About approval of Rules of conducting examination of technical safety

In pursuance of Item 2 of the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About technical safety" of February 2, 2000 the No. 269 Cabinet of Ministers of the Azerbaijan Republic decides:

1. Approve "Rules of conducting examination of technical safety" (are applied).

2. This resolution becomes effective from the date of signing.

Rules of conducting examination of technical safety

I. General provisions

1.1. These rules are prepared on the basis of the Law of the Azerbaijan Republic "About technical safety", the Presidential decree of the Azerbaijan Republic "About application of the Law of the Azerbaijan Republic "About technical safety" of February 2, 2000 No. 269 also is established by requirements to discipline of conducting examination of technical safety on potentially dangerous objects (further - "examination"), to creation and approval of the conclusion by its results.

1.2. According to article 14 of the Law of the Azerbaijan Republic examination expatiates "On technical safety" on:

* the project documentation on construction, expansion, reconstruction, technical updating, preservation and liquidation of potentially dangerous object;

* the equipment and technical installations used on potentially dangerous object;

* buildings and constructions on potentially dangerous object;

* the declaration of technical safety and other documents connected with operation of potentially dangerous object.

II. Conducting examination

2.1. Process of conducting examination shall be completely documented.

2.2. Process of conducting examination consists of the following stages:

a) preparation of the request, scheduled plan, agreement or other documents establishing conditions of conducting examination;

b) examination process;

c) experimental testimony issue.

2.3. The request or other documents establishing conditions of conducting examination

2.3.1. Expertize is carried out based on the request of the customer or other documents in accordance with the terms, approved between the customer and the expert organization.

2.3.2. Documents for conducting examination are constituted after carrying out preliminary negotiations.

2.3.3. In documents:

a) the parties signing the agreement are established;

b) objects of examination are established;

c) the list of data which according to the existing normative and technical documents are necessary for conducting examination of object is carried out;

d) the consent of the customer to observance of necessary requirements to conducting examination, including to payment of the expenses connected with conducting examination irrespective of its results proves to be true (except as specified, provided in article 26 of the Law of the Azerbaijan Republic "On regulation performed in the field of entrepreneurships and protection of interests of entrepreneurs);

e) terms of conducting examination are established.

2.3.4. The term of conducting examination is established depending on complexity of object of examination, however according to the existing normative and technical documents this term shall not exceed three months from the moment of receipt of complete set of proper materials and documents.

2.3.5. The expert organization starts conducting examination only after obtaining according to requirements of the existing normative and technical documents of complete set of proper materials and documents.

2.4. Examination process

Process of examination includes:

a) selection of the materials and documents necessary for conducting examination of object;

b) assignment of experts;

c) conducting examination.

2.4.1. Materials and documents necessary for conducting examination

For conducting examination the customer shall submit the following documents:

a) information about the customer and object of examination;

b) project, design, operational and repair documents on hazardous production facility, the declaration of technical safety of potentially dangerous object, the passport of technical constructions, instructions, production schedules, other documents with codes or other designations, necessary for identification (with indication depending on object of examination);

c) acts of testing, certificates (including, if necessary, about components), the calculations connected with determination of durability (if necessary);

d) equipment samples (if necessary).

2.4.2. In case of discrepancy of the provided materials and documents to the established requirements the expert organization according to the existing normative and technical documents sends to the customer the notice on terms of representation of complete set of materials and documents. The expert organization shall send the corresponding notice not later than to 7-day time from the date of receipt of materials.

If the requested materials and documents are not submitted within the terms coordinated between the customer and the expert organization, expertize is not carried out, and materials and documents return to the customer.

2.5. Assignment of experts

Experts shall be appointed officially, and their powers are determined by the expert organization in accordance with the established procedure.

2.5.1. For conducting examination one skilled expert, and if necessary - group of skilled experts is appointed.

2.5.2. In case of conducting examination by the group of experts the leading expert who is responsible for results of work of the group of experts is appointed.

2.6. Conducting examination

Conducting examination consists in establishment of completeness, reliability and reliability of the data provided for examination and also their compliance to standards, regulations and rules of technical safety.

2.6.1. In some cases the expert organizations can carry out testing by own forces by the techniques and programs approved with the customer.

2.6.2. If necessary the expert organization can carry out expertize directly on ekspertiruyemy object.

2.7. The expertize which is carried out directly on object

2.7.1. During the expertize which is carried out direct on object, experts observe normative work progress on object, and also carry out complex inspections for examination:

a) powers of employees and heads;

b) suitability of buildings, the instrument equipment, and also their condition from the point of view of servicing of test means and devices;
