CONTRACT BETWEEN THE REPUBLIC OF UZBEKISTAN AND REPUBLIC TURKMENISTAN

of October 2, 2012

About economic cooperation for 2013-2017

This agreement is approved by the resolution of the President of the Republic of Uzbekistan of December 3, 2012 No. PP-1866 "About approval of the international treaty"

The Republic of Uzbekistan and Turkmenistan which further are referred to as "Party"

considering mutual interest in further deepening and expansion of bilateral economic cooperation,

being guided by provisions of the Treaty of friendship, cooperation and mutual assistance between the Republic of Uzbekistan and Turkmenistan of January 16, 1996, Contracts between the Republic of Uzbekistan and Turkmenistan on friendship, enforcement of trust and development of cooperation of November 19, 2004, Contracts on further strengthening of friendship and full cooperation between the Republic of Uzbekistan and Turkmenistan of October 18, 2007, and also other international treaties which participants are the Parties,

being based on historically developed relation of friendship, mutual respect and trust between the people of two countries,

proceeding from the purposes to further expansion of bilateral ties and mutually advantageous partnership in trade and economic, scientific and technical, cultural and humanitarian spheres,

adhering to observance of the national legal system existing in the territory of two states and taking into account the conventional principles and rules of international law, agreed as follows:

Article 1

Economic cooperation of the Parties is based on the principles of sovereign equality of the states, equality, strategic partnership, mutual advantage and is performed taking into account national interests of the Parties by direct interaction between business entities irrespective of their patterns of ownership.

The parties abstain from the actions causing damage to interests of other Party.

Article 2

The parties will activate cooperation on further development of trade and economic relations, including by creating favorable conditions for building-up of bilateral goods turnover, growth in volumes and the range of mutual deliveries of goods (services), and also establishment of direct business contacts between representatives of business structures of the Republic of Uzbekistan and Turkmenistan.

Article 3

The parties agreed that development of cooperation in the field of transport and transport communications bears in itself the strategic importance for both states.

For this purpose the Parties will continue work on diversification of transport corridors and highways on entry into foreign markets, and also on creating favorable conditions for transportation of the foreign trade loads passing on the territories of two countries.

Article 4

The parties will promote:

to development of single line item in cooperation questions in the field of environmental protection and rational environmental management, including concerning management and use of water and energy resources of basins of the cross-border rivers of Central Asia, and also overcoming ecological crisis and improvement of economic and social situation in the basin of the Aral Sea;

to providing mutually advantageous conditions of entrance, the departure and stay of operational personnel, motor transport and mechanisms used in water management and electrical power objects in the territory of two states;

to building-up of cooperation in the field of the prevention and liquidation of emergency situations, and also in education, research works, health care, culture, sport and tourism.

Article 5

For the purpose of implementation of this agreement of the Party adopt the Program of economic cooperation between the Republic of Uzbekistan and Turkmenistan for 2013 - 2017 (further - the Program) which is integral part of this Agreement and render every possible assistance in its realization.

The parties will actively advance cooperation in the spheres provided by the Program, taking the important place in economic development of two states.

The parties will promote creation of the favorable investment climate for cooperation in the specified economy industries.

Article 6

The parties charge to the Joint Uzbek-Turkmen commission on trade and economic, scientific and technical and cultural cooperation coordination of accomplishment of the Program, control of the course of its realization.

The course of accomplishment of the Program is considered at meetings of the above-stated commission at least once a year.

Article 7

Disputes and disagreements on interpretation and application of provisions of this agreement are subject to settlement by consultations and negotiations.

Article 8

By mutual consent of the Parties changes and additions which are drawn up by separate protocols which become effective according to Article 10 of this Agreement can be made to this Agreement and commencing on the effective date are its integral part.

Article 9

This Agreement does not affect the rights and obligations of the Parties following from other international treaties which participants they are.

Article 10

This Agreement becomes effective from the date of receipt through diplomatic channels of the last written notice confirming accomplishment of the interstate procedures by the Parties necessary for its entry into force and is effective till December 31, 2017.

Each of the Parties can terminate this Agreement by the direction of the written notice to other Party. In this case the Agreement stops the action in six months from the date of receipt of such notification.

Cancellation of this Agreement does not extend to implementation of the projects and programs begun in its framework, before their full completion if the Parties do not agree about other.

It is made in the city of Ashgabat on October 2, 2012 in two authentic copies, everyone in the Uzbek, Turkmen and Russian languages, and all texts have identical legal force.

For the purposes of interpretation of provisions of this agreement the text in Russian is used.
