In pursuance of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About traffic" of November 22, 1998 24, the Cabinet of Ministers of the Azerbaijan Republic decides No.:

1. Approve Model clause about vehicular maintenance it (is applied).

2. Approve Model clause about the technical repair sites rendering vehicular maintenance it (is applied).

3. Approve Model clause about the repair technical stations rendering vehicular maintenance it (is applied).

4. To provide to the ministry of digital development and transport of the Azerbaijan Republic and the Ministry of Economics of the Azerbaijan Republic within the competence supervision of implementation of requirements of these provisions.

5. This resolution becomes effective from the date of signing.

Model clause about vehicular maintenance

I. General provisions

1.1. This Provision is prepared according to the Laws of the Azerbaijan Republic "About traffic", "About consumer protection", "About transport", the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About traffic" of November 22, 1998 No. 24, "Regulations on the Ministry of digital development and transport of the Azerbaijan Republic" and requirements of other regulatory legal acts about the sphere of road and transport complex and establishes rules of vehicular maintenance in the territory of the Azerbaijan Republic, governs the relations arising between consumers and contractors during rendering the provided services.

1.2. The consumer - the physical person or legal entity ordering vehicular maintenance.

1.3. The contractor - the legal entity irrespective of pattern of ownership and legal form, and also the physical person who is engaged in business activity without creation of the legal entity, rendering services in maintenance of vehicles.

1.4. Maintenance consists of repair and technical care of vehicles, is the complex action directed to identification and debugging, and also to reliable and safe operation and ecological suitability.

1.5. Maintenance provides material and legal responsibility of the contractor guaranteeing safe result and free remedial action of the provided maintenance during the established time.

II. Information on maintenance, rules of adoption of orders and creation of agreements

2.1. The contractor shall inform the consumer the name of the organization, its location (legal address) and operational mode. These data are placed at the stand specifying the name of the organization.

The contractor shall inform the consumer according to its requirement about state registration with indication of the name of the body which registered the contractor.

The contractor who temporarily suspended the activities for the purpose of holding sanitary, repair and other actions shall notify consumers on time of suspension of works and term of suspension.

2.2. The contractor shall provide to the consumer information on technical services giving the chance to make right choice to the conclusion of the agreement.
