1. Approve the enclosed Regulations on licensing of operation explosion-fire-hazardous and chemically hazardous production facilities I, II and III classes of danger.

2. Make to the section Rostekhnadzor of the list of the federal executive bodies performing licensing of specific types of activity, No. 957 approved by the order of the Government of the Russian Federation of November 21, 2011 "About the organization of licensing of separate types of activity" (The Russian Federation Code, 2011, No. 48, Art. 6931; 2012, No. 39, Art. 5267), following changes:

a) the paragraph one to state in the following edition:

"Operation explosion-fire-hazardous and chemically hazardous production facilities I, II and III classes of danger";

b) declare paragraph two invalid.

3. Recognize invalid:

Regulations on licensing of operation explosion-fire-hazardous and chemically hazardous production facilities I, II and III classes of danger

1. This Provision determines procedure for licensing of operation explosion-fire-hazardous and chemically hazardous production facilities I, II and III classes of the danger (further - objects) performed by legal entities and individual entrepreneurs (further - the licensed type of activity).

2. The licensed type of activity includes performance of works on objects according to the list according to appendix.

3. Licensing of operation of objects is performed by Federal Service for Environmental, Technological and Nuclear Supervision (further - the licensing body).

4. Licensed requirements to the license applicant on implementation of the licensed type of activity (further - the license) are:

a) availability on the property right or other legal cause in the place of implementation of the licensed type of activity of the parcels of land, buildings, structures and constructions, on (in) which objects, and also the technical devices planned for application on objects are placed;

b) availability of the documents confirming input of the objects in operation or entered in the register of positive experimental testimonies of industrial safety on the technical devices planned for application on objects and also on buildings and constructions on objects (further - positive experimental testimony of industrial safety) according to Articles 6, 7 and 13 Federal Laws "About Industrial Safety of Hazardous Production Facilities";

c) compliance of the technical devices planned for application on objects, to mandatory requirements of technical regulations, federal regulations and rules of industrial safety or before their entry into force - to the requirements of industrial safety established by regulating documents of federal executive bodies, the stipulated in Article 49 Federal Laws "About modification of separate legal acts of the Russian Federation in connection with realization of provisions of the Federal Law "About Technical Regulation" according to article 7 of the Federal law "About Industrial Safety of Hazardous Production Facilities" and article 46 of the Federal law "About Technical Regulation";

d) availability of declarations of industrial safety in cases, the stipulated in Article 14 Federal Laws "About Industrial Safety of Hazardous Production Facilities";

e) creation of management system industrial safety in cases, the stipulated in Article 11 Federal Laws "About Industrial Safety of Hazardous Production Facilities";

e) availability of regulations on production control over observance of requirements of industrial safety on objects according to article 11 of the Federal law "About Industrial Safety of Hazardous Production Facilities";

g) availability conforming to the established requirements of devices and control systems, managements, alarm systems, the notification and antiemergency automatic protection of engineering procedures on objects in cases if obligation of availability of such devices and systems is provided by federal regulations and rules of industrial safety or before their entry into force - the requirements of industrial safety established by regulating documents of federal executive bodies, the stipulated in Article 49 Federal Laws "About modification of separate legal acts of the Russian Federation in connection with realization of provisions of the Federal Law "About Technical Regulation" according to article 9 of the Federal law "About Industrial Safety of Hazardous Production Facilities";

h) availability of actions plans on localization and mitigation of consequences of accidents on objects according to article 10 of the Federal law "About Industrial Safety of Hazardous Production Facilities";

i) availability of the service agreements signed with professional rescue services or forming or the organization of own professional rescue services according to article 10 of the Federal law "About Industrial Safety of Hazardous Production Facilities";
