About approval of the Procedure for alienation of the parcels of land on which the objects of real military estate which are subject to realization and the parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport are located

According to part three of article 4 of the Law of Ukraine "About use of lands of defense" and part three of article 6 of the Law of Ukraine "About legal regime of property in the Armed Forces of Ukraine" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for alienation of the parcels of land on which the objects of real military estate which are subject to realization and the parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport which is applied are located.

2. Bring in the resolution of the Cabinet of Ministers of Ukraine of December 28, 2000 No. 1919 "About procedure for alienation and realization of military property of Armed Forces" (the Of_ts_yny v_snik of Ukra§ni, 2001 No. 1-2, of Art. 26; 2002 No. 29, Art. 1369; 2003 No. 21, Art. 934; 2005 No. 21, Art. 1133 No. 34, Art. 2075; 2006 No. 50, Art. 3324; 2007 No. 28, Art. 1107 No. 64, Art. 2506; 2010 No. 9, the Art. 460) changes which are applied.

3. To the Ministry of Defence, the Ministry of infrastructure together with the Ministry of Finance to provide since 2014 during preparation of the draft of the Government budget of Ukraine for the corresponding year expenses to the Ministry of Defence, Administration of the Public special service of transport, local public administrations for financing of actions for selection of the parcels of land and preparation of lots for carrying out the land biddings.

4. Provide to the Ministry of Finance transfer in the general fund of the government budget of the means which arrived from alienation of the parcels of land on which the objects of real military estate which are subject to realization and the parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport are located.

5. To the state agency of land resources to provide in the procedure established by the legislation issue in the two-month time of licenses for carrying out the land biddings to the companies (organizations) authorized by the Cabinet of Ministers of Ukraine on realization of military property in the domestic market.

6. To the Ministry of Defence and Administration of the Public special service of transport to submit to the Cabinet of Ministers of Ukraine for approval the list of the parcels of land together with the objects of real military estate located on them which are subject to realization and other parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport and are subject to alienation, based on accounting these rather military camps.

7. To Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city, district public administrations with the assistance of the Ministry of Defence and Administration of the Public special service of transport to perform based on the lists of the parcels of land of action for selection of the parcels of land and preparation of lots for carrying out the land biddings approved by the Cabinet of Ministers of Ukraine.

8. This resolution becomes effective since August 1, 2013.

Procedure for alienation of the parcels of land on which the objects of real military estate which are subject to realization and the parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport are located

1. This Procedure determines the procedure of alienation of the parcels of land together with the objects of real military estate located on them (the military camp, part of the military camp, the certain building, construction (further - objects of real military estate), subject to realization, and other parcels of land which are released in the course of reforming of Armed Forces and State special transservice, at the land biddings.

2. In this Procedure the stated below terms are used in such value:

the auction commission - the commission on preparation and carrying out the land biddings created by the contractor of the land biddings which structure, in particular, joins representatives of the organizer of the land biddings, the Ministry of Defence or Administrations of State special transservice;

alienation of the parcels of land (further - sale of the parcels of land) - sale by contractors of the land biddings of the parcels of land, including together with the objects of real military estate located on them which are subject to realization;

the contractor of the land biddings - the subject of managing determined on the competitive principles to which powers concerning alienation of military property are conferred by the Cabinet of Ministers of Ukraine and which has the license for carrying out the land biddings also signed with the organizer of the land biddings in accordance with the established procedure the agreement on their organization and carrying out;

selection of the parcels of land - works on carrying out technical inventory count and implementation according to the legislation of state registration of the property rights to the objects of real military estate located on the parcel of land; determination of the parcels of land on which objects of real military estate, taking into account the approved town-planning documentation and documentation on land management, marketing researches, investment appeal which can be offered for preparation of lot are located; or determination of the parcels of land which are released in the course of reforming of Armed Forces and the Public special service of transport, taking into account the approved town-planning documentation and documentation on land management, marketing researches, investment appeal which can be offered for preparation to lot;

lot - the parcels of land of state-owned property together with the objects of real military estate located on them which are subject to realization or the parcels of land which are released in the course of reforming of Armed Forces and the State special transservices prepared for sale and exposed on the land biddings;

organizers of the land biddings - Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city, district state administrations according to the powers determined in Article 122 of the Land code of Ukraine concerning transfer of the parcels of land to property;
