For the purpose of ensuring execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About modification and amendments in the Laws of the Azerbaijan Republic "About the Constitutional court" and "About courts and judges" of May 8, 2001 the No. 483 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Procedure for issue to judges of money allowance for treatment" it (is applied).

2. To the Ministry of Justice of the Azerbaijan Republic within 1 month to approve the standard application form about issue of money allowance for treatment to the judges provided in Item 3 of "Procedure for issue to judges of money allowance for treatment".

3. This resolution becomes effective from the date of its signing.

Procedure for issue to judges of money allowance for treatment

1. This Procedure establishes procedure for issue in the Azerbaijan Republic of money allowance to judges on their treatment.

2. The money allowance for treatment is issued to judges in the amount of, established by the legislation.

3. The money allowance provided by this Procedure is issued according to the statement of the judge who is treated or shall be treated (according to the procedure of exception - his legal representative).

4. The application on receipt of money allowance is submitted:

* judges of the Supreme Court Azerbaijani to Respublikipredsedatel of the Supreme Court of the Azerbaijan Republic;

* judges of the Constitutional Court Azerbaijani to Respublikipredsedatel of the Constitutional Court of the Azerbaijan Republic;

* judges of Appeal Courts - to the chairman of the relevant Appeal Court;

* judges of the Supreme Court Nakhchivan Autonomous to Respublikipredsedatel of the Supreme Court of the Nakhchivan Autonomous Republic;

* judges of other courts - to the Minister of Justice of the Azerbaijan Republic or the Minister of Justice of the Nakhchivan Autonomous Republic.

* the sick leave note about temporary disability issued by medical institution (doctor);

* the permit in sanatorium organization;

* other documents necessary by the legislation.

In case of non-presentation of the money allowance specified in this paragraph of the document in issue refuses.

6. The application for issue of money allowance is considered in the terms established by the legislation. In urgent cases it can be considered immediately. In case of the positive solution of question of issue of money allowance these means during five banking days are paid by the relevant structural division of the courts specified in item 4 of these rules or the Ministries of Justice to the judge (his legal representative) only by transfer.

The money allowance provided by this Procedure can be received by the judge before, in the course or upon termination of treatment.

7. Within calendar year the money allowance for treatment can be issued to the judge once.

8. The money allowance is issued to the judge (his legal representative) irrespective of the result of treatment.

9. The money allowance for the purposes provided by this Procedure is issued to the Constitutional Court of the Azerbaijan Republic, the Supreme Court of the Azerbaijan Republic, Appeal Courts, the Supreme Court of the Nakhchivan Autonomous Republic, the Ministry of Justice of the Azerbaijan Republic and the Ministry of Justice of the Nakhchivan Autonomous Republic at the expense of the funds allocated from the government budget.
