Technical regulation "About Marking of Foodstuff"

1. This Law is directed to protection of life and health of citizens, the rights of consumers against the actions arising in the course of marking of foodstuff and is applied for the purpose of the prevention of the actions misleading consumers.
2. This Law establishes objects of technical regulation concerning which mandatory requirements about marking are established: rules of identification of objects of technical regulation; mandatory requirements to marking of objects of technical regulation and rules of its drawing; rules and forms of assessment of conformity of objects of technical regulation to requirements of this Law.
3. Requirements of this Law are obligatory for all legal entities and individual entrepreneurs performing activities for production (production) and turnover of foodstuff, rendering services in the sphere of retail trade by foodstuff in the territory of the Kyrgyz Republic and also for officials, representatives to exercise the state supervision of observance of requirements of this Law.
4. Requirements of this Law do not extend to foodstuff which production is performed by the organizations of public catering, except for the food packed-up products intended for retail sale.
For the purposes of this Law the following basic concepts are used:
antioxidant - the nutritional supplement intended for delay of processes of oxidation of fatty component of foodstuff;
fragrances - the nutritional supplement brought in foodstuff for improvement of its aroma and taste, representing mix of vkusoaromatichesky substances;
safety of foodstuff - the condition of foodstuff testimonial of lack of the unacceptable risk connected with harmful effects per capita;
biologically active nutritional supplements - the products containing the vitamins, mineral and other substances of natural origin promoting maintenance of health;
genetically modified products - the foodstuff made from the gene engineering modified (transgene) plants and animals;
date of production - end date of engineering procedure of production of the foodstuff released in the territory of the Kyrgyz Republic;
date of packaging (date of pouring for liquid products) - date of placement of foodstuff in consumer pack;
the statement for distinctive signs of foodstuff - the data containing in marking of foodstuff testimonial that this foodstuff has the properties distinguishing it from other foodstuff of the same group including about nutrition value, conversion methods, structure, the place of origin and advantage for health;
identification - establishment of identity of characteristics of foodstuff to its essential signs;
INS (International Numbering System) - the international digital system of codification of nutritional supplements included in standards for foodstuff of international commission in the Code Alimentarius (Codex Alimentarius) according to which to each additive it is appropriated digital three - or four-digit number with the letter E preceding it (in Europe);
ingredient (component) - substance of animal, vegetable, microbiological or mineral origin, and also the natural or synthesized nutritional supplements used in case of production of foodstuff;
kolyeretka - the label pasted on the upper part of bottle, containing the additional information about foodstuff (the endurance term, the trademark, etc.);
marking of foodstuff - the information on foodstuff intended for the consumer, applied in the form of texts, drawings, signs, symbols, other designations and (or) their combinations on consumer packaging, transport container or other type of the data carrier attached to packaging, container, or placed in packaging, container, or attached to packaging, container;
batch of foodstuff - set of the uniform foodstuff made and (or) packed in the identical conditions accompanied with one document certifying safety;
nutrition value - complex of properties of the foodstuff providing physiological needs of the person for energy and the main feedstuffs;
foodstuff - the product in the natural or processed type intended for the use by the person in food (including products of baby food, products of dietary food);
the address of food products - the movement of products from the manufacturer to the consumer covering all processes which there undergo products after completion of its production (storage, transportation and realization);
the seller - physical person or legal entity, irrespective of pattern of ownership, realizing foodstuff to consumers;
the consumer - the physical person or legal entity buying and receiving foodstuff for the purpose of satisfaction of the personal needs;
product of baby food - the foodstuff intended for food of children aged up to 14 years and meeting physiological requirements of children's organism;
product of dietary food - the foodstuff intended for clinical and preventive foods;
nutritional supplement - the natural or artificial substances and their connections which are specially entered into foodstuff in the course of their production for the purpose of giving to foodstuff of certain properties and (or) preserving quality of foodstuff;
storage duration - the period during which foodstuff in case of observance of the established storage conditions keeps the properties specified in the regulating or technical document;
expiration date - the period established by the manufacturer in coordination with bodies of health care in case of observance of certain storage conditions after which foodstuff is considered unsuitable for proper use;
container - the packaging of foodstuff for its delivery as separate subject which is closing foodstuff fully or partially, and including wrapper. The container can contain several units or types of packagings;
the trademark - the designation placed (put) on packaging of product of industrial or trade enterprise for individualization of goods and its producer (seller);
the label - the data carrier on which the descriptive product characteristic and his manufacturer enclosed or attached to each consumer packaging and (or) commodity unit is applied;
label - the data carrier about the packed foodstuff intended for drawing marking, attached or attached to packaging or put in packaging.
1. Information for the consumer shall be the consumer, unambiguously understood, complete and reliable for the purpose of the prevention of false representation, concerning structure, properties, nutrition value, the nature of origin, method of production and the use, and also other data characterizing directly or indirectly safety of foodstuff.
2. The manufacturer (seller) shall provide timely to the consumer the necessary and reliable information about foodstuff providing possibility of their right choice.
3. Information for the consumer is presented directly with foodstuff in the form of the text, symbols and drawings on consumer pack, the label, the counterlabel, kolyeretka, label, stopper, the insert by the method accepted for separate types of foodstuff.
4. The text of information for the consumer is put in the state and official languages. The text and texts can be duplicated in foreign languages. The text and texts shall meet standards of that language in which information on product is given. For import foodstuff information for the consumer shall be translated into state language.
1. The name of foodstuff specified in its marking shall contain the reliable information characterizing foodstuff and allowing consumers to distinguish it from other foodstuff.
2. When specifying the name of foodstuff relevant requirements of technical regulations for types of foodstuff shall be observed.
3. In the absence of technical regulations the name of foodstuff can be specified separate types of foodstuff according to the regulating document on standardization.
4. Information on distinctive conditions and special processing of foodstuff ("concentrated", "recovered", Sukhoi, "ground", "smoked", "sublimated", "pasteurized", "cooled", "refrigerated", "genetically modified", "irradiated with ionizing radiation" and others) is included in the name of product.
5. When marking foodstuff it is not allowed:
To specify 1) in the name of foodstuff components if these components or products of their conversion are not part of foodstuff;
2) to appropriate one name to different foodstuff.
6. The name of foodstuff to which the fragrances imitating availability of the components which are absent in this product are added shall be added with the words "with taste", "with aroma", "flavored" or similar words.
7. The name of product created according to the requirements stated above can be added with the brand name, including letters of the Latin alphabet, the name in the place of production, according to the name of the manufacturer of product and others, drawing trade mark (sign).
