About measures for the organization of activities of the center for management of the state assets under the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition

In pursuance of the resolution of the Cabinet of Ministers of November 14, 2012 "About the organization of activities of the State committee of the Republic of Uzbekistan for privatization, demonopolization and development of the competition", for the purpose of ensuring effective management of the state assets, implementation of single technical and economic, production policy, production upgrade, and also expansion of amounts of release and development of new types of products (works, services), including by investment attraction, the Cabinet of Ministers decides No. 322:

1. Approve:

structure of the Center for management of the state assets under the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition to the extreme number of managerial personnel in number of 35 units according to appendix No. 1;

Regulations on the Center for management of the state assets under the State committee of the Republic of Uzbekistan on assistance to the privatized companies and development of the competition according to appendix No. 2.

2. To the state committee of the Republic of Uzbekistan on privatization, demonopolization and development of the competition (further - Goskomkonkurention) to transfer to the Center for management of the state assets (further - the Center) to ownership and use, without the order right:

the state blocks of shares in authorized capitals of joint-stock companies according to appendix No. 3;

the state shares in authorized capitals of limited liability companies according to appendix No. 4.

3. To the Ministry of Internal Affairs, Goskomzemgeodezkadastra of the Republic of Uzbekistan, to Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent respectively to perform without collection of charges and other payments:

re-registration in bodies of the Ministry of Internal Affairs of the Republic of Uzbekistan the vehicles passing to the Center reorganized SUE Mulk-Invest;

re-registration on the Center of cadastral real estate documents reorganized SUE Mulk-Invest;

state registration of the changes and additions made to constituent documents of economic societies in connection with reorganization SUE Mulk-Invest.

4. Determine that:

the right and the obligation reorganized SUE Mulk-Invest pass to the Center;

balances in cash on the account reorganized SUE Mulk-Invest are subject to transfer in full into the account of the Center;

The center in the activities for management of the state assets acts on behalf of the state;

transfer to the Center of the state blocks of shares and shares in ownership and use, and also subsequent their transfer by the Center to trust management are performed without evaluating by the estimative organizations; the state blocks of shares (shares) in economic societies are delivered by the Center in trust management on competitive basis, except as specified their transfers to the state attorneys and bodies of the public and economic board;

 fee of representatives of the state in the third and fourth quarter 2012 and in the first quarter is made 2013 Goskomkonkurention in accordance with the established procedure;

 source of covering of maintenance costs, forming of necessary material and technical resources, and also other expenses connected with functioning of the Center in 2013 is part of the funds allocated in city budget of Tashkent by the Center of lease of state-owned property under territorial administration of Goskomkonkurention on the city of Tashkent, and since 2014 - at the expense of part of the dividends which actually arrived in the Government budget of the Republic of Uzbekistan on the state share and assignments from net profit of the state companies for expense budget, the approved Goskomkonkurention and the Ministry of Finance of the Republic of Uzbekistan.

At the same time the money listed to the Center is the dividends received by it as the shareholder (participant) in economic societies and according to the legislation is assessed with tax at payment source.

Accounting of the budgetary funds selected by the Ministry of Finance of the Republic of Uzbekistan and transfered to account the Center is performed on the separate off-budget account of Goskomkonkurention of the Republic of Uzbekistan.

5. Determine that:

management of the state assets delivered in trust management to bodies of the public and economic board is performed by them together with the Center according to the trust management agreement;

state bodies and public authorities on places provide to the Center analytical information, including on results of financial and economic activities of the state unitary enterprises and economic societies in which they are founders (shareholders, participants) in form, the determined Goskomkonkurention.

6. Goskomkonkurention of the Republic of Uzbekistan in a month:

in accordance with the established procedure to provide placement of the Center for zero rate of the rent;

together with the interested ministries and departments to make in the Cabinet of Ministers of the Republic of Uzbekistan offers on the changes and amendments in the legislation following from this resolution;

together with the interested ministries and departments to bring departmental regulatory legal acts into accord with this resolution.

7. To the state committee of communication, informatization and telecommunication technologies of the Republic of Uzbekistan to provide the Center with necessary government communication in accordance with the established procedure.

8. To impose control of execution of this resolution on the First Deputy Prime Minister of the Republic of Uzbekistan R.S.Azimov.
