1. Approve "Regulations on procedure for provision of Internet access in public Items of use" according to appendix.

2. Determine that this Provision becomes effective after ten days from the moment of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

3. Consider No. 186 which voided the order of the Uzbek communication agency and informatization of July 5, 2004 "About approval of the Procedure for provision of Internet access in public Items of use".

Regulations on procedure for provision of Internet access in public Items of use

§ 1. General provisions

1. This Regulations on procedure for provision of Internet access in public Items of use (further - the Provision) determine procedure for rendering Internet access by Internet service providers of services in public Items of use and govern the relations between Internet service providers and users of services in public Items of use.

2. The following terms and determinations are hereunder used:

the operator of telecommunications (further - the operator) - the legal entity owning network of telecommunications on the property right or other corporeal rights, providing it functioning, development and rendering services of telecommunications;

The Internet service provider - the legal entity rendering services of Internet access on commercial basis;

public Item of use - the Item of rendering services of collective access for users to the Internet equipped with necessary technical means (computers, modems, telephone sets and other equipment);

the user of services the Internet (further - the user) - the physical person or legal entity which is the consumer of services of Internet access.

3. The operation mode of public Item of use is set by the Internet service provider of public Item of use.

4. In case of force majeure (military operations, earthquakes, floods, the fires, epidemics and others) specially authorized body in the field of communication and informatization has the right of priority use, and also restriction and suspension of functioning of technical means of the Internet service provider of public Item of use.

§ 2. General requirements to public Items of use

State registration and execution of allowing documents of activities of the Internet service provider of public Item of use for provision of services of Internet access are performed in the procedure established by the legislation taking into account non-admission of arrangement of public Item of use in basement or semibasement rooms of multi-storey buildings.

6. The activities connected with rendering services of Internet access through public Items of use in the territory of the Republic of Uzbekistan shall be performed based on the license granted by the Ministry of development of information technologies and communications of the Republic of Uzbekistan in the procedure established by the legislation.

7. For provision of services of Internet access, the Internet service provider of public Item of use establishes in public Item of use necessary technical means (computers, modems, telephone sets and other equipment), and also surveillance cameras for safety of visitors.

8. The uses used in public Item technical means of telecommunications, subjects of obligatory certification according to the legislation, shall have certificates of conformity.

9. Connection of the Internet service provider to network of the operator is performed on the specifications issued by the operator on the basis of the agreement.
