About approval of the Regulations on approval procedure on special water use or water consumption
In pursuance of the Law of the Republic of Uzbekistan "About water and water use" and for the purpose of further streamlining of procedure for water use and water consumption, rational use and protection of the water Cabinet of Ministers resources decides:
1. Approve Regulations on approval procedure on special water use or water consumption according to appendix and to enact it since August 1, 2013.
2. To the ministry of agricultural and water economy, the Ministry of Health, the State committee of the Republic of Uzbekistan on ecology and environmental protection, the State committee of the Republic of Uzbekistan on geology and mineral resources, the State inspectorate for supervision of geological studying of subsoil, safe operation in the industry, mining and the household sector under the Cabinet of Ministers of the Republic of Uzbekistan, to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent:
in week time to develop specific measures for ensuring realization of the Provision approved by this resolution and observance of its requirements by all water users and water consumers;
in a month to bring the regulatory legal acts into accord with the Provision approved by this resolution;
provide control of rational use and protection of water resources, observance of procedure for water use and water consumption.
3. To impose control of execution of this resolution on Information analysis department concerning agricultural and water economy, conversion of agricultural products and consumer goods of the Cabinet of Ministers of the Republic of Uzbekistan.

Appendix
to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of June 14, 2013 No. 171
1. This Provision according to the Law of the Republic of Uzbekistan "About water and water use", and also the resolution of the Cabinet of Ministers of March 19, 2013 No. 82 "About approval of the Regulations on procedure for water use and water consumption in the Republic of Uzbekistan" establishes approval procedure on special water use or water consumption when using surface and underground water in the territory of the Republic of Uzbekistan.
2. Special water use or water consumption is performed based on the permission issued by the relevant authorized bodies specified in items 4 and the 5th this provision (further - bodies for issue of permission).
3. Special water use or water consumption is the water use or water consumption performed by legal entities and physical persons using the special constructions and devices exerting impact on condition of waters and water objects. The water use or water consumption without application of special constructions and devices but exerting impact on condition of waters and water objects can be in some cases also referred to special water use or water consumption.
3-1. Issue of permission to special water use and water consumption is not allowed from:
the wells which are not considered in accordance with the established procedure on water;
the operational inventories of underground waters which are not approved in accordance with the established procedure for group water intakes (two and more wells)
4. Permission to special water use or water consumption from natural water objects is issued:
The state committee of the Republic of Uzbekistan on ecology and environmental protection - to water users and water consumers from natural water objects of interregional and cross-border value, to the separate organizations operating large and especially important water, energy and household objects;
territorial authorities on ecology and environmental protection - from natural water objects of regional, interdistrict and district value.
5. Permission to special water use or water consumption from artificial water objects is issued:
The ministry of agricultural and water economy of the Republic of Uzbekistan - to the basin managements of irrigational systems, managements of the main channels (systems), managements of operation of water storage basins, the organizations operating cross-border water objects, water objects of interregional value, large and especially important water management objects, to managements of pumping points, power and communication, meliorative expeditions, and also other water users and water consumers - from water objects of interregional and cross-border value, and also to the separate organizations operating large and especially important water, energy and household objects;
basin managements of irrigational systems - to managements of irrigational systems, and also other water users and water consumers - from water objects of regional or interdistrict value;
managements of irrigational systems - to associations of water consumers, and also other water users and water consumers - from water objects of district value;
associations of water consumers - to farmer and Dehkan farms, self-government institutions of citizens and other water consumers who are in zone of their servicing - from water objects for agricultural needs, in coordination with district department of agricultural and water economy.
6. Permission to special water use or water consumption from natural water objects is issued by bodies for ecology and environmental protection in coordination with:
bodies of agricultural and water economy - when using surface water;
bodies for geology and mineral resources - when using underground waters (including from springs);
bodies for supervision of geological studying of subsoil, safe operation in the industry, mining and the household sector - when using mineral and thermal waters.
7. In case of water intake for drinking, household, medical, resort, recreational, fishery and production needs, irrespective of water supply source, and also in the presence of dumping of sewage into water objects and on land relief permission to special water use or water consumption shall be approved with bodies of the state sanitary inspection.
8. Bodies of agricultural and water economy, and also bodies for ecology and environmental protection in exceptional cases can resolve use of the water objects referred to category medical for other purposes, in coordination with relevant organs on supervision of geological studying of subsoil, safe operation in the industry, mining and the household sector, health cares and managements of resorts.
9. Preparation of materials, approval of the project of permission and issue of permissions to special water use or water consumption is performed according to the scheme according to appendix No. 1 to this Provision.
