About mutual deliveries

The government of the Republic of Uzbekistan and the Government of Turkmenistan which are hereinafter referred to as by "Parties"

wishing to promote development of economic cooperation between the Parties, and also to expand and diversify their trade,

being guided by the conventional principles and rules of international law and legislations of the states,

recognizing importance of long-term measures for development of cooperation and strengthening of ties between two states at the different levels, including their business entities, agreed as follows:

Article 1

For the purpose of implementation of provisions of this agreement, and also according to legislations and regulatory legal acts of two states, the Parties will cooperate in the field of mutual deliveries of goods, including, but, without being limited to the following types:

from the Republic of Uzbekistan to Turkmenistan - cars, cargo vehicles, buses, the special equipment, agricultural machinery, spare parts, mineral fertilizers, chemical remedies of plants, construction materials, the household and electrotechnical equipment, agricultural and other products;

from Turkmenistan to the Republic of Uzbekistan - oil, gas condensate, polypropylene, polystyrene, bischofite, products of textile, agricultural and processing industry, carpet products and other products.

Article 2

1. The cooperation provided by this agreement shall be performed according to the laws and rules existing in both states of the Parties, the international trade practice and on the basis of the contracts signed between the companies and business entities of the Parties.

2. The parties do not bear responsibility according to obligations of business entities of the Parties.

Article 3

Monitoring and coordination of implementation of this agreement will be performed by the Joint Uzbek-Turkmen commission on trade and economic, scientific and technical and cultural cooperation at which meetings the Parties will hold consultations, with participation of the interested companies and business entities of two states. The parties will regularly generalize data on trade in goods and to agree on the issues arising in the course of trade.

For the purposes of this agreement of the Party shall support and stimulate the following activities of the ministries, departments, organizations and companies of both states of the Parties:

- organization of business meetings, trade missions and negotiations;

- exchange of information and experience concerning their foreign trade;

- determination of the problems constraining bilateral trade cooperation, and provision of recommendations for finding of mutually satisfactory decision.

Article 4

Provisions of this agreement do not affect the rights and obligations of the either party following from international treaties which participants are Turkmenistan and the Republic of Uzbekistan, and also from their membership in the international organizations.

The parties will perform long-term cooperation according to the universally recognized norms of international law and legislations of the states.

Article 5

The parties, in case of disagreements concerning interpretation or application of this agreement, resolve them by negotiations and consultations.

Article 6

By mutual consent of the Parties changes and additions which are drawn up by separate protocols can be made to this agreement and will be integral part of this agreement.

Entry into force and effective period of the protocols specified in the first paragraph of this Article are determined by article 7 of this Agreement if other procedure is not determined by protocols.

Article 7

This agreement becomes effective from signature date and is effective till December 31, 2017. Action of this agreement is automatically prolonged for the next five-year terms if any of the Parties in six months prior to the expiration of its action does not notify in writing other Party on the intention to terminate this agreement.

The termination of effective period of this agreement will not influence the contracts signed during action and within implementation of this agreement.

It is made in the city of Ashgabat on October 2, 2012 in two authentic copies, everyone in the Uzbek, Turkmen and Russian languages, and all texts are equally authoritative.

In case of discrepancies in interpretation of this agreement of the Party will be guided by the text in Russian.
