For the purpose of ensuring execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About protection of atmospheric air" of June 11, 2001 No. 501 of the Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of the certification confirming compliance of fuel, technical constructions, engineering procedures, engines, transport and other portable means, oborudovaniye to requirements for protection of atmospheric air" (are attached).

2. This resolution becomes effective from the date of signing.

Rules of the certification confirming compliance of fuel, technical constructions, engineering procedures, engines, transport and other portable means, oborudovaniye to requirements for protection of atmospheric air

1. General provisions

1.1. These rules are prepared on the basis of the Law of the Azerbaijan Republic "About protection of atmospheric air" and the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About protection of atmospheric air" of June 11, 2001 No. 501 and establish the rules of certification confirming compliance of fuel, technical constructions, engineering procedures, engines, transport and other portable means, oborudovaniye in the territory of the Azerbaijan Republic (further - objects) to requirements for environmental protection.

1.2. Certification is carried out for the purpose of prevention of import and consumption of objects, creating direct and significant threat for life, health of the person, the environment and to valuable interests of the state or causing considerable loss.

1.3. Certification is carried out according to the documents constituting basis of national system of certification.

1.4. Certification is carried out on the basis of requirements of the accepted national, international and interstate standards.

1.5. Provisions of these rules extend on all legal entities irrespective of the legal form and pattern of ownership and physical persons who are engaged in the territory of the Azerbaijan Republic in the activities able to influence pollution of atmospheric air.

1.6. Certification processes, confirming compliance of objects to requirements for protection of atmospheric air, perform national authority of certification - the State agency of anti-monopoly and control of the consumer markets - and specially appointed body - the Ministry of Ecology and Natural Resources of the Azerbaijan Republic.

1.7. Rules of issue of certification of conformity are prepared and affirm jointly the State agency of anti-monopoly and control of the consumer markets of the Azerbaijan Republic and the Ministry of Ecology and Natural Resources of the Azerbaijan Republic.

1.8. All expenses connected with certification of objects are paid by customers irrespective of results of certification, on the basis of the agreement.

1.9. Recognition of appropriate certificates of the imported equipment is performed on the basis of the legislation of the Azerbaijan Republic and international treaties with participation of the Azerbaijan Republic.

2. Organizational structure of the certification confirming compliance of objects to requirements for protection of atmospheric air

2.1. The organizational structure of the certification confirming compliance of objects to requirements for protection of atmospheric air (further - STOAV), consists of the following:

- national authority of certification - the State agency of anti-monopoly and control of the consumer markets;

- specially appointed body - the Ministry of Ecology and Natural Resources;

- accredited test and analytical laboratories (centers);

- customers.

2.2. The state agency of anti-monopoly and control of the consumer markets performs the following functions on certification:

- determination of the general principles of certification of STOAV in the territory of the Azerbaijan Republic;

- accreditation of test laboratories;

- the conclusion of the agreement for receipt of the certificate on safety indicators;

- choice of schemes of certification;

2.3. The Ministry of Ecology and Natural Resources performs the following functions in the field of certification:

- the organization and management of works on STOAV in the territory of the Azerbaijan Republic;

- determination of proper regulating documents for carrying out STOAV;

- determination of range of the objects which are subject to certification;

- pricing for works on STOAV;

- acceptance and consideration of the applications for certification of objects;

- determination from the point of view of ecological safety of technical requirements to production and operational facilities in the territory of the Azerbaijan Republic and conducting inspection supervision over them for the purpose of protection of atmospheric air;

- creation in necessary cases of interconnection with other organizations;

- adoption of the conclusion for issue of the certificate of conformity by positive results of testing and checks;

- provision of the right to marking of objects sign CTOAB;

- conducting counter works on STOAV with other countries and international organizations;

- introduction of offers on decision making about accession to the international and regional agreements, and also the conclusion of agreements on mutual recognition of results of certification;

- making the conclusion for recognition of certificates of foreign countries.

2.4. Accredited test and analytical laboratories (centers) carry out testing and analyses of the certified objects and constitute protocols (acts) of their results.