10. Permissions to special water use or water consumption depending on type of water use or water consumption are drawn up and issued:
for the physical persons and legal entities using water objects for industrial, utility, transport and other nonagricultural purposes in form according to appendix No. 2 to this Provision;
for basin managements of irrigational systems in form according to appendix No. 3 to this Provision;
for managements of operation of water storage basins (water-engineering systems) in form according to appendix No. 4 to this Provision;
for managements of irrigational system in form according to appendix No. 5 to this Provision;
for managements of pumping points, power and communication, and also other managements of pumping points in form according to appendix No. 6 to this Provision;
for meliorative expeditions in form according to appendix No. 7 to this Provision;
for associations of water consumers in form according to appendix No. 8 to this Provision;
for farmer and Dehkan farms, self-government institutions of the citizens and other water consumers serviced by associations of water consumers in form according to appendix No. 9 to this Provision.
In exceptional cases for certain water users or water consumers, taking into account specifics of their water use or water consumption, the form of permissions is developed and affirms the State committee on ecology and environmental protection (on natural water objects) and the Ministry of agricultural and water economy of the Republic of Uzbekistan (on artificial water objects) in coordination with the interested ministries and departments according to Items 6, of the 7 and 8 this provision, and also Information analysis department concerning agricultural and water economy, conversion of agricultural and food products of the Cabinet of Ministers of the Republic of Uzbekistan.
11. On all types of special water use or water consumption assumed to implementation on the operating, designed or reconstructed objects, one permission is drawn up.
In case of arrangement of water users or water consumers on several platforms removed from each other not connected by single source of water intake, water supply system and water disposals, several permissions can be issued to the water user or the water consumer.
At the same time the decision on issue of one or several permissions is accepted by bodies for issue of permission taking into account specifics and conditions of water use, water consumption and water disposal, and also type of water object and the receiver of sewage.
12. In case of construction new, and also reconstruction of the operating objects of special water use or water consumption permission is drawn up by the customer as a part of works on the choice of the site for construction of objects in accordance with the established procedure.
13. For receipt of permission to special water use or water consumption the water user or the water consumer:
prepares materials according to lists according to appendices No. No. 10 - 18 for this Provision;
independently or together with the attracted organizations on contractual basis develops the project of permission to special water use or water consumption in form according to appendices No. No. 2 - 9 to this Provision (in exceptional cases in separate form). The project of permission to special water use or water consumption prepares in triplicate, and in case of fence from underground sources - in four copies;
approves (except for subjects of entrepreneurship, and also the water consumers serviced by associations of water consumers) the project of permission to special water use or water consumption with the relevant organs specified in Items 6, of the 7 and 8 this provision.
14. Approval of the project of permission to special water use or water consumption of subjects of entrepreneurship, and also the water consumers serviced by associations of water consumers is performed by relevant organs on issue of permission independently after filing of application about issue of permission to special water use or water consumption.
15. Approval of the project of permission to special water use or water consumption by the bodies specified Item in paragraph five 5, and Items 6, of the 7 and 8 this provision (further - bodies for approval), is performed in week time from the date of the written address of the water user or the water consumer, and also bodies for issue of permission (for subjects of entrepreneurship, and also water consumers serviced by associations of water consumers) with provision of the prepared materials according to lists according to appendices No. No. 10 - 18 to this Provision.
16. In case of refusal in approval or need of completion of the project of permission to special water use or water consumption bodies for approval shall draw up the reasonable letter and from the date of the written address to send it to five-day time to the applicant in accordance with the established procedure.
De novo review of documents is performed within three working days from the date of the written address.
17. The special water user or the water consumer (except for subjects of entrepreneurship, and also the water consumers serviced by associations of water consumers) after approval of the project of permission submits the application for issue of permission to special water use or water consumption to relevant organs on issue of permission.
18. The statement is certified by the signature (official) and sealed the special water user or the water consumer.
Are applied to the statement for issue of permission to special water use or water consumption:
the project of permission to special water use or water consumption (in triplicate, in case of fence from underground sources in four copies) approved with bodies for approval (except for subjects of entrepreneurship, and also the water consumers serviced by associations of water consumers);
the corresponding materials according to lists according to appendices No. No. 10 - 18 to this Provision.
19. Subjects of entrepreneurship, and also the water consumers serviced by associations of water consumers for receipt of permission to special water use and water consumption submit the application to bodies for issue of permission without approval of the project of permission to special water use or water consumption.
20. Permission to special water use or water consumption is drawn up by bodies for issue of permission within twenty working days from the date of receipt of the written application of the water user or the water consumer.
Obligations of the water user and the water consumer on rational use of water resources, conducting proper accounting of amount of the taken-away water, prevention of water from pollution and depletion, and also to representation in accordance with the established procedure to authorized state bodies of the systematic reporting are applied to permission to special water use and water consumption on use of underground waters.
21. In case of refusal in issue or need of completion of the project of permission to special water use or water consumption bodies for issue of permission shall draw up the reasonable letter during the term specified in Item 20 of this provision and send it to the applicant in accordance with the established procedure.
De novo review of documents is performed by body for issue of permission within ten working days from the moment of receipt of the statement.
22. One copy of the drawn-up permission to special water use or water consumption is transferred to the water user or the water consumer, the second - the relevant division of body for issue of permission for control of observance of conditions of permission to water use or water consumption, third remains in bodies for issue of permission.
In case of intake of underground waters one copy of the drawn-up permission is transferred to relevant organ on geology and mineral resources.
23. When using of the superficial and approved operational inventories of underground waters permission to special water use or water consumption is issued for a period of five years.
23-1. During effective period of permission to special water use and water consumption on use of underground waters by the legal entities and physical persons which got permissions:
account of amount of the taken-away underground waters is daily kept in the special magazine;
annually no later than January 10 to territorial hydrogeological stations of Goskomgeologiya the report on use of underground waters on form, the approved Goskomgeologiya is submitted.
23-2. The legal entities and physical persons which got permission to special water use and water consumption on use of underground waters in the period of the term of its action have the right to carrying out preservation and degreasing of the operational wells which are drawn up by the relevant acts with participation of representatives of regional governments of Goskomecology, territorial hydrogeological stations of Goskomgeologiya and inspections of the State inspection Sanoatgeokontekhnazorat.
24. When using underground waters from unconfirmed operational inventories permission to special water use or water consumption is issued no more than one year.
25. No later than one month before expiration of permission the water user or the water consumer has the right to appeal to body for issue of permission about prolongation of effective period of earlier issued permission.
The validity of permission is extended by the body which issued this permission in the presence of the conclusion:
the responsible person on issue of permission;
relevant organs under approval about confirmation of data on lack of any changes of source and purpose, and also other conditions of water use or water consumption specified in the request of the water user or water consumer and accomplishment properly of obligations of the water user and water consumer on rational use of underground waters.
In case of invariance of source and the purpose, and also other conditions of water use or water consumption the validity of permission can be extended for new term (no more than for three years).
In case of expiration of permission to special water use or water consumption, and equally in change of sources and the purpose, and also other conditions of water use or water consumption the water user or the water consumer addresses in body for issue of permission with request for extradition of new permission in accordance with the established procedure.
26. In case of special water use or water consumption in the period of construction or reconstruction of objects permission is drawn up for their implementation in accordance with the established procedure.
With commissioning of object permission to special water use or water consumption is drawn up according to the procedure, provided by this Provision.
27. In case of transformation of the water user or the water consumer - the legal entity, change of its name or the location (postal address) on condition of invariance of source and the purpose, and also other conditions of water use or water consumption, the water user or the water consumer shall within seven working days after passing of re-registration submit to body for issue of permission the application for renewal of permission to special water use or water consumption with application of documents, confirming the specified data.
28. In case of change of surname, name, middle name or the place of activities of the water user or the water consumer - the physical person specified in the certificate on state registration granted to it on condition of invariance of source and the purpose, and also other conditions of water use or water consumption, the water user or the water consumer shall within seven working days after passing of re-registration submit to body for issue of permission the application for renewal of permission to special water use or water consumption with application of documents, confirming the specified data.
29. Before renewal of permission to special water use or water consumption the water user or the water consumer or his legal successor (heir) who submitted the application for renewal of permission makes or performs the action and (or) activities specified in it based on the submitted application for renewal of permission with mark of body for issue of permission about date of reception of an application.
30. Renewal of permission to special water use or water consumption is performed no more than five working days from the date of obtaining by body for issue of permission of the statement for renewal with appendix of the relevant documents in time.
31. Permission to special water use or water consumption after its registration is entered in the register of the issued permissions to special water use or water consumption of body for issue of permission (further - the register) in which it is specified:
the name, the location (postal address) and departmental subordination of the water user or water consumer - the legal entity, surname, name, middle name and the place of activities of the water user or water consumer - physical person;
purpose of special water use or water consumption;
the name of sources of water intake from which special water use or water consumption, and receivers of sewage is performed;
limiting settlement amount of intake of water, turnover and reusable waters, dumping of sewage;
type and performance of treatment facilities;
number, term and date of issue of permission.
32. In case of prolongation of effective period, renewal of permission in the register special entry is made.
33. The register is the working accounting document and shall be numbered, strung together and under seal body for issue of permission.
34. The termination of special water use or water consumption is performed in the procedure established by the legislation.
35. The disputes and disagreements arising in the course of issue of permissions to special water use or water consumption are solved according to the procedure, established by the legislation.
36. Persons guilty of violation of requirements of this provision bear responsibility according to the procedure, established by the legislation.
