About the state housing supervision

Based on Item 16.1 of Article 12 and part 2 of article 20 of the Housing code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Regulations on the state housing supervision.

2. Determine that the Ministry of Construction and Housing and Communal Services of the Russian Federation performs coordination of activities of executive bodies of the subjects of the Russian Federation exercising the state housing supervision.

3. To the Ministry of Regional Development of the Russian Federation to approve methodical recommendations about development of procedure of the state housing supervision in subjects of the Russian Federation, including order of interaction of bodies of municipal housing control with the authorized bodies of the executive authority of subjects of the Russian Federation exercising regional housing supervision and administrative regulations of execution of functions on the state housing supervision and municipal housing control.

4. Recommend to public authorities of subjects of the Russian Federation to approve within the Russian Federation established in the subject of the number of staff of public authorities of the subject of the Russian Federation the standard rate of the number of staff of staff of bodies of the state housing supervision providing accomplishment of the powers assigned to such bodies by article 20 of the Housing code of the Russian Federation.

5. Recognize invalid:

the order of the Government of the Russian Federation of September 26, 1994 No. 1086 "About the state housing inspectorate in the Russian Federation" (The Russian Federation Code, 1994, No. 23, the Art. 2566);

the order of the Government of the Russian Federation of February 24, 1995 No. 182 "About modification and amendments in some decisions of the Government of the Russian Federation" (The Russian Federation Code, 1995, No. 10, the Art. 894);

Item of 1 changes and additions which are made to the decisions of the Government of the Russian Federation on housing questions approved by the order of the Government of the Russian Federation of October 13, 1997 No. 1303 (The Russian Federation Code, 1997, No. 42, the Art. 4788);

Item 5 of the order of the Government of the Russian Federation of February 6, 2006 No. 75 "About procedure for holding open tender by local government body on selection of management company for management of the apartment house" (The Russian Federation Code, 2006, No. 7, the Art. 786).

Regulations on the state housing supervision

1. This Provision establishes requirements to the organization and carrying out the state housing supervision.

2. Tasks of the state housing supervision are the prevention, identification and suppression of the violations by public authorities, local government bodies, and also legal entities, individual entrepreneurs and citizens established according to the housing legislation, the legislation on energy saving and on increase in energy efficiency of requirements to use and safety of housing stock irrespective of its patterns of ownership, including requirements to premises, their use and content, use and content of common property of owners of rooms in apartment houses to forming of funds of capital repairs, creation and activities of legal entities, the individual entrepreneurs exercising control of apartment houses, the rendering services and (or) performing works on content and repair of common property in apartment houses to provision of utilities to owners and users of rooms in apartment houses and apartment houses, regional operators, violations of restrictions of change of the amount of the payment for utilities brought by citizens, requirements to structure of standard rates of consumption of municipal resources (utilities), conditions and methods of establishment of standard rates of consumption of municipal resources (utilities), and also justification of the size of the established standard rate of consumption of municipal resources (utilities), requirements of energy efficiency and equipment of rooms of apartment houses and apartment houses metering devices of the used energy resources, requirements to provision of premises in hired houses of social use (further - mandatory requirements).

3. The state housing supervision is exercised by means of:

a) organizations and conducting checks of accomplishment by public authorities, local government bodies, legal entities, individual entrepreneurs and citizens of mandatory requirements;

b) acceptances of stipulated by the legislation measures of the Russian Federation for suppression and (or) elimination of the revealed violations;

c) systematic observation of execution of mandatory requirements, the analysis and forecasting of condition of execution of mandatory requirements when implementing by public authorities, local government bodies, legal entities, individual entrepreneurs and citizens of the activities.

4. The state housing supervision is exercised by authorized bodies of the executive authority of subjects of the Russian Federation (regional state housing supervision) (further - bodies of the state housing supervision) according to the procedure, established by the supreme executive body of the government of the subject of the Russian Federation, taking into account the requirements provided by this Provision.

5. The procedure of the state housing supervision including includes:

a) name of body of the state housing supervision;

b) structure of body of the state housing supervision and procedure for the organization of its activities;

c) powers and functions of body of the state housing supervision;

d) the list of the officials of body of the state housing supervision who are the state housing inspectors and their powers;

e) procedure for disclosure by body of the state housing supervision of information on results performed observance of mandatory requirements, and also about efficiency of the state housing supervision;

e) order of interaction of body of the state housing supervision with the bodies of municipal housing control and local government bodies performing the powers established by part 1.1 of article 165 of the Housing code of the Russian Federation with self-regulatory organizations in the sphere of management of apartment houses or other associations of legal entities irrespective of form of business or the individual entrepreneurs performing activities for management of apartment houses and also with associations (associations, the unions) of condominiums, housing, building and other specialized consumer cooperatives;

g) procedure for conducting checks of observance by public authorities, local government bodies and citizens of mandatory requirements;

h) other provisions provided by this Provision.
