About approval of the Procedure for providing persons exempted from serving sentence, food, clothes, footwear, payments by it of travel cards and issue of one-time money allowances

For the purpose of ensuring execution of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About approval, entry into force of the Code of execution of punishments of the Azerbaijan Republic and the questions of legal regulation connected with it" and the Code of execution of punishments of the Azerbaijan Republic approved by this Law" of August 25, 2000 the No. 388 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Procedure for providing persons exempted from serving sentence, food, clothes, footwear payments by it of travel cards and issue of lump-sum allowances" it (is applied).

2. Determine that the means required based on "Procedure for providing persons exempted from serving sentence, food, clothes, footwear, payments by it of travel cards and issue of lump-sum allowances are paid within the budget approved for Head department of execution of court decrees of the Ministry of Justice of the Azerbaijan Republic for 2001".

3. This resolution becomes effective from the date of signing.

According to article 176 of the Code of execution of punishments of the Azerbaijan Republic persons exempted from serving sentence in the form of imprisonment for certain term and lifelong imprisonment are provided with seasonal clothes, footwear, food and travel money for departure for the residence.

1. In case of absence at persons exempted from organizations of serving sentence, opportunity to acquire necessary seasonal clothes and footwear they are provided with clothes and footwear at the expense of the state budget.

2. Persons exempted from organizations of execution of punishments are provided with food taking into account time spent for the road to the residence. In case of impossibility of providing with food in nature for certain reasons 1 manat 10 kopeks for each day of stay in transit is paid to them.

3. The lump-sum allowance in the amount of 11 manats can be granted to persons exempted from places of detention in the absence of means on their personal accounts for the reasons which are not depending on them.

4. To persons exempted from organizations of serving sentence cost for the passenger ticket to the Nakhchivan Autonomous Republic and fare by shuttle buses to the residence in other areas is paid.

In case of use at the request of these persons of other transport services the difference in payment of journey becomes covered by them.

5. Funds for purchase to persons exempted from organizations of serving sentence it and issue of one-time money allowance are paid with food, clothes, footwear, payment of travel cards at the expense of the government budget of the Azerbaijan Republic.

6. Providing persons exempted from serving sentence with food, clothes, footwear, payment of travel cards it and issue of one-time money allowance is performed by administration of organization of serving sentence.
