelyakov) to provide to management publication of this order in official publications of FCS of Russia.

5. To impose control of execution of this order on the deputy manager of FCS of Russia R. V. Davydov.

This order becomes effective after 30 days after day of its official publication.

Procedure for submission of documents and data to customs authority when placing goods on warehouse of temporary storage (other places of temporary storage of goods), placements (issue) of goods on warehouse of temporary storage (from warehouse) and other places of temporary storage, submission of the reporting on the goods which are on temporary storage and also procedure and conditions of issue of permission of customs authority to temporary storage of goods in other places

I. General provisions

1. The procedure for submission of documents and data to customs authority when placing goods on warehouse of temporary storage (other places of temporary storage of goods), placements (issue) of goods on warehouse of temporary storage (from warehouse) and other places of temporary storage, submission of the reporting on the goods which are on temporary storage and also procedure and conditions of issue of permission of customs authority to temporary storage of goods in other places, is developed on the basis and according to the Customs Code of the Customs Union (The Federal Law of June 2, 2010 No. 114-FZ "About ratification of the Agreement on the Customs Code of the Customs Union" (The Russian Federation Code, 2010, No. 23, the Art. 2796) (further - the Customs code), the Federal Law of November 27, 2010 No. 311-FZ "About customs regulation in the Russian Federation" (The Russian Federation Code, 2010, No. 48, Art. 6252; 2011, No. 27, the Art. 3873, No. 29, the Art. 4291, No. 50, the Art. 7351) (further - the Federal Law).

2. After completion of customs procedure of customs transit (arrival of goods on customs area of the Customs union) goods shall be placed in the customs control zone (the adjacent territory of the warehouse of temporary storage (WTS) created in the place of completion of customs procedure of customs transit (the place of arrival of goods).

The carrier or other interested person having powers concerning goods or their representatives (further - the authorized person) shall place goods on temporary storage if with goods the customs transactions connected with their customs declaring according to customs procedure within 3 hours after completion of customs procedure of customs transit are not made (presentations of goods to customs post in the place of arrival), (concerning the goods transported by railway or water transport - 12 hours).

3. Goods can not be located on temporary storage if during the time specified in Item 2 presents of the Procedure the customs transactions connected with their customs declaring according to customs procedure are made:

to customs authority it is given and it registers the customs declaration;

all data necessary for customs declaration of goods are provided;

the documents necessary for release of goods, except for case are submitted if separate documents based on which the customs declaration is completed cannot be provided in case of submission of the customs declaration, and according to the motivated address of the customs applicant the customs authority resolves submission of such documents after release of goods.

Goods in the above-stated cases are placed in the customs control zone (in the adjacent territory of SVH).

In case of withdrawal of the customs declaration or refusal in release of goods, and also in need of carrying out or completion concerning these goods of forms of customs control with prolongation of term of release of the customs declaration such goods are located on temporary storage as they cannot be considered as goods concerning which customs transactions are made. The placement of the specified goods on temporary storage is performed by the authorized person within 3 hours from the moment of approach of the corresponding event.

4. Temporary storage of goods is performed:

in rooms and (or) on the open areas of SVH in the places included in the net volume of the specified rooms (the usable space of the open areas) according to requirements of article 73 of the Federal Law;

in rooms and (or) on the open areas of SVH of the closed type intended for storage of goods of the warehouse keeper, and in other places of temporary storage specified in Item 34 presents of the Procedure without determination of the net volume (usable space);

in other places of temporary storage of the goods established by part 1 of article 198 of the Federal Law without determination of the net volume (usable space).

5. Goods placement on temporary storage and temporary storage of goods are performed according to this Procedure and taking into account requirements of the civil legislation of the Russian Federation, and also the legislation of the Russian Federation establishing procedure for storage of the separate types of goods requiring special storage conditions.

6. When using SVH for storage of goods in cases, stipulated in Article 145 Customs codes and Articles 168, of 183, 189 Federal Laws, goods on SVH are placed by customs authority.
