About approval of the Procedure for forming of the accounting identifier of the subject of primary financial monitoring and provision of the message on its assignment

According to Item of 1 part two of article 6 of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way or to terrorism financing", the paragraph third Item 9 of the Procedure for capture on accounting of subjects of primary financial monitoring, registration of financial transactions by them which are subject to financial monitoring, and representation of financial monitoring of information to Public service on the specified and other financial transactions which can be connected with legalization (washing) of income gained in the criminal way, or the terrorism financing approved by the resolution of the Cabinet of Ministers of Ukraine of August 25, 2010 No. 747, the resolution of Board of the National Bank of Ukraine of May 14, 2003 No. 189 "About approval of the Regulations on implementation of financial monitoring by banks" the subitem 64 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 08, 2011 No. 446, and for the purpose of ensuring registration of the subject of primary financial monitoring of PRIKAZYVAYU registered in the Ministry of Justice of Ukraine on May 20, 2003 for No. 381/7702,:

1. Approve the Procedure for forming of the accounting identifier of the subject of primary financial monitoring and provision of the message on its assignment which is applied.

2. Declare invalid the order of the State committee of financial monitoring of Ukraine of August 27, 2010 No. 150 "About approval of the Procedure for forming and provision of the accounting identifier of the subject of primary financial monitoring", registered in the Ministry of Justice of Ukraine on October 06, 2010 for No. 892/18187.

3. (Chmeruk M. O.) together with Department of information technologies of Public service of financial monitoring of Ukraine (Davydyuk V. S.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and vice-chairman of Public service of financial monitoring of Ukraine Zubriya V. P.

Procedure for forming of the accounting identifier of the subject of primary financial monitoring and provision of the message on its assignment

І. General provisions

1. Action of this Procedure extends to subjects of primary financial monitoring and their separate divisions (subjects are farther), which perform submission of information according to requirements of the Law of Ukraine "About prevention and counteraction of legalization (washing) of income gained in the criminal way or to terrorism financing" (further - the Law).

2. In this Procedure terms are used in such value:

key details - the information about the subject specified in the form of accounting and which change requires assignment of the new accounting identifier which are:

1) for subjects which are not banks, - legal entities (separate divisions):

code on EGRPOU;

subject's type;

2) for subjects which are banks (their separate divisions) or branches of foreign banks:

code on EGRPOU;

subject's type;

code of bank institution;

intra bank registration code;

3) for subjects which are physical persons:

registration number of accounting card of the taxpayer or series and passport number (for persons who because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and reported about it to relevant organ of the State Tax Service and have mark in the passport);

subject's type;

the accounting identifier - combination from letters of the Latin alphabet and figures which Gosfinmonitoring of Ukraine appropriates to the subject during capture it on accounting and which is used by it during accomplishment of obligations according to the Law, including registration and submissions of information to Gosfinmonitoring of Ukraine, representation of requests in state bodies concerning identification of clients and in other cases determined by the legislation;

details - any information about the subject specified in the form of accounting;

accounting form - the document of the established sample (in paper or electronic form) which is filed by the subject for registration to Gosfinmonitoring of Ukraine or modification of details.

Other terms are used in the value given in the Law.

ІІ. Forming of the accounting identifier

1. The accounting identifier is created by Gosfinmonitoring of Ukraine based on key details of form of accounting which is given by the subject in the procedure established by the legislation.

When forming the accounting identifier for separate divisions of the subject the sequence number of the last separate division of such subject registered in Gosfinmonitoring of Ukraine is in addition considered.

2. In case of change of key details of the subject the appropriated accounting identifier is cancelled and new is in accordance with the established procedure created.

ІІІ. Provision of the message on assignment of the accounting identifier

1. The message on assignment of the accounting identifier of the subject of primary financial monitoring which is used by it when implementing requests in state bodies concerning identification of clients and in other cases determined by the legislation are created based on urgent details:

for subjects - physical persons which in the procedure established by the law because of the religious beliefs refused adoption of registration number of accounting card of the taxpayer, the certificate on statement of the subject of primary financial monitoring on accounting (further - the certificate);
