About some questions of activities of public institution "Transport inspection of the Ministry of Transport and Communications of the Republic of Belarus"

For the purpose of ensuring functioning of system of electronic collection of fare of vehicles on paid highways of the Republic of Belarus, control of execution of procedure for its collection and strengthening of responsibility for violation of requirements to accomplishment of motor transportations of passengers:

1. Grant the right:

1.1. to authorized officers of public institution "Transport inspection of the Ministry of Transport and Communications of the Republic of Belarus" (further - Transport inspection) to constitute protocols on the administrative offenses provided in part 1-1 of Article 12.7 and parts 6-8 of article 18.12 of the Code of the Republic of Belarus about administrative offenses;

1.2. to bodies of the Ministry of Transport and Communications to consider cases on the administrative offenses provided in parts 6-8 of article 18.12 of the Code of the Republic of Belarus about administrative offenses, protocols on which making are constituted by authorized officers of Transport inspection;

1.3. to the chief of Transport inspection and his deputies, chiefs of branches of Transport inspection and their deputies to consider on behalf of bodies of the Ministry of Transport and Communications of case on the administrative offenses provided in parts 6-8 of article 18.12 of the Code of the Republic of Belarus about administrative offenses.

2. Determine that:

2.1. authorized officers of Transport inspection have the right to carry out control order placement on rendering services in motor transportation of passengers;

2.2.     No. 523 is excluded according to the Presidential decree of the Republic of Belarus of 27.11.2013

2.3.     No. 349 is excluded according to the Presidential decree of the Republic of Belarus of 10.08.2015

2.4. in case of disagreement of owners (owners) of vehicles with the requirement about introduction of payment by them with oversize for driving of vehicles through paid highways of the Republic of Belarus specified persons make claim according to the procedure, determined by Council of Ministers of the Republic of Belarus.

Presentation of the claims specified in part one of this subitem does not stop collection of the payment which is not brought by owners (owners) of vehicles with oversize for driving of vehicles through paid highways of the Republic of Belarus.

3. Permit the Ministry of Internal Affairs according to the procedure, established by the legislation, transfer information on vehicles and their owners (owners) in the amount determined by Council of Ministers of the Republic of Belarus, to the Ministry of Transport and Communications for transfer to other organizations for the purpose of ensuring system operation of electronic collection of payment.

Illegal distribution of information specified in part one of this Item attracts responsibility according to legal acts.

3-1. The transport inspection has the right to request and receive data:

according to the procedure, established by the Ministry of Transport and Communications together with the State Customs Committee, - from the State Customs Committee about customs applicants of the vehicles for private use issued for the purpose of the address on customs area of the Eurasian Economic Union without restrictions on use and the order for creation of the act of violation of payment procedure for driving of vehicles through paid highways of the Republic of Belarus;

according to the procedure, established by the Ministry of Transport and Communications together with the Ministry of Taxes and Tax Collection, - from the Ministry of Taxes and Tax Collection about availability of the current (settlement) bank accounts in banks and the non-bank credit and financial organizations of legal entities, individual entrepreneurs - owners (owners) of vehicles for collection in indisputable procedure from owners (owners) of vehicles of the payment which is not brought by them with oversize for driving of vehicles through paid highways of the Republic of Belarus through committed executive text of the notary.

4.     No. 523 is excluded according to the Presidential decree of the Republic of Belarus of 27.11.2013

5. Make changes and additions to the following presidential decrees of the Republic of Belarus:

5.1. in parts one and the second appendices to the Presidential decree of the Republic of Belarus of March 20, 1996 No. 114 "About free economic zones in the territory of the Republic of Belarus" (Collection of presidential decrees and resolutions of the Cabinet of Ministers of the Republic of Belarus, 1996, No. 9, Art. 225; National register of legal acts of the Republic of Belarus, 2005, No. 92, 1/6516; 2012, 1, 1/13170) words "the republican unitary enterprise "Belavtostrada" shall be replaced with words No. "the republican unitary enterprise of highways Brestavtodor;

5.2. in the Traffic regulations approved by the Presidential decree of the Republic of Belarus of November 28, 2005 No. 551 "About measures for traffic safety increase" (The national register of legal acts of the Republic of Belarus, 2005, No. 189, 1/6961; 2007, No. 251, 1/9036; 2009, No. 27, 1/10431; 2010, No. 288, 1/12128; 2012, No. 8, 1/13223):
