About procedure of activities for management of apartment houses

According to part 1 of article 161 of the Housing code of the Russian Federation the Government of the Russian Federation decides:

1. Approve the enclosed Rules of implementation of activities for management of apartment houses.

2. To make to the Ministry of Construction and Housing and Communal Services of the Russian Federation explanations about procedure for application of the Rules approved by this resolution.

Rules of implementation of activities for management of apartment houses

I. General provisions

1. These rules establish standards and procedure of activities for management of the apartment house:

a) owners of rooms in the apartment house under direct management of the apartment house of owners of rooms in this house;

b) the condominiums, housing cooperatives, housing cooperatives or other specialized consumer cooperatives exercising control of the apartment house without the conclusion of the contract of management with management company (further respectively - partnership, cooperative);

c) the management companies which signed the agreement of management of the apartment house including in the case provided by part 14 of article 161 of the Housing code of the Russian Federation;

d) ceased to be valid according to the Order of the Government of the Russian Federation of 25.12.2015 No. 1434

e) the builders managing the apartment house to the conclusion of the contract of management of the apartment house with management company (further - the builder - management company).

2. Activities for management of the apartment house (further - management of the apartment house) are understood as accomplishment of the standards directed to goal achievement, the stipulated in Clause 161 Housing code of the Russian Federation, and also determined by the decision of owners of rooms in the apartment house.

3. Control is exercised concerning each certain apartment house as independent object of management taking into account structure, design features, degree of physical wear and technical condition of common property, depending on geodetic and climatic conditions of arrangement of the apartment house, and also proceeding from the minimum list of the services and works necessary for ensuring proper maintenance of the common property in the apartment house approved by the order of the Government of the Russian Federation of April 3, 2013 N 290 (further - the minimum list).

II. Standards of management of the apartment house

4. Management of the apartment house is provided with accomplishment of the following standards:

a) acceptance, storage and transfer of technical documentation on the apartment house and other documents connected with management of such house provided by the Rules of content of common property in the apartment house approved by the order of the Government of the Russian Federation of August 13, 2006 No. 491, of keys from the rooms which are part of common property of owners of rooms in the apartment house, electronic codes of access to the equipment which is part of common property in the apartment house, and other technical means and the equipment necessary for operation of the apartment house and management for them (further - technical documentation on the apartment house and other documents connected with management of such apartment house, technical means and the equipment), according to the procedure, established by these rules, and also their updating and recovery (if necessary);

b) maintaining the register of owners of rooms in the apartment house according to part 3.1 of article 45 of the Housing code of the Russian Federation, collection, updating and storage of information on employers of rooms in the apartment house, and also about persons using common property of owners of rooms in the apartment house based on agreements (according to the decision of general meeting of owners of rooms in the apartment house), including maintaining urgent lists in electronic form taking into account requirements of the legislation of the Russian Federation about personal data protection;

c) preparation of offers on content and repair of common property of owners of rooms in the apartment house for their consideration by general meeting of owners of rooms in the apartment house, including:
