About approval of the Rules determining general terms of gas supply by gas-distributors

1. Approve "The rules determining general terms of gas supply by gas-distributors" (are attached).

2. This resolution becomes effective from the date of its signing.

The rules determining general terms of gas supply by gas-distributors

1. General provisions

1.1. These rules are prepared based on the Law of the Azerbaijan Republic "About gas supply", the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About gas supply" of September 28, 1998 No. 773 also is determined by general terms of gas supply by Azerigaz Production association of the State Oil Company of Azerbaijan Republic and Service of operation of gas of the Nakhchivan Autonomous Republic in the territory of the Nakhchivan Autonomous Republic (further - the gas-distributor).

1.2. Gas supply by the gas-distributor shall be carried out according to the Law of the Azerbaijan Republic "About gas supply", these rules, regulating documents of the State committee of town planning and architecture, and also with the "Safety rules for gas economy" approved by the Ministry of emergency situations.

2. Classification of gas consumers

In case of shortage of gas as a result of natural disasters, accidents, etc. gas consumers on priority of gas supply are divided into two groups:

The first group is provided with gas first of all. Treat this group:

a) population;

3. Obligations of gas consumers

3.2. Consumers of gas shall use the gas installations conforming to state standards, to conduct operation of gas installations, control of consumption of gas and its registration according to industry instructions.

3.3. They shall create conditions to inspection of gas installations and their check of monitoring bodies by the relevant organizations, fulfill requirements of monitoring bodies and relevant organizations.

3.3-1. Consumers of gas once a year (till November 1 every year), according to article 6.2 of the Law of the Azerbaijan Republic "About gas supply", shall create conditions for carrying out inspection (further - inspection) gas devices and gas lines, flues, and also lines of extract and ventilation of consumers for the purpose of establishment of their working condition and observance of requirements of technical safety, including identification of shortcomings and (or) violations.

3.3-2. Inspection of gas devices and control of subjects of entrepreneurship of them is carried out in the cases and procedure provided by the Law of the Azerbaijan Republic "On regulation performed in the field of entrepreneurships and protection of interests of entrepreneurs".

3.4. For reliable and effective use of industrial gas plants consumers shall perform additional following actions: *

provide with the skilled workers who completed special course of operation and servicing of the gas installations instructed about these rules and "Safety rules for gas economy";

perform timely rezhimonaladochny works for each installation;

for each installation the regime card which is drawn up on the basis of results of regime and adjustment works shall be constituted and regime indicators shall be controlled by means of devices;

after accomplishment of capital repair work on gas installations and implementation of constructive changes to carry out extraordinary regime and adjustment works;

carry out the repair of gas installations in time specified in technical data sheet;

consumers shall establish detectors of leakage of gas and carbon monoxide in construction objects and contain them in working order.

3.5. The activities of plenipotentiaries of the gas-distributor connected with departure to places of implementation of activities of subjects of entrepreneurship and the requirement of accomplishment of terms of the contract are performed taking into account requirements of the Law of the Azerbaijan Republic "On regulation of the inspections which are carried out in the field of entrepreneurship and protection of interests of entrepreneurs".

3.6. If in case of removal of indications of gas meters of subjects of entrepreneurship plenipotentiaries of the gas-distributor establish intervention in these counters, and also illegal connection to gas distribution network bypassing the counter without the consent of the gas-distributor, then they shall take the measures connected with conducting check taking into account requirements of the Law of the Azerbaijan Republic "On regulation of the inspections which are carried out in the field of entrepreneurship and protection of interests of entrepreneurs".

4. Gas-giving suspension

4.1. The gas-distributor can turn off supply of gas in the following cases:

4.1.1. in the presence of the corresponding written address of the consumer (with indication of the reason and the term of shutdown of gas supply);

4.1.2. when carrying out repair and preventive and emergency works, including in case of prevention of the fire or leakage of gas;

4.1.3. in case of discrepancy of the gas device of the consumer to the state standards established by the State agency of anti-monopoly and control of the consumer markets of the Azerbaijan Republic;

4.1.4. in case of incomplete payment by the consumer within one month after representation (direction) the distributor to the consumer of the account for the released gas on the counter;

4.1.5. in case of not the conclusion of the relevant agreement with the distributor;
