About approval of the Regulations on the Red List of the Azerbaijan Republic

Based on the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About fauna" of August 30, 1999 the No. 186 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Provision on the Red List of the Azerbaijan Republic" it (is applied).

2. This resolution becomes effective from the date of signing.

Regulations on the Red List of the Azerbaijan Republic

The Red List of the Azerbaijan Republic is kept based on the Laws of the Azerbaijan Republic "About fauna" of June 4, 1999 No. 675-IG and "About environmental protection" of June 8, 1999 No. 678-IG.

I. General part

1. Animal species and the plants living in the territory of the Azerbaijan Republic in nature and being under the threat of disappearance (further - animal species and plants), are especially protected and brought in the Red List of the Azerbaijan Republic.

2. The Red List of the Azerbaijan Republic is the official document and reflects data on condition, distribution of types (subspecies, populations) of animals and plants in all territory of the Azerbaijan Republic, including the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic, and about measures for their protection.

3. The Red List of the Azerbaijan Republic is kept by the Ministry of Ecology and Natural Resources of the Azerbaijan Republic in coordination with the Ministry of science and education of the Azerbaijan Republic, the Ministry of Agriculture of the Azerbaijan Republic.

4. Scientific institutions and the organizations of the Ministry of science and education of the Azerbaijan Republic, the Ministry of Ecology and Natural Resources of the Azerbaijan Republic and the corresponding higher educational institutions conducting researches in the field of protection, cultivation and use of animal species and plants (further - the scientific organizations), perform scientific providing the Red List and report about its results to the Ministry of Ecology and Natural Resources of the Azerbaijan Republic.

For implementation of scientific providing the Red List the scientific organizations will organize collection, generalization, the analysis and storage of data on animal species and plants in all territory of the Azerbaijan Republic, including the sector of the Caspian Sea (lake) belonging to the Azerbaijan Republic, and also prepares actions for protection of these animal species and plants.

5. The works connected with maintaining and the periodical of the Red List of the Azerbaijan Republic are financed by the government budget.

6. For the solution of the questions connected with maintaining the Red List under the Ministry of Ecology and Natural Resources of the Azerbaijan Republic the commission on animal species and plants with participation of representatives of the scientific organizations is created.

II. Main actions for maintaining the Red List of the Azerbaijan Republic

Maintaining the Red List of the Azerbaijan Republic includes:

1. Entering into the Red List of the Azerbaijan Republic or exception of it in accordance with the established procedure animal species and plants.

2. Preparation for the edition, order and edition of the Red List of the Azerbaijan Republic.

III. Entering of animal species and plants into the Red List of the Azerbaijan Republic

1. The animal species answering to the conditions provided below and plants for which categories of the status are established are brought in the Red List of the Azerbaijan Republic:

a) the animal species and plants requiring measures of special protection:

o the rare and being under the threat of disappearance animal species and plants;

o the local rare and being under the threat of loss self-defense capabilities animal species and plants, faunae, important for preserving, and flora of different climatic zones;

o animal species and plants which actual or potential value is established, the depletions of their reserves requiring implementation of important and urgent actions for prevention in present condition of use;

o the animal species and plants which are not requiring holding important security actions, but being under the threat of loss of capability of self-defense (located and extended outside area, rare, etc.) and from this point of view requiring the state control of their condition;

b) animal species and the plants falling under coverage of international agreements and conventions;

c) the animal species and plants brought in the International Red List.

2. Offers on introduction of animal species and plants in the Red List of the Azerbaijan Republic (exception of it) go the scientific organizations, legal entities and physical persons to the Ministry of Ecology and Natural Resources of the Azerbaijan Republic.

3. Data on reduction of number of animal species and plants or reducing their area to dangerous limit, deterioration in conditions of dwelling, implementation of the actions necessary for their protection and recovery, can become the basis for introduction of these animal species and plants in the Red List of the Azerbaijan Republic, change of categories of their status.

4. Offers on introduction of animal species and plants in the Red List of the Azerbaijan Republic, to change of category of their status are considered by the Commission on animal species and plants created under the Ministry of Ecology and Natural Resources of the Azerbaijan Republic with adoption of the relevant decision.

5. The conclusion of the Commission on introduction of animal species and plants in the Red List of the Azerbaijan Republic and to change of categories of their status is accepted by a majority vote and becomes effective by order of the Ministry of Ecology and Natural Resources of the Azerbaijan Republic.

IV. Preparation for the edition, edition and distribution of the Red List of the Azerbaijan Republic

1. The Ministry of Ecology and Natural Resources of the Azerbaijan Republic prepares the Red List of the Azerbaijan Republic for the edition, organizes its edition, and also performs publication of separate announcements and distribution of materials with respect thereto.

2. The external description of the animal species and plants brought in the Red List of the Azerbaijan Republic consists of single sheets. On the back of leaf the scheme map of area of type in the territory of the republic and data on type (the status, distribution, the habitat, number, data on reproduction, the reasons of change of number and area), adequate measures on protection and information sources are given.
