About additional measures for providing sales warranties of the rights and legitimate interests of children

For the purpose of assistance of realization of the rights and legitimate interests of children, following the results of the All-Ukrainian meeting on protection of the rights of the child I decide:

1. To the Cabinet of Ministers of Ukraine:

1) to take immediate measures concerning enhancement of procedure for the direction of children on treatment abroad;

2) in three-months time:

develop taking into account experience of the cities of Donetsk, Kirovohrad, Chernivtsi and approve regulations on the social apartment for orphan children, children deprived of parent care and children from families which are in difficult vital circumstances, and also to promote studying and distribution of such experience in regions of Ukraine;

take measures concerning enhancement of supervising, social, educational and scheduled maintenance of ugolovnoispolnitelny inspection during control of behavior of the minors exempted from serving sentence with testing or conditional ahead of schedule;

3) in six-months time:

develop and submit in accordance with the established procedure for consideration of the Verkhovna Rada of Ukraine the bill of introduction of amendments to the Law of Ukraine "About leaves" concerning provision to one of parents tutors of orphanage of family type of the right to child care leave before achievement of three-year age by it for child care from among children pupils;

take in accordance with the established procedure measures concerning regulation of questions of licensing of activities of physical litspredprinimatel which provide educational services in the sphere of out-of-school education;

provide studying of experience of activities of the center of social support of children and families "Ray of hope" (Makarovsky district of Kiev region), by its results to handle issues concerning distribution of such experience and approval of standard regulations on the center of social support of children and families;

4) to develop and make till December 31, 2013 changes to the Procedure by agencies of guardianship and cares of the activities connected with protection of the rights of the child, the interactions of agencies of guardianship directed to enhancement of the mechanism and care with other subjects of social work with families, children and youth concerning protection of the rights of the child and support of families which are found in difficult vital circumstances;

To provide 5) in time of preparation of the bill of introduction of amendments to the Law of Ukraine "About the Government budget of Ukraine for 2013" the expenses necessary for opening in the current year based on children's recreation camp "Vympel" of the National center "Small Academy of Sciences of Ukraine" of the international center of children's scientific creativity and ensuring its activities.

2. To the Ministry of Health of Ukraine:

1) to take additional measures concerning ensuring timely implementation of purchases and supply of medicines for treatment of the children sick with oncological and oncohematological, other irregular and rare shapes of diseases, to resolve issue concerning stock forming of such medicines in the state and municipal institutions of health care;

2) together with the Ministry of Internal Affairs of Ukraine to bring into three-months time form of the act of the child abandoned in maternity hospital, other institution of health care or which parents or other relatives, about the abandoned or found baby and procedure for filling of such act in compliance with regulations of the Family code of Ukraine refused to take away;

3) to develop and approve till December 31, 2013 normative legal acts concerning ensuring proper functioning of system of provision of complex medical care to the children sick with rare diseases.

3. To the Ministry of Education and Science of Ukraine, Ministry of Culture of Ukraine, Ministry of youth and sport of Ukraine:

1) to handle issue concerning determination of new approaches to training of pedagogical workers, trainers-teachers, specialists and other employees of out-of-school educational institutions and to their professional development, in particular, introduction in the highest pedagogical educational institutions and higher educational institutions of the sphere of culture of specialization "out-of-school education";

2) together with Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations to take measures concerning upgrade educational, material and technical resources of out-of-school educational institutions.

4. To the Ministry of Culture of Ukraine to develop and approve in six-months time standard rates of material logistics of out-of-school educational institutions, in particular children's music, art and choreographic schools, schools of arts, by the corresponding tools, accessories and stock.

5. To the ministry of social policy of Ukraine:

1) in three-months time:

a) take measures to enhancement of methodical ensuring activities of agencies of guardianship and cares, in particular, relatively:

obligation of observance of requirements of the Family code of Ukraine by preparation of offers concerning collecting of the child from parents without deprivation of their parent rights, concerning deprivation of the parent rights and taking into account at the same time information concerning acceptance of exhaustive measures for provision of necessary support to families with children who are in difficult vital circumstances;

non-admissions of cases of deprivation of persons of the parent rights because of their poverty or disability;

training of candidates for adoptive parents, guardians, custodians, adoptive parents, parents tutors, provisions of the corresponding conclusions and recommendations to specified persons;

implementation of supervision of conditions of accommodation and education of the adopted children, social maintenance of families in which adopted children, children pupils and children who are under guardianship or care, and also families with children which appeared in difficult vital circumstances are raised;

b) develop and implement technique of social work with children who suffered from criminal offenses or became witnesses of such offenses;

2) to develop and approve indicators of estimation of efficiency of activities of social workers, other specialists which provide social services to families with children till September 2, 2013;

3) to handle issue and to introduce in six-months time in accordance with the established procedure offers concerning determination of the ordering procedure by agencies of guardianship and care of social services for children and families with children which are provided by specialized institutions and organizations, public organizations.

6. To the Ministry of Internal Affairs of Ukraine to take additional measures relatively:

enhancements of activities in the sphere of protection of the rights and legitimate interests of minors, in particular when attracting them to responsibility, during pre-judicial investigation and their content under guards;
