For the purpose of ensuring execution of Item 3.4 of the Presidential decree of the Azerbaijan Republic "About modification of the Presidential decree of the Azerbaijan Republic of August 24, 2002 "About approval of the Regulations on procedure for consideration, acceptance and approval of regulatory legal acts of executive bodies" of July 27, 2011 the No. 483 Cabinet of Ministers of the Azerbaijan Republic decides No. 772:

1. Approve Rules of placement on the portal of "the electronic government" of projects of the regulatory legal acts prepared by the Cabinet of Ministers of the Azerbaijan Republic and the central executive bodies" it (is applied).

2. Charge to the Ministry of Communications and Information Technologies of the Azerbaijan Republic to provide in a month the technical capabilities necessary for placement on the portal of "The electronic government" of projects of the regulatory legal acts prepared by the Cabinet of Ministers of the Azerbaijan Republic and the central executive bodies.

3. This resolution becomes effective from the date of signing.

Rules of placement on the portal of "The electronic government" of projects of the regulatory legal acts prepared by the Cabinet of Ministers of the Azerbaijan Republic and the central executive bodies

1. General provisions

1.1. These rules are prepared for the purpose of ensuring execution of Item 3.4 of the Presidential decree of the Azerbaijan Republic "About modification of the Presidential decree of the Azerbaijan Republic of August 24, 2002 No. 772 "About approval of the Regulations on procedure for consideration, acceptance and approval of regulatory legal acts of executive bodies" of July 27, 2011 No. 483.

1.2. These rules establish rules of placement on the portal of "The electronic government" (further - the portal) projects of the regulatory legal acts (further - projects) prepared by the Cabinet of Ministers of the Azerbaijan Republic and the central executive bodies (further - owners of information), open discussion (further - discussion) projects (public or professional), and also provisions of answers by owners of information to persons participating in discussion.

1.3. Projects (except for the projects reflecting information which receipt is limited to the legislation) from the moment of the direction on coordination with the carrying out purpose for public or professional discussion are posted in the special section created on the portal for owners of information.

1.4. The technical capabilities necessary for placement on the portal of projects by owners of information are provided with the Ministry of Communications and Information Technologies of the Azerbaijan Republic.

1.5. Drafts of regulatory legal acts will be stirred on the portal from the moment of the direction on coordination by directly state body which prepared this project.

1.6. Persons wishing to participate in discussion of the project shall undergo necessary registration on the portal.

2. Placement of projects on the portal

2.1. For the purpose of ensuring placement of projects on the portal the owner of information identifies the responsible person and provides it with the digital signature.

2.2. The responsible person for placement of projects on the portal undergoes the corresponding authentication by means of the digital signature.

2.3. The responsible person, according to the technical requirements established by these rules prepares projects and posts in the special section of the portal according to the procedure corresponding to the instruction for use. The instruction for use is available in the special Section of the portal.

2.4. The project posted in the special section of the portal is submitted for discussion after check by the responsible person of the portal of its compliance to technical requirements identified by these rules.

2.5. If the project does not conform to technical requirements, the responsible person of the portal informs within 1 working day of the owner of information, having precisely specified shortcomings. After elimination by the owner of information of shortcomings within 1 working day the project is placed on the portal.

3. Technical requirements to placement of the project on the portal

3.1. In case of placement of projects on the portal by the owner of information provides the following:

3.1.1. the text of the project is prepared with use of the funds conforming to the international standard ISO 10646 (Unicode);

3.1.2. together with the project on the portal the following information is placed:

3.1.2.1. name of the owner of information;

3.1.2.2. name of the project;

3.1.2.3. discussion term;

3.1.2.4. the list of the state bodies and organizations participating in coordination of the project.

3.2. The body performing administration of the portal in case of placement of projects on the portal provides the following:

3.2.1. opportunity to projects of open and non-paid entry;

3.2.2. possibility of census and search of the complete text of the project or its any fragment;

3.2.3. openness of the notes and offers left on the portal faces concerning projects only to owners of information;

3.2.4. technical capability for the direction owners of information by means of the portal of answers to persons which left the notes and offers concerning projects.

4. Discussion of the project

4.1. In case of establishment by the legislation or at the request of rule-making body of two-month or shorter term for preparation of the project the owner of information shall establish term for discussion of the project less than 5 days, and in other cases less than 10 days.

4.2. Projects at which the term of discussion is complete are withdrawn from the portal.

4.3. In case of modification of the project taking into account the received notes and offers, the prepared new project is placed on the portal according to these rules from the moment of the direction it on coordination.

4.4. After the direction of new version of the project the reasonable answer about it goes for coordination or submissions to rule-making body on approval during the term established by the Law of the Azerbaijan Republic "About the address of citizens" to persons whose notes and offers were not accepted as reasonable by the state body which marked up the project on the portal by means of the portal.
