About approval of Rules of use of means of the Reserve fund of the government budget

For the purpose of ensuring execution of Item 1 of the Presidential decree of the Azerbaijan Republic "About introduction of the Law of the Azerbaijan Republic "About the budget system" of October 31, 2002 the No. 809 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of use of means of the Reserve fund of the government budget" (are applied).

2. Declare invalid the resolution of the Cabinet of Ministers of the Azerbaijan Republic "About approval of "Provision on use of means of the Reserve fund" of March 27, 2000 No. 59 (except for Item 2).

3. This resolution becomes effective from the date of its signing.

Rules of use of means of the Reserve fund of the government budget

1. These rules are developed according to the Law of the Azerbaijan Republic "About the budget system" and the Presidential decree of the Azerbaijan Republic "About introduction of the Law of the Azerbaijan Republic "About the budget system" of October 31, 2002 No. 809 and determine rules of use of means of the Reserve fund of the government budget.

2. From the Reserve fund funds for unforeseen by the government budget of expenses, and also holding actions of the state and local value can be allocated.

3. In case of the appeal to the Cabinet of Ministers of the Azerbaijan Republic concerning assignment from the Reserve fund also the relevant proving documents shall be provided.

4. The Cabinet of Ministers of the Azerbaijan Republic, having studied the proving documents submitted to it on assignment from the Reserve fund, considers question of assignment from the Reserve fund and in necessary cases accepts the resolution (order).

5. Allocation from the Reserve fund of means based on orders, made in resolutions and orders of the Cabinet of Ministers of the Azerbaijan Republic, performs the Ministry of Finance of the Azerbaijan Republic in the appropriate order.

6. The funds allocated from the Reserve fund go only to those purposes which are specified in resolutions and orders of the Cabinet of Ministers of the Azerbaijan Republic.

7. In case of impossibility of expenditure of the funds allocated from the Reserve fund for the established purposes or in case of economy of allocated funds these means according to the existing legislation shall be without delay returned in their initial source.

8. If execution of the corresponding social and economic projects financed from the Reserve fund of the government budget requires more time, than the current fiscal year, use of the funds allocated for financing of project data can be continued also in the next budget year. In other cases the term of use of means of the Reserve fund expires for the end of the corresponding fiscal year.

9. Accounting of the funds allocated from the Reserve fund is conducted by the Ministry of Finance of the Azerbaijan Republic

10. The officials of the organizations who received means from the Reserve fund bear the direct responsibility for not target use of means in accordance with the established procedure.

11. Control of effective use of the funds allocated from the Reserve fund, and their expenditure is to destination performed by the Ministry of Finance of the Azerbaijan Republic.

12. The Ministry of Finance of the Azerbaijan Republic quarterly represents data on the funds allocated from the Reserve fund to the Cabinet of Ministers of the Azerbaijan Republic.
